DECEMBER 17, 1981
The December 17, 1981 meeting of the Prior Lake Planning Commission was
called to order at 7:37 P.M. by Vice Chairman Roseth. Present at the
meeting were Commissioner's Arnold, Foster, Fitzgerald, City Planner
Graser, City Planning Consultant Tooker and City Manager McGuire.
The minutes of the previous meeting were reviewed. Motion was made
by Commissioner Foster to approve the minutes as written, seconded
by Commissioner Arnold. Upon a vote taken, the motion was duly passed.
At this time Commissioner Fitzgerald excused himself due to special
interest in the up coming item.
Item I, Fitzgerald -Tupa Preliminary Plat Public was called to order.
Present at the meeting were: Mr. John Fitzgerald and Mr. 6 Mrs.Tupa to
answer questions.
City Planner Graser made a presentation to the Planning Commission as
per memorandum dated December 17, 1981.
Mr. Fitzgerald commented on this request. He commented that the property
is being torrenced.
Mr. Tupa presented a map of the easement to zhe Commissioners
Motion was made by Commissioner Arnold to approve the Preliminary Plat as
presented as per staff's recommendation 1. Park dedication as established
by Bill Mangan. 2. Northeast corner of Lot 2 being dedicated to the City
for roadway. 3. Sewer $ Water stubs will be installed at the cost of the
developer. and the Preliminary Plat map be marked as Exhibit "A", seconded
by Foster. Upon a vote taken, the motion was duly passed.
At this time ,John Fitzgerald rejoined the Planning Commissioners.
Item II, a variance request by Jeff Dousette and Karl Bohn was called to
order. Mr. Dousette and Mr. Bohn were present to answer questions.
City Planner Graser Commented on this request. The applicant is requesting
a 10' front yard variance and a 40' lakeshore variance since this is consistant
with an earlier variance and is within the spirit and intent of the City Code.
Make the variance contingent upon a maximum coverage ratio of 30o and issue
no occupancy permit for house construction until the City has constructed
a public road serving North Grainwood.

Mr. Bohn and Mr oouse[te commented on this and felt they had no problem
with the recommendation.
Mr. Will Williams a concerned property owner in this area wanted to make
sure he has a buildable lot.
City Manager McGuire stated that the City has the right -of -way to the
property but that a preliminary hearing before the District Court was set
for January 1982 to settle the awarding of money to a property owner
in this area.
Motion was made by Commissioner Fi`zgerald to approve the 10' front yard
variance and a 50' lakeshore variance with the maximum coverage ratio of
30' and no occupancy permit be issued until a public road has been constructed.
Also ',— developer be cautioned in this manner of the public road, seconded
by Arnold. Upon a vote taken, the motion was duly passed.
Item III, the Prior Lake Zoning Ordinance was called to order at 8:36 P.M.
City Planning Consultant made presentation of the ordinance.
Primary discussion of the Zoning Ordinance focused on the Agri. land use
density. Vice Chairman Roseth called for a written explanation of the
4 for 40. at the next discussion of the Zoning Ordinance.
Motion was made by Commissioner Arnold to adjourn the Planning Commission
meeting, seconded by Foster. Upon a vote taken, the motion was duly passed .
and the meeting was adjourned at 9:40 P.M.

MINUTES -
DECEMBER 3. 1981
The December 3, 1981 meeting of the Prior Lake Planning Commission was
called to order at 7:40 P.M. by Vice Chairman Roseth. Present at the
meeting were Commissioners Arnold, Fitzgerald, Councilman Bissorett and
City Planner Graser. Commissioners Wilker and Foster were absent.
The minutes of the previous meeting were reviewed. The following correct-
ion was made to paragraph 9, 1st sentence to add after the word recommend-
ation "and to add that the coverage ratio not exceed 30 % ". Motion was
made by Fitzgerald to add the correction, seconded by Arnold. Upon a vote
taken the motion was duly passed. Motion was made by Arnold to approve
the minutes as amended, seconded by Fitzgerald. Upon a vote taken the
motion was duly passed.
Item I, Continuance of Variance for Crown Oil Company was called to order.
Mr. Ron Riviere was present to answer questions.
Mr. Riviere stated that he contracted James Benshoof, P.E. to do a traffic
analysis for the Crown Oil site. Mr. Benshoofs comments and findings were
presented by Mr. Riviere. The comments were marked Exhibit " A " and entered
into the record.
Motion was made by Fitzgerald to approve a 30' front yard variance for the
existing pump islands contingent upon the following items:
1. The easterly radius of the existing driveway be widened
as per attached Exhibit ".A ".
2. That one parking stall per 250 feet of floor area be
delineated for the site.
3. The existing gravel surface area northeast in the north-
east portion of the site be improved to encourage traffic
in that direction.
Improved meaning a bituminous or concrete surface. As per improved as per
Exhibit "A ". This improvement is to be completed no later than June 15, 1982.
Item II, Cy Schweich Rezoning Public Hearing was called to order. Mr. Schweich
was present to answer questions.
Mr. Birdsong a concerned citizen and adjacent property owner was there to
provide input to the hearing.

Staff presented its prepared comments and two attached memorandums
on Schweich Rezoning. Staff recommended that the application be denied
on the basis that the application was not comprehensive in nature and
would result in overall density higher than R -2.
Mr. Schweich's comments primarily geared towards Holly Court. He stated
that it was necessary to rezone the property in order to gain enough units
to make the construction and improvements of Holly Court feasible.
Mayor Stock was in the audience and discussed the zoning history of Holly
Court and Lakeside Estates.
Mr. Birdsong also made comments in regard to his property which is adjacent
to Mr. Schweich's and the fact that his application for a similar use was
denied. He stated that it would only be fair that his application be given
the same consideration as the one submitted by Mr. Schweich.
Motion was made by Fitzgerald to deny the request based on the fact that the
parcel north of Cates Street namely Lot 1, Block 1, Holly Court should be
incorporated in the rezoning request since the density transfer would result
in an uneven distribution of density area wide, seconded by Arnold. Upon
a vote taken the motion was duly passed. Motion was made by Arnold to close
the Cy Schweich Rezoning Public Hearing, seconded by Fitzgerald. Motion carried.
Item III, the Conditional Use request by Cy Schweich was postponed until such
a time the zoning issue is resolved.
Vice Chairman Roseth called for a five minute recess.
The Planning Commission meeting was reconvened at 9:35 P.M.
Item IV, discussion for John Bradly. Mr. Bradly presented a concept plan
to resubdivide approximately 10 Lots in Northwood Addition. The .petition
was presented to the Commission with six signatures all in agreement with
the redivision. After discussing the facts in this case, it was decided
by the Planning Commission that too many variances and deviations of the
City Code would be necessary in order to implement this project. The
Commission told Mr. Bradly that if he were to pursue this project they would
make a negative recommendation to the City Council.
Motion was made by Commissioner Arnold to adjourn the Planning Commission
meeting, seconded by Fitzgerald. Motion carried. Meeting was adjourned
at 10:06 P.M.
