JULY 29, 1982
The July 29, 1'-�2 meeting of the Prior Lake Planning Commission was called
to order at 7:3` P.M. by Chairman Roseth. Present at the meeting were
Commissioner's ester, Felix and City Planner Graser. Absent were Arnold
and Fitzgerald.
The minutes of the previous meeting were reviewed. Motion was made by
Foster to approve the minutes as presented, seconded by Felix. Upon a
vote taken, the notion was duly passed.
Item I, Public nearing for Sand Pointe P.U.D. for Denny Me Williams was
called to order. Mr. Me Williams was not present. Representive James
Hill, Almac, was present to answer questions.
City Planner Graser reviewed and commented per memorandum dated July 22,
1982.
James Hill, Almac, commented on the Sand Pointe P.U.D. stating that
no lots brve been sold for 2 years. Therefore there has been a change
in plans from twin and quads to all single family homes, 1 out of 4(25 %,)
will have no garage but the otl,ars will have double garages. At this
time there are three contractors /builders interested in buying the
parcels. The idea 's to furnish homes for young married people who cannot
afford housing too expensive. The open space and park will stay the same.
If staff needs elevation it will be provided. R -2 And R -4 zoning needs
60 ft. lots and we have 65 ft. lots. We are providing priced housing
needed in Prior Lake. The acreage will meet the requirements needed.
This is a 2 - 3 year project.
At this time Chairman Roseth called for input from the audience.
Cleve Mickley, 14476 Shady Beach Trail commented on the presented P.U.D.
The Planning Commissioners commented on the P.U.D. and felt it was good
but needs further information to staff on details if approved.
At this time Chairman Roseth stated that the plat map of Sand Pointe
Phase 1 Revision be made "Exhibit A" for the record.
Motion was made by Foster to approve the Replat of Sand Pointe Phase 1
P.U.D. with the stipulation that Outlot C & G remain designated as
park land with a satisfactory review of the building design at the time
that the design is presented and the elevation of the housing units meet
the requirements & that not more than 25% of the houses be built with
out garages, seconded by Felix. Upon a vote taken, the motion duly passed.

Motion by Poster to close the Public Hearing, seconded by Felix. Upon
a vote taken, the motion was duly passed.
Item II, Conditional Use Permit request by James Hill. Mr. Hill was
present.
City Planner Graser commenced per memorandum dated July 29, 1932.
Mr. Hill commented on the Conditional Use Permit request for an
ice arena. The parking facility holds space for 5 -7 people per
stall. The materials will be fabcon and /or block. Financing can
be available to the staff. The facility will have sewer and water.
Otherwise all requirements are meet for a Conditional Use Permit
in C -1 zoned property. Also the drainage and erosion control would
be submitted along with the landscape plan at the time of building
permit request.
The Planning Commissioners commented on the request with concerns
of the parking, building materials, financing, drainage, erosion,
and landscaping.
Mr. Hill commented that all these concerns would be met as per staff's
satisfaction.
Motion was made by Foster to approve the Conditional Use Permit request
to a C -1 Conservation District for the ice arena with the contingency
that the landscaping plan, the drainage, the financial report /projections
the breakdown of hours of operation, peak demand, marketing area, exterior
wall materials & parking be submitted and approved by staff prior to the
application for the building permit, seconded by Felix. Upon a vote
taken, the motion was duly passed.
Item III, Variance request for Bob Boegeman. Joe Mahoney, builder,
was present to answer questions.
City Planner Graser commented per memorandum dated July 29, 1982
Motion by Foster to approve a 4 ft. side yard variance for walkway
to deck for Lot 4, Block 37 Spring Lake Village, seconded by Felix.
Upon a vote taken, the motion was duly passed.
Item IV, Variance request for Joseph Reseland. Mr. Reseland was present.
City Planner Graser commented per memorandum dated July 29, 1982.
The Planning Commissioners commented on the item.
Motion was made by Foster to approve an 8 ft. side yard variance from the
west property line for Lot 5 Fairlawn Shores provided that the garage be
no closer than the extension of the addition in a straight line for the
22 X 36 ft. garage, seconded by Felix. Upon a vote taken, the motion passed.
Motion was made by Foster to adjourn the Planning Commission meeting,
seconded by Felix. Upon a vote taken, the motion passed. The meeting
adjourned at 9:45 P.M.

JULY 1, 1982
The July 1, 1982 meeting of the Prior Lake Planning Commission was called to
order at 7:30 P.M. by Chairman Roseth. Present at the meeting were Commissioner's
Foster, Fitzgerald, Felix, Arnold and City Manager McGuire.
The minutes of the previous meeting were reviewed. Motion was made by Arnold
to approve the minutes as presented, seconded by Felix. Upon a vote taken,
the motion was duly passed.
Item L, Variance request by Leore Boltz. Mr. & Mrs. Boltz were present.
City Manager McGuire commented on this item per memorandum dated July 1, 1982.
Mr. & Mrs. Boltz commented that others have variances, why can't us.
Chairman Roseth stated that.had nothing to do with this variance.
Mr. & Mrs. Boltz stated the reason for the variance was a gravel drive which
is already there and the roof line.
The Planning Commissioners commented on this item.
Motion by Foster to deny the 3' side yard variance for Lot 34 and the westerly;
24' of Lot 35 Fairview Beach due to no justification of hardship, seconded by
ARnold. Upon a vote taken the t:)tion was duly passed.
Chairman Roseth asked City Winger McGuire to send a letter to the Boltz's
stating that they have the'option to appeal the motion before the Council
also that they have a buildable lot and the building plans could work nicely
on the lot. i
City Manager McGuire staled that he would get a letter out to the Boltz's.
Item II, Variance request by Harold Gustafson. Mr. Gustafson was persent.
City Manager McGuire commented on this item per memorandum dated July 1, 1982.
Motion to approve the request for a 5' side yard variance for 14852 Oakland Beach
Ave. SE, Lot 8 & k of Lot 9, Oakland Beach, was made by Fitzgerald, seconded by
Felix. Upon a vote taken, the motion was duly passed.
Motion was made by Fitzgerald to adjourn the Planning Commission meeting, seconde
by Arnold. Upon a vote taken, the motion passed. The meeting adjourned at 8:05
