September 20, 1984
The September 20, 1994 meetinn of the Prior Lake Planninq Commission was
called to order by Vice Chairman Felix at 7:30 P.M. Present were Commis-
sioners Larson, Roseth, Loftus and Citv planner Eraser. Chairman Arnold
arrived at A:no P.M.
The minutes of the previous meetinn were reviewed. Motion by Loftus to
approve the minutes as Presented, seconded by Poseth. Upon a vote taken
the motion was duly passed.
Item I, Lohart Renner request for a 5 foot side yard variance from the
east side property line and a 4.5 foot side yard variance from the west
side property line for 1493 Lori Road S.E. Lohart and Charlotte Renner
were present to answer questions.
City Planner Graser commented per memo dated September 20, 1984. Also
Mr. Graser received a call from Mrs. Tesarek abuttinn property owner
who lives in Chicago. Mrs. Tesarek had concerns as to how this variance
would affect her nroperty. She was assured that her property would be
treated as any other property would.
Motion by Larson to approve a 5 foot side yard variance from the east
side property line and a 4.5 foot side yard variance from the west side
property line for 1493 Lori Road S.E., since it is consistent with the
character of the area and will not infringe on anyones living environment
and not detrimental to any adjacent property values but would rather have
the tendency to increase them, seconded by P.oseth. Upon a vote taken,
the motion was duly passed.
At this time a 10 minute recess was called.
Chairman Arnold called the meeting to order at 7:55 P.M.
Item II, Gary G. Johnson request for a 4 foot side yard variance, a 4
foot rear yard variance and a 1% coverage ratio variance at 4434 Dakota
Street S.E. Len Grassini, contractor, was present to answer questions.
Len Grassini commented on the variance request for a garage and hobby
shop.
City Planner Graser commented per memo dated September 20, 1984.
At this time City Planner Graser presented 4 letters from neighbors

!lotion by Aoseth to approve a 4 foot . side yard variance, a 4 foot rear
vard variance and a 1% coverage ratio variance at 4434 Dakota Street
S.L., since it will not be detrimental to the general health and welfare
of the peonle and not detrimental to the pronerty values of the area,
seconded by Loftus. Upon a vote taken, the motion was duly Passed.
At this time a 10 minute recess was called.
The meeting resumed at a:25 P.M.
Item III, Dorth Co Development request for a 22 foot lakeshore variance
for Tract B of Biohm's Additon continuation. Brad Pothnem and Larry
Gensmer were nresent to answer questions.
Brad Pothnem commented on the variance request due to view factor,
cove problem and future county road access.
City Planner Craser commented per memo dated September 6, 1984.
Delores Blohm property owner commented that all the fees for the subject
site have not been settled.
The Planninq Commissioners had comments on the future road and its
ramifications.
Motion by Felix to approve a 22 foot lakeshore variance for Tract B of
Blohm's Addition, consistant with the development character of the
neiqhborhood and lonq ranqe planninq for potential public road servinn
this lot and neiqhborhood, seconded by Larson. Upon a vote taken,
the motion was duly passed.
At this time a 3 minute recess was called.
The meetinq resumed at 9:00 P.M.
Item IV, request by Jeffrey White for a 66.5 foot lakeshore variance
and a 3.1 foot side yard variance for Lot 1 Breezy Point. Mr. White
was present to answer questions.
Mr. White commented that the deck was built on its site due to a radical
hill and trees, also he presented the Commissioners with pictures of the
lot for review.
City Planner Craser commented per memo dated September 20, 1984.
Motion by Felix to deny the 66.5 foot lakeshore variance and a 3.1 side
yard variance as applied for Lot 1 Breezy Point on the qrounds that it
would be settinq a dangerous precedent and the ramifications of such a qreat
deviation would be almost impossible to reverse 8t the existing structure
be removed to some spot in conformance with the buildinq code within 30
days, seconded by Arnold. Upon a vote taken, the motion was duly passed.
item V, request for 40 foot Lakeshore and a 5 foot front vard variance
for Lot 1, 2, 3, of 9ed o1aks by David H. Watzl. Mr. Watzl was present
to answer questions.
Mr. Watzl commented that this is an unusual shared lot and thev are
trvinq to stav within code but there is no basement and storaqe space
is needed.
City Planner Craser commented per memo dated September 20, 1984. At
this time a letter was read from abuttinn property owner Morbert Traxler
supporting the pronosed, Exhibit "A ".
Motion by Larson to approve a 40 foot lakeshore variance and a 5 foot
front yard variance for Lot 1, 2, 3, of Red Oaks since it is consistent
with the character of the Red Oaks area and not detrimental to the
general health, and welfare and property values of the area, also
provided that the proposed boat storage house is in conformance with the
variance granted and the shed existino on the south property line be
removed, seconded by Arnold. Upon a vote taken, the motion was duly
nassed.
Item VI, request by David Kreye for a 2 foot side yard variance for
4341 Pleasant Street S.E.. Mr. Kreye was Present to answer questions.
City Planner Graser commented per memo dated September 20, 1994.
Motion by Loftus to approve a 2 foot side yard variance for 4341 Pleasant
Street S.E., since it is not detrimental to the neneral health and welfare
of the community, seconded by Roseth. Upon a vote taken, the motion was
duly passed.
Item VII request by David L. Freeborn for a 20 foot rear vard and a 5
foot side yard variance for 4359 Colorado Street S.E.. Mr. Freeborn
was present to answer questions.
Mr. Freeborn commented that there is a 10 foot drop on the property making
the site a problem and therefore needs the variance to place the structure
to fit
City Planner Craser commented per memo dated September 20, 1984.
The Planning Commission commented on this variance request and felt the
Council had set a precedent the Monday before therefore this request
with its hardship should be given consideration.
Motion by Larson to deny the variance as requested by qrant a 15 foot rear
yard variance and a 5 foot side yard variance for 4359 Colorado Street S.E.
seconded by Felix. Upon a vote taken, the motion was duly passed.
Item VIII, Zoning Ordinance Discussion regardinq the combat qame.
City Planner Craser commented per memo dated Sentember 20, 1984.
The Planning Commission had concerns over this type of commercial
recreation activity specifically in regards to noise, parking, access,
sanitary conditions, traffic and therefore should be regulated.
Motion by Larson that the combat game be classified an open land space
recreational use and therefore a Conditional Use in the A -1 District
and should come before the Planning Commission to acquire a permit
and business suspended until a permit is acquired, seconded by Roseth.
Upon a vote taken, the motion was duly passed.
Motion by Loftus to adjourn the Planning Commission meeting of Sept-
ember 20, 1984, seconded by Roseth. Upon a vote taken, the motion
was duly passed. The meeting adjourned at 11:20 P.M.

September 6, 1984
The September 6, 1984 meeting of the Prior Lake Planning Commission was
called to order by Chairman Arnold at 7:30 P.M. Present were Commissioners
Larson, Felix, Rosz-h, Loftus and City Planner Graser.
The minutes of the previous meeting were reviewed. Corrections as follows:
page 2, 2nd to last paragraph, 4th line, delete "with the question regarding
the use of the term "no person" being deleted ".
page 2, 2nd to last paragraph, 5th line after Larson add "Staff is directed
to look into the question of the specificity of the term 'no person "'.
Motion by Loftus to approve the minutes as corrected, seconded by Felix.
Upon a vote taken, the motion was duly passed.
Item I, review of Harbor P.U.D.. Mr. Wesley Green was present to answer any
questions.
City Planner Graser reviewed the background of the Harbor P.U.D. which
started in 1976 and the first phase approved in 1979. The P.U.D is moving
along to the satisfaction of the City.
Mr. We81ey Green commented on the Harbor P.U.D. stating that there are no
major changes from the orginial material submitted. Completion date is
hard to project since the economy has a lot to do with it.
Motion by Roseth to pass on to the Council no action taken on the Harbor
P.U.D. since it is moving along in an orderly fashion, seconded by Larson.
Upon a vote taken, the motion was duly passed.
At this time a 5 minute recess was called.
The meeting resumed at 8:15 P.M.
Item II, North Co. Development Inc. request for a 22 foot lakeshore variance
for Tract B of Blohm's Addition. No one was present to represent the applicant.
Motion by Larson to continue the North Co. Development Inc. request for a 22
foot Lakeshore variance for Tract B of Blohm's Addition to Seot:°mber 20, 1984
being the last item, seconded by Felix. Upon a vote taken, the .motion was
duly passed.

At ti,is time Staff read a letter from Don W. Johnston, 3960 - 140th
Street, reqardinq th combat name being played on abuttinq oroperty
and in violation of City Code.
Th(- Planninq Commissioners directed Staff to write a recommendation
rerR3rdinq this for the next Agenda.
Also at this time Staff asked for an opinion of the Commissioners
to Save a facilitator at the January 19, 1945 workshop. They all
agreed to a facilitator.
Motion by Felix to adjourn the September 6, 1984 meeting of the
Planninq Commission, seconded by Roseth. Upon a vote taken, the
meeting adjourned at 9:00 P.M.
