BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - MINUTES - MARCH 18, 1982 The March 18, 1982 meeting of the Prior Lake Planning Commission was called to order at 7:35 P.M. by Chairman Roseth. Present at the meeting were Commiisaioner's Arnold, Felix and City Planner Graser. Absent were Commissioner's Foster and Fitzgerald. The minutes of the previous meeting were reviewed. Motion was made by Commissioner Arnold to approve the minutes as presented, seconded by Commissioner Felix. Upon a vote taken, the motion was duly passed. Item I, Rezoning Hearing for Wally Johnson was called to order. Staff commented that Mr. Johnson called to withdraw his application at this time due to action of the City Council and will wait for the outcome of the Industrial /Commercial Committee's findings which will effect the adjacent property owners. No action was taken. Item II, Review of Mobile Home Ordinance by Staff. City Planner Graser reviewed the Mobile Home Ordinance stating that the City needs the protection of this ordinance since there isn't one now. The following corrections were made: Section 2, A, #13 to read "Signs identifying the park shall comply with the Prior Lake Sign Ordinance." Section 2, E, #6 a period after streets and delete "carrying major traffic flow." Section 2, E, #7 change "done by" to ?responsibility of" Section 2, G, change Five (5) to Fifteen (15) Section 3, A, delete last sentence and add "Such inspection fee shall be set from time to time by the City Council." Section 3, B, delete last sentence in parentheses. Section 3, E, change $300.00 to $500.00 Motion was made by Arnold to pass the Mobile Hpme Ordinance as amended and to submit it to the City Council for approval, seconded by Felix. Upon a vote taken, the motion was duly passed. Motion was made by Arnold to adjourn the Planning Commission meeting, seconded by Felix. L'pon a vote taken, the motion was duly passed. BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - MINUTES - March 4, 1982 The March 4, 1982 meeting of the Prior Lake Planninq Commission was called to order at 7:30 P.M. by Chairman Roseth. Present at the meeting were Commissioner's Arnold, Foster, Fitzaerald, City Planner G rase£ a City Consulting Planner Tooker. Absent was Commissioner Michael Felix. The minutes of the previous meeting were reviewed. Motion was made by Commissioner Arnold to approve the minutes as written, seconded by Commissioner F =_r >ter. Upon a vote taken, the motion was duly passed. Item I, Home Occupation Permit for Steve Collins was called to order. Mr. Collins was present to answer questions. City Planner Graser stated that Mr. Collins is requesting a Home Occupation Permit for a Photography Studio in his home at 4500 Colorado Street SE. Staff recommended approval since it would not be obje ^tionable to the neighborhood nor cause the residential character of the neighborhood to deteriorate. Motion was made by Foster to approve the Home Occupation Permit, seconded by Arnold. Upon a vote taken, the motion duly passed. Item II, Continuation of Townhouse Conditional Use for Cy Schweich. Cy Schweich, Ted Schweich and Greg Schweich were present to answer questions. City Planner Graser stated staff's position which included the following points: 1.) The plan submitted for this hearing incorporated some of the Planning Commission's suggestions with respect to design. 2.) The plan did not go into detail or provide a clear description of the platting and development of this proposal. 3.) Postponing the submittal of information (mostly engineering) until preliminary plat could result in redesign of the plat due to engineering requirements or unforseen circumstances. 4.) The natural amenities have not been addressed with respect to prservation and integration in the planning process. Mr. Schweich presented a letter ( Planning Commission Exhibit "B ") to the Planning Commission which he reviewed in detail. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 The Planninq Commission reviewed Plannina Commission Exhibit "A" which is the site map submitted by the applicant with the followinq recommend- ation to oo to the Council.: Motion by Fitzgerald seconded by Foster to: 1.) Grant an 8' rear yard variance for the four units consisting of block 2. 2.) The culvert and size necessary to build the road servinq block 6 and 7 be determined. 3.) The proposed dam and potential high water elevation and the effects it would have on this plat be reviewed by the Citv Enaineer. 4.) An appropriate landscape plan be approved by staff. 5.) Block 8 and 9 shall only be serviced by two access drives. 6.) ugly five units north of Cates Street be permitted to be consistant with the Zonina Ordinance. Upon a vote taken, the motion duly passed. At this time Chairman Roseth called for a 5 minute recess. The Plannina Commission meeting reconvened at 9:45 P.M. Item III, Variance request by Mark Hyland was called to order. Mr. Hyland was present to answer questions. City Planner Grazer commented that Mr. Hyland is requesting a 5.5' side yard variance from the north property line and 2' side yard variance from the south property line for Lot 36, Boudins Manor. Staff recommended approving the 2' side yard variance from the south property line and a 4.5' side yard variance from the north property line. Mr. Hyland stated that the 34' garage side was incorrect it should be 24'. Also Mr. Hyland stated he needs the 5.5' variance to accommodate 2 cars which will just barely fit. Motion was made by Fitzgerald seconded by Arnold to approve the variance per staff recommendation since the variance would perserve the residential characteristics of neighborhood and consistant with previous actions on similar situations. Item IV, Discussion by Staff and Planning Commission on Rural Land Use Density. City Consulting Planner Tooker referred to Memorandum dated January 15, 1982 on Agricultural Zoning in Prior Lake. Mr. Tooker feels the Comprehensive Plan should be changed at this time per the model distributed by the Metro Council. The Planning Commissioners discussed this item at length and the Zoning Ordinance is adequate for now and until changes are needed to keep it as such. Motion was made by Fitzgerald, seconded by Arnold to reject the Agricultural density concept and retain the 10 acre minimum lot size but reduce the front footage requirement or width to 330' based on: 1.) The density concept is fraught with problems. 2.) The density concept would be an impossible administration problem. 3.) The density concept would constantly generate variances due to unique situations. 4.) If the density concept is tested and proven cumbersome then the reversal to original concept would be cumbersome. Motion was made by Commissioner Arnold to adjourn the Plannina Commission meetinc, seconded by Foster. Upon a vote taken, the motion was duly passed. The meeting adjourned at 10:40 P.M.
