BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PLANNING COMMISSION - MINUTES- October 21, 1982 The October 21, 1982 meeting of the Prior Lake Planning Commission was called to order at 7:35 PM by Chairman Roseth. Present were John Fitzgerald, Chuck Arnold, Tom Fo- Mike Felix and City Planner Graser. The minutes of the previous meeting were reviewed. Motion was made by Fitzgerald to approve the minutes as presented, seconded by Arnold. Upon vote taken the motion was duly passed. Item I, Variance request by Michael Mraz. Mr. Mraz was present to answer questions. City Planner Graser commented per memorandum dated Oct..ber 21, 1982. Motion was made by Fitzgerald to approve the 15 ft. rear yard variance for Lot 32 Green Heights due to a previous precedence set and the garage is not detrimental to the valuation of the neighboring property or the general health, and welfare of the community, seconded by Arnold. The motion duly passed. Item II, Variance continuation request by Gary Burkhart. Mr. Burkhart was present to answer questions. City Planner Graser commented per memorandum dated October 7, 1982. Mr. Burkhart commented that he needs the width for a 16 ft. garage door and finish material to make the new addition look blended with the existing structure. The Planning Commission had concerns on the large deviation from the code and precedence setting. Motion was made by Foster to deny the 20 ft. front yard and 5 ft. side yard variance as requested because the variance would be too extreme and precedent setting but to approve the 11 ft, front yard variance to allow a 14 ft. front garage and approve the 5 ft. side yard variance for Lot 1 First Addition to Lakeside Manor. Also the 11 ft, variance would not be that detrimental to the property value of the neighborhood. Granting is due to a lack of consideration and the garage is built into the hillside and will not be detrimental to any use and only the roof of the garage will be exposed and will not cause any detriment, Seconded by Felix. P.O. BOX 359 PRIOR LAKE, MINNESOTA 56372 CITY OF PRIOR LAKE PLANNING COMMISSION - MINUTES - October 7. 1982 The October 7, 1982 meeting of the Prior Lake Planning Commission was called to order at 7:30 PM by Chairman Roseth. Present were John Fitzgerald, Chuck Arnold, Tom Foster, Mike Felix and City Planner Graser. The minutes of the previous meeting were reviewed. Motion was made by Arnold to approve the minutes as written, seconded by Fitzgerald. Upon a vote taken, the motion was duly passed. Item I, Tom Steffen's P.U.D. continuation was called to order. Mike Gair, Consulting Planner, Bob Fein, Engineer, Mr. Knoblaugh were present to answer questions. City Planner Graser reviewed the previous discussions on the P.U.D. and commented on the P.U.D. per memorandum dated October 5, 1982. Mike Gair, Consulting Planner for the P.U.D. reviewed the P.U.D. and stated that they are asking 25% credit on density. At 8:00 PM the P.U.D. was tabled for one hour due to a Public Hearing. Item II, Cy Schweich, Public Hearing for Lakeside Fstates was called to order at 8:05 P.M. by Chairman Roseth. Ted and Greg Schweich were present to answer questions. City Planner Graser commented per Memorandum dated October 7, 1982 also stating that the setbacks were checked out this day and there is no violation. The Planning Commissioners had comments on the Preliminary Plat Plan. Motion was made by Fitzgerald to approve the Preliminary Plat Plan seconded by Foster. Upon a vote taken the motion was duly passed. Motion by Fitzgerald to close the Public Hearing, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item III, Variance request by Gary Burkart was called to order. Mr. Burkart was present to answer questions. City Planner Graser commented per Memorandum dated October 7, 1982. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 At this time a letter from "Penny Barncard adjacent property owner" was submitted for the record "Exhibit A ". Mr. Burkart commented on his request changing it from 20 ft. front yard to 18 ft. front yard variance request. Motion was made by Foster to table P,r. Gary Burkart's request for a variance for two weeks until October 21, 1982, seconded by Fitzgerald. Upon a vote taken, the motion was duly passed. At this time the P.U.D. for Priorview was continued. Mr. Mike Gair commented for the applicant. Audience input was asked for at this time by Chairman Roseth. Bill Doheny, 16686 Creekside Circle, has concerns over the height of the buildings and density of the proposal. The Planning Commissioners had comments and concerns of the P.U.D. and a vote was taken for denisty bonus calculation. Motion by Fitzgerald to grant preliminary approval for the Priorview P.U.D. at this level based on the following items ' :that the developers cooperate and obtain the nece -sary approvals in orde to install a roadway from High- way 13 to the northerly edge of the property line, that a park dedication fee be established, that a more specific exterior and landscaping plans reflecting berming as to house screening to the east be developed and in- corporated in the final plan, that a sidewalk be constructed on the east side of Five Hawks from Highway 13 to north edge of the property, that the existing dirt path be improved to woodchip and submitted along with the final plans, and that the project have maximum density of 106 units based on the following calculations 17.45 acres less wetland area'2.4 equalling 15.05 calculable acres times 5.5 units per acre arriving at 83 units times the following density bonuses 10% for open space considering the sidewalks the natural walkways and a proposed'improvement of wildlife status of the ponding area subject to the ability to do so from the DNR standpoint., that 10% density be given for siting of the units on a rather complex site, that a 211% density bonus be given the semi - collector status of the roadway serving the church and school areas on the southernly edge'of the property and a 5% density bonus be given for the difficult physical characteristics of the property intrinsic to the site arriving at'2V,% density bonus times 83 potential units equalling 106 units and that Preliminary Engineering Plans be submitted to the City Engineer and the Preliminary Plat Plan as Exhibit "A ", seconded by Foster. Upon a vote taken, the motion was duly passed. At this time an unscheduled Item, Gary Revak's request for an Occupance Permit and an extension of one year to complete his commercial building. Mr. Revak was percent to answer questions. City Planner Eraser commented stating that Mr. Revak was granted a variance 2 years ago for his commercial building with conditions of completion. One of the five items was the completion of the exterior. At this time Mr. Revak would like to complete the outside with s'tucce but cannot afford to do so now.but would be able to in one year. Therefore Mr. Revak is requesting an extension of one year to complete t'.e exterior and an Occupancy Permit so a tenant can move in. Mr. Revak commented on his request stating that stucco is better than paint. but more expensive. The Planning Commissioners had concerns over the time element. Motion was made by Foster to give Mr. Revak one year time frame to improve the exterior texture of the building and a temporary Occupancy Permit till October 1, 1983, seconded by Fitzgerald. Upon a vote taken, the motion duly passed. Motion was made by Arnold to adjourn the Planning Commission meeting, seconded by Fitzgerald. Upon a vote taken, the motion was duly passed. The Planning Commission meeting adjourned at 10:33 P.M.
