Cy Schweici - Conditional Use continuation
This item was continued for two weeks at the last
meeting to allow additional time for the applicant
to submit additional information and incorporate
several concepts into the development. To date
the developer has not complied with the request.

Recommend to schedule a hearing on 3- 18 -82.
Staff - Discussion
Staff has rewrittrin the section of the Zoning
Code dealing with house moving. Review and
approval is requested in order for the revised
section to be added to the already approved
ordinance.

PRIOR LAKE PLANNING COMMISSION

FEBRUARY 18, 1982
The February 18, 1982 meeting of the Prior Lake Planning Commission
was called to order at 7:35 P.M. by acting Chairman Roseth. Present
at the meeting were Commissioner's Foster, Fitzgerald, Arnold, and
City Planner Graser.
The minutes of the previous meeting were reviewed. Motion was made
by Foster to approve the minutes as written, seconded by Arnold.
Upon a vote taken, the motion was duly passed.
Item I, Conditional Use Continuation forCy Schweich. Mr. Schweich
contacted City Planner Graser and requested this item be tabled for
two weeks.
Motion was made by Foster to table the Conditional Use Permit
continuation to March 18, 1982 at 7:45 P.M., seconded by Arnold.
Upon a vote taken, the motion was duly passed.
Item II, Rezoning Hearing Schedule request by Wally Johnson. Mr.
Johnson was not present.
Motion was made by Arnold to schedule a Public Hearing for March 18,
1982 at 7:35 P.M., seconded by Foster. Upon a vote taken, the
motion was duly passed.
Item III, review by staff on House Moving for the Ordinance.
City Planner Graser made the presentation per memorandum.
Motion was made by Foster to incorporate the special exceptions
into the Ordinance, seconded by Fitzq�rald. The motion duly passed.
Motion was made by Fitzgerald to adjourn the meeting, seconded by
Arnold. The motion duly passed. The meeting adjourned at 8:12 P.M.

FEBRUARY 4, 1982
The February 4, 1982 meeting of the Prior Lake Planning Commission was
called to order at 7:35 P.M. by acting Chairman Roseth. Present at the
meeting were Commissioner's Foster, Fitzgerald, Cty Planner Graser.
commissioner Arnold was absent.
The minutes of the previous meeting were reviewed. Motion was made by
Commissioner Fitzgerald to approve the minutes as written, seconded by
Commissioner Foster. Upon a vote taken, the motion was duly passed.
Item I, Rezoning Request by Gary Hanson was called to order. Gary Hanson,
Norm Erickson, and Dean Morlock property owners were present to answer
questions.
City Planner Graser made a presentation as per his memorandum dated
February 4, 1982. He noted that Mr. Hanson is requesting the rezoning
of a parcel of land 1 acre lying directly southeast of intersection
of Franklin Trail and S.T.H. 13. The property is located at the northern
fringe of the S.T.H. 13 commercial strip which extends southward along
S.T.H. 13 for 1.9 miles. Mr. Hanson is requesting rezoning to B -3.
City Planner Graser stated that this application is in direct conflict
with Prior lake's Comprehensive Plan. "To create unified fully developed
commercial service centers, all shopping will be confined to the downtown
Brooksville Center and a neighborhood oriented center at the intersection
of County Rd. 42 and Highway 13." Also this area has been denied rezoning
twice by the City Council.
Staff's recommendation was to deny this petition for rezoning of the property.
Norm Erickson said it would be common sense and only good judgement since
the corner is natural for commercial.
Wally Johnson ajoining property owner felt a rezoning was needed.
Howard Olson ajoining property owner directly east stated that it is
evident the property is commercial.
Discussion followed by the Planning Commissioner's. Commissioner Foster
felt the request was premature due to the new 9 member committee assigned
by the Mayor to look into future Commercial & Industrial Property sites.
Commissioner Fitzgerald questioned why the request was for B -3 instead
of B -1, but felt a B rezoning was adequate for this property. Commissioner
Roseth stated that the Comprehensive Plan was approved by thb Commission
and should be a guideline. Also he felt a sketch or something tangible
was needed to show what would be built on the property. At this time

acting Chairman Roseth read a letter submitted by Mr. Jay Willemssen
for the Scnool Dist. 719, "Exhibit A ", Which was opposed to a business
strip.
Motion was made by Fitzgerald to deny the B -3 rezoning request and approve
or recommend to the City Council to approve B -1 rezoning for the parcel.
The motion was amended by Fitzgerald to recommend to City Council a denial
of B -3 rezoning but recommend to City Council B -1 rezoning for the refer-
enced parcel but also to bring this before the Industrial /Commercial Commit-
tee for review and comment if ,appropriate.
Acting Chairman Roseth called for a vote on the amended motion. It was
seconded by Commissioner Foster. Upon a vote taken, two ayes, one naye
the amended motion passed.
Motion was made by Fitzgerald to adjourn the Public Hearing seconded by
Foster. Upon a vote, the motion was duly passed.
Acting Chairman Roseth called for a five minute recess.
The Planning Commission meeting reconvened at 8:50 P.M.
Item II, a Conditional Townhouse Use Permit request by Cy Schweich,
Mr. Schweich and son, Greg were present to answer questions.
City Planner Graser made a presentation to the Planning Commission. He
noted that Mr. Schweich is requesting a conditional use permit to construct
townhouses on 5.92 acres. This property is zoned R -2 with a permitted
density of 6 units per acre. The three parcels should be handled separately
from a density standpoint. He noted that the site is extremely prone to
erosion once construction is started, precaution should be taken to reduce
the potential for sediment erosion into the creek. A grading plan will be
required with established building elevations and street slopes. The culvert
size must be established which in turn has a. direct effect on low slab
elevations. The slope between finished road grade and building to creek
channel must be established. Staff presented several site plans which would
be feasible. Staff recommends the Planning Commission establish if this
concept is feasible, then evaluate the individual parcels. If additional
information is desired make a list and inform the developer.
Motion was made by Fitzgerald to table the request for two weeks until the
developer could give staff a better site plan and details, seconded by
Poster. Upon a vote taken, the motion was duly passed.
Motion was made by Commissioner Foster to adjourn the Planning Commission
meeting, seconded by Fitzgerald. Upon a vote taken, the motion was duly
Passed. The meeting adjourned at 9:40 P.M.
