BOX 359 PRIOR LAKE, MINNESOTA 55372 s PLANNING COMMISSION - MINOTES- NOVEMR 15,1984 The November 15, 1984 meeting of the Prior Lake Planning Commission was called to order by Chairman Arnold at 7:30 P.M. Present were Commissioners Loftus, Felix, Roseth and City Planner Graser. Absent was Commissioner Larson. The minutes of the previous meeting were reviewed. Motion by Loftus to approve the minutes as presented, seconded by Roseth. upon a vote taken the motion was duly passed. Item I, Zoning Code Amendment for rear yard setback. Chairman Arnold called the Public Hearing to order at 7:35 P.M. City Planner Gra.;er camiented per memorandum dated November 8, 1984. Also stating that staff reccmnendation is: 1. Accessory structures of any size the setback to 10 feet. 2. Principal structures remain at 25 foot setback. At this time audience input was called for. Jim Weninger, 2591 Spring Lake Road, commented that there could be a problem with setting a precedent and filling a substandard lot with structures. At this time audience input was closed by Chairman Arnold. The Planning Ccm dssioners felt that 10 foot rear yard setbacks for accessory structures was consistent with other communities and seldom an issue in new areas. They also felt that the benefit of the code change would be to older neighborhoods with small lots. They also felt this would allow more people to use their property to the fullest. Motion by Roseth to recam;end to the City Council that the Zoning Code be amended to allow accessory structures a 10 foot rear yard setback but retain 25 feet for principal structures in all four residential districts. This will make better use of rear yard green space, by redesigning allow maximum design options, this is modernization but caution not to infringe on utility easements. The motion was seconded by Loftus. Upon a vote taken there were 2 ayes, 1 nay, the motion carried. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Motion by ROSeth to close the Public Hearing, seconded by Loftus. Upon a vote taken, the motion was duly passed. Item II„ Terry Peterson request for a 2.5 foot side yard variance for 15478 Red Oaks Road S.E. Mr. Terry Peterson was present to answer questions. Mr. Peterson commented on the request with the hardship being cost and! view. City Planner Graser commented per memo dated November 15, 1984. Stan Hamias, property owner of Lot 16, stated that he is in favor of the variance request. Motion by Loftus to approve a 2.5 foot side yard variance for 15478 Red Oaks Road S.E., since it is consistent with the character of the area and not detrimental to the property values, seconded by Roseth. Upon a vote taken, the motion was duly passed. Item III, Substandard Lots discussion with staff. City Planner Graser commented that 50 foot lots have presented a Problem with structure coverage and variance requests. The lots were assessed making them a buildable lot therefore the consensus is to grant buildings even tho they are substandard lots. Some of the questions are: What is an acceptable variance for substandard lot? Can there be enforcement of coverage ratio on 50 foot lots? Is there such a thing as an unbuildable lot? Can the Planning Commission request a building envelope on So foot lots before building? Jim Wenirger concerned citizen of Prior Lake commented on the substandard lots which he felt needed development guidelines which should come from the Planning Commission. The Planing Commissioners felt that the question of guidelines for substandard lots is a legal concern and asked staff to check with the City Attorney. Motion by Felix to adjourn the November 15, 1984 Planning Commission meeting, seconded by Loftus. Upon a vote taken, the motion was duly passed. The meeting adjourned at 10:20 P.M. The November 1, 1984 meeting of the Prior Lake Planning Commission was called to order by Chairman Arnold at 7 :30 P.M. Present were Commissioners Roseth, Larson, Loftus, Felix and City Consulting Planner Charles Tooker. The minutes of the previous meeting were reviewed. Motion by Felix to approve the minutes as presented, seconded by Loftus. Upon a vote taken, the motion was duly passed. Item I, Greg Springer request for Home Occupation Permit at 4165 Lord's Street N.E. Mr. Springer was present to answer questions. Mr. Springer commented on the request and does not want to go against ordinance. City Consulting Planner Tooker commented per memo dated November 1, 1984. Chairman Arnold at this time read a letter from a neighboring property owner with no objections. Exhibit "A ". Motion by Larson to deny the Home Occupation Permit request for 4165 Lord's Street N.E. for a small jewelry manufacturing business since it is not in compliance with paragraph A of Section 6.8 of the Zoning oDde and the definition of a Home Occupation, seconded by Felix. Upon a vote taken, the motion was duly passed. Item II, Gerald Brezinski request for a 4 foot side yard and a 29 foot lakeshore variance for Lot 7 Boudins Manor 2nd Addition. Mr. Brezinski was present to answer questions. Mr. Brezinski commented on the request and presented the Commissioners with pictures showing his house flooded, which he said happened 3 times. City Consulting Planner Tooker commented per memo dated November 1, 1984. Mr. Joe Whitney, 14492 Glendale, neighbor suggested that the request was too large as presented bu' would go along with a smaller side yard variance. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Motion by Loftus to approve a 2 foot side yard variance and a 29 foot lakeshore variance for 14498 Glendale Avenue S.E., since this would be consistent with previous development in the neighborhood. The location of the addition is dictated by the existing floor plan and will not be detrimental to this area. Seconded by Roseth. Upon a vote taken, the motion was duly passed. Motion by Larson to adjourn the November 1, 1984 Planning Commission meeting, seconded by Ruseth. Upon a vote taken, the motion was duly passed. The meeting adjourned at 8:20 P. M..
