BOX 359 PRIOR LAKE, MINNESOTA 56372 r ..: PLANNINC COMMISSION - MINUTES - October 18, 1984 The October 18, 198'e meetinq of the Prior Lake Planning Commission was called to order by '.')airman Arnold at 7:30 P.M. Present were Commissioners Roseth, Larson, Loftus and Administrative Assistant Marty Schmitz. Absent was Commissioner Felix arc? City Planner Craser. The minutes of the previous re:etinq were reviewed. Motion by Roseth to approve the minutes as presented, seconded by Loftus. loon a vote taken, the motion was duly passed. Item I, C. Lee Anderson request for a 20.7 foot front yard variance a 3 foot side yard variance from the west property line and an 8% coverage ratio variance continuation for 15389 Breezy Point !load. Mr. C. Lee Anderson was present to answer questions. Administrative Assistant Schmitz commented per memo dated October 15, 1984. Motion by Roseth to grant a 20.7 foot front yard variance, and a 3 foot side yard variance from the west property line and an 8% coverage ratio variance and the alternative plan A be submitted as amended and should read 20 X 20'garage since this is the only realistic solution to the situation, seconded by Loftus. Upon a vote taken, the motion was duly passed. Item II, continuation for John Casey's request for a variance from the Prior Lake Sign Ordinance to allow him to use 2 window boxes measuring 4 X 12 foot each. and attached to the exterior east wall of his store as a location for signs advertising specials and other current price promotions. Mr. Casey also felt that his window boxes closely resembled windows in physical appear- ance and definition. Mrs. Casey was present to answer questions. Administrative Assistant Schmitz commented per memo dated October 15. 1984. Also reading the letter from Attorney Kessel dated October 10, 1984. The Planning Commissioners commented on this variance with respect to a hard- ship. Motion by Roseth to deny the variance request from John Casey to allow him to use 2 window boxes measuring 4 X 12 feet each from the grounds that they do not comply with the definition of window as used in the Sign Ordinance, seconded by Loftus. Uocn a vote taken, I nay, 2 ayes, the motion carried. Discussion followed regarding the Sign Ordinance and Zoning Ordinance. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 369 PRIOR LAKE, MINNESOTA 56372 CITY OF PRIOR LAKE PLANNING COMMISSION - MINUTES - October 4, 1984 The October 4, 1984 neeting of the Prior Lake Planninn Commission was called to order by Vice Chairman Felix at 7:30 P.M. Present were Commissioners Larson, Loftus, Roseth and City Planner Eraser. Absent was Commissioner Arno'd The minutes of the previous meeting were reviewed. Correction as follows: Page 3, 3rd to last paragraph, 1st line, delete "by" and replace with "but ". Motion by Larson to approve the minutes as amended, seconded by Roseth. Upon a vote taken, the motion was duly passed. Item I, C. Lee Anderson request for a 20.7 foot front yard variance, a 3 foot side yard variance from the west property line and an 8% coverane ratio variance at 15389 Breezy Point Road. Mr. C. Lee Anderson was present to answer questions. City Planner Eraser commented per memo dated October 4, 1984. Motion by Roseth to continue this variance request by C. Lee Anderson to the next meeting_ October 18, 1984 to give the applicant time to confer with staff, seconded by Larson. Upon a vote taken the motion was duly passed. Item II, Fairview Properties request for a 15 foot lakeshore variance for Lot 4 Fairview Beach. Mr. Bryce Huemoeller was present to answer questions for the applicant. Mr. Huemoeller stated that he did not know the request was for over a utility easement and would amend his request to 144 sq. ft. for the deck and would not encroach on the utility easement, since this is an old platt and small lot. Mr. Bob Boeck, owner of Lot 3 commented that the survey the Planning Commission has is incorrect and presented another survev from the same company. Motion by Roseth to deny the variance request as presented for Lot 4 Fairview Beach but approve a 9 foot lakeshore variance for a wood deck not to exceed 144 cq. ft. and not encroach upon the west side property line or utility easement and observe the east side yard setback of 5 feet since this is not detrimental to the area, seconded by Larson. Upon a vote taken, the motion was dulv passed. (612) 447.4236 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Ttem III, Jeff and Judv CLarine request for a 12 foot front vard variance for 15611 Fish Point Road. Judy Clarine was present to answer questions. Citv Planner Craser commented per memo dated October 4. 1984. Motion by Loftus to approve the 12 foot front yard variance for 15611 Fish Point Road since the circumstances in this case are unique and the proposed resulting situation is within the intent and the spirit of the ordinance and not contrary to public inter- est, seconded by Roseth. Upon a vote taken, the motion was duly passed. At this time a 5 minute recess was called. The meeting resumed at 8:15 P.M. Item IV, Sohn Casey request for a variance from the Prior Lake Sign Ordinance to allow him to use 2 window boxes measuring 4X12 foot each, and attached to the exterior east wall of his store as a location foc signs advertising specials and other current price promotions. Mr. Casey also felt that his window boxes closely resembled windows in physical appearance and definition. Mr. Casey was nresent to answer questions. Mr. Casey commented on this request. City Planner Oraser commented per memo dated October 4, 1984. The Planning Commissioners commented on the request stating concerns with definition of window and signs. Motion by Roseth to continue this variance request to the next meeting October 18. 1984 to give staff time to get the City Attorney's clari- fication of window, seconded by Larson. Upon a vote taken, the motion was duly passed. Motion by Larson to adjourn the October 4. 1984 Planning Commission meeting, seconded by Roseth. dpon a vote taken, the motion was duly passed.
