PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - Minutes- February 19, 1981 The February 19, 1981 meeting of the Prior Lake Planning Commission was called to order by Chairman Fitzgerald. Present at the meeting were Commissioners Fitzgerald, Foster, Arnold, Roseth, Wilker, City Planner Graser and Councilman Bissonett. The minutes of the January 15, 1981 Prior Lake Planning Commission meeting were re- viewed. Motion was made by Commissioner Roseth to approve the minutes as written, seconded by Commissioner Wilker. Upon a vote taken, the motion was duly passed. Item I, a variance request by Skip Reebie was called to order by Chairman Fitzgerald. Mr. Reebie was present at the meeting to answer questions. City Planner Graser made his presentation to the Planning Commission. He noted that ( -" , ,Mr. Reebie is requesting a 4' front yard variance and a 5' side yard variance.for 'Lot 20, Sunfish Bay. The subject parcel is a 50' x 161..5' lot zoned R -1. Mr. Graser stated that it was the developers intent to construct a 24' wide home with an attached double garage facing Sunfish Trail. Staff's recommendation was to approve the variance request since it would not be detrimental to the neighborhood. The Planning Commissioners discussed this request. Chairman Fitzgerald asked that the drawings that were submitted be marked as an exhibit. City Planner Graser marked these Exhibit " A " . Motion was made by Commissioner Roseth to approve the 4' front yard variance and a 5' side yard variance, subject to the building being in concert with the drawing submitted marked Exhibit "A" and the garage being set back 20' from Sunset Trail, as this would be in harmony with the existing neighborhood, seconded by Commissioner Foster. Upon a vote taken, the motion was duly passed. Item II, a variance request by Lawrence Schweich was called to order by Chairman Fitzgerald. Sandy Johnson, secretary to Mr. Schweich was present at the meeting to answer questions. Mr. Graser made his presentation to the Planning Commission noting that the variance re- quest is to consider a 35' lakeshore variance for 15086 Fish Point Road. The subject parcel is an extremely low lot about 16,800 square feet in size with only 5,600 square feet being above the 904 elevation. Mr. Craser noted that the applicant is proposing ;to fill the lot which would bring the total square footage above the 904 elevation to 10,200 square feet. Permits would be - required from the DNR and the Watershed District to add this fill. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Page two, minutes continued Staff's recommendation was to approve the request subject to the following: 1. Required permits from the DNR 2. Required permits from local Watershed District 3. Submit detailed plans for arranging drainage between the proposed house and house to the south 4. Encourage the developer to postpone construction until building elevation has been amended. Chairman Fitzgerald called for input from the audience. Mr. John Roberts of 15096 Fish Point Road came to the podium. He stated that he was opposed to building on this lot.because of drainage problems and the negative aesthetic effect that filling would cause. Mr. John Titus of 5463 150th Street commented on this request. Mr. Titus stated that he,,..,: was representing five property owners that were granted a 100' easement by the original owners across the property for access to the lake for use of the lake. He questioned the legal aspects of allowing a building to be put on this property. Mr. Donald Lamm , an attorney from Minneapolis who was representing the property owners made comments regarding this matter. He also read a copy of the deed regarding the access rights for this property. Mrs. Marlis Bluedorn of 15290 Fish Point Road, commented on this request. The Planning Commissioners discussed this request. There were questions about the permits that are required by the DNR and the Watershed District. The Commissioner's were also concerned about the lake access easement that was discussed. They questioned' the drainage from the lot and whether it would affect the property to the south. Chair man Fitzgerald called for a poll of the commission members regarding their feelings of tabling or denying the request. Motion was made by Commissioner Arnold to table the request until further informat is received with regards to the DNR permits, the Watershed permits and information City Attorney, Mark Sullivan regarding the easement for lake access, seconded by C sioner Wilkey. Planner Graser noted that a specific date should be set for the continuation of this variance request. This was tabled until April 2, 1981. The motion was amended to table this matter until April 2nd, 1981. Upon a vote taken the motion was duly passed. Motion was made to adjourn the Prior Lake Planning Commission meeting by Commissioner Wilkey, seconded by Commissioner Roseth.
