March 19, 1981
The March 19, 1981 meeting of the Prior Lake Planning Commission was called to order
by Chairman Fitzgerald. Present at the meeting were Commissioner's Fitzgerald, Foster,
Wilker, Arnold, Rosetn, City Planner Graser and Councilman Bissonett.
The Minutes of the March S, 1981 Prior Lake Planning Commission meeting were reviewed.
Motion was made by Commissioner Foster to approve the minutes as written, seconded by
Commissioner Arnold. Upon a vote taken, the motion was duly passed.
Item I, a variance request by Gary Pitschka was called to order. Mr. Pitschka was
present at the meeting to answer questions.
City Planner Graser commented on this request. He noted that Mr. Pitschka is requesting
- -a 20' front yard variance for Lot S and the Westerly 10' of Lot 6, Spring Brook Park
_.co add an 8: x 24' section to the existing garage.
Staff recommended approval of the request since the improvement is consistant with the
area. The improvement would upgrade the existing garage.
The ning Commission discussed this request and asked questions of Mr. Pitschka.
Moti,,t was made by Commissioner Foster to approve the 20' front yard variance for Lot S,
Spring Brook Park as requested for an 8' x 24' addition to the existing garage contin-
gent upon the garage being brought up to standards to commence with the neighborhood so
that no deterioration or rehabilitation that has been accomplished be visible, sec-
onded by Commissioner Arnold. Upon a vote taken the motion was dul, passed.
Item II, a rezoning request by Russell Tjernlund was called to order. Mr. Bryce Huemoeller,
Attorney for Mr. Tjernlund was present at the meeting.
City Planner Graser gave a brief presentation regarding this request. He noted that this
property is abandoned railroad property and the request is to rezone from C-1, Conservation
to R -1, residential single family. City Planner Graser recommended that a Public Hearing
on this request be scheduled for April 16, 1981 at 7:30 P.M.
Attorney Huemoeller commented on this request.
Motion was made by Commissioner Roseth to schedule a Public Hearing for April 16, 1981
at 7:30 P.M., seconded by Commissioner Foster. Upon a vote taken, the motion was duly

'em III, a Home Ocr::pation Permit request by Bob Beaudette was called to order. Mr.
Beaudette was present at the meeting to answer questions.
City Planner Crascr commented on this request. He noted that Mr. Beaudette is requesting
a permit to conduct sales and servicing of water softners from his home at 16379 Albany
Avenue. He noted that there would be very little if any sales made directly to persons
at his home. Most of the work is done through phone contacts.
Mr. Beaudette answered questions from the Planning Commissioner's. The Planning Commission
questioned whether there would be any outside storage of merchandise. Mr. Beaudette stated
that there would not be any outside storage, his business related items would be kept in his
garage.
Motion was made by Commissioner Roseth to approve the Home Occupation Permit as requested
in view of the facts that there is no objection from the neighbor's and that it is com-
patible with the neighborhood traffic wise, with the stipulation that there be no outside
storage that would detract from the neighborhood and that the house and garage be maintained,
seconded by Commissioner Wilker. Upon a vote taken, the motion was duly passed.
Item IV, a review of the Comprehensive Plan was called to order.
A discussion on the Comprehensive Plan lead by City Planner Graser followed.
Motion was made by Commissioner Foster to adjourn the meeting of the Prior Lake Planning
_Commission, seconded by Commissioner Arnold. Upon a vote taken, the motion was duly passed

The March S, 1981 meeting of the Prior Lake Planning Commission was called to order by
Chairman Fitzgerald. Present at the meeting were Commissioner's Fitzgerald, Foster,
Wilker, Arnold, Roseth and City Planner Graser. Councilman Bissonett was absent.
The minutes of the February 19, 1981 Prior Lake Planning Commission meeting were re-
viewed. Motion was made by Commissioner Arnold to approve the minutes as written,
seconded by Commissioner Foster. Upon a vote taken, the motion was duly passed.
Item I, a Conditional Use application by Barry Miller was called to order by Chairman
Fitzgerald. Mr. Miller and his partner were present at the meeting to answer questions.
City Planner Graser gave a presentation to the Commission members. He stated that Mr.
....Miller is requesting a conditional use permit for recreation equipment, sales, servi.a
nd repair of boats and related items for the parcel located northwest of intersection_
"'Highway 13 and Anna Trail S.E. This parcel is zoned B -2 and consists of approximately
one acre. He noted that the applicant is proposing to add a 40' x 80' x 8' high security
fence adjacent to the building where boats will be displayed and for general storage.
Staff recommended approval of the Conditional Use under the following conditions: 1) The
applicant immediately conform to Prior Lake Sign Ordinance; 2) Maintain the entire grounds
including mowing of grass and controlling weeds; 3) Submit a landscaping plan to staff
to be reviewed by the City's consultant planner and director of parks. The plan must be
implemented no later than July 31, 1981; 4) To encourage the applicant to pave the parking
area and boat storage area.
Mr. Miller commented on this request. He noted that he will be leasing this piece of
property to operate a retail marina which will include displays, servicing and rigging
of boats. He stated that the repair service portion of the business will be contracted
out and possibly done at another location. He also noted that his partner will have a
custom made cabinet shop in this building. This type of business would be a permitted
use under this zoning.
The Planning Commissioner's discussed this item. There was concern about the proposed
fencing and related aesthetics. Commissioner Wilker stated that he would like to see
the fence moved back towards the rear of the building. They were also concerned about
staff's recommendation of paving the parking and the storage area with regard to setting
a time limit as to when this work should be completed.
Motion was made by Commissioner Roseth to approve the Conditional Use Permit, based on the
`en.cing requirement be from the southern part of the overhead door extending northeasterly -

4 .1 rhould be lighted; the sign ordinance be complied with and that the grounds be maintained,
also, that some minimal landscaping be done between the fenced area and the highway and
that the future landscaping plan be submitted to staff for review and implemented prior to
.June 30, 1981, the storage area be blacktopped by .June 30, 1952, seconded by Commissioner
Foster.
Discussion: Chairman Fitzgerald stated that he felt strongly that this use is going in
the wrong place. That it is a misuse and an abuse of the site to put the fence extending
towards the middle of that triangle from the building, for future developing, for visual
impact from the highway, the use of the property, etc., he felt is just in the wrong lo-
cation.
Chairman Fitzgerald called for a vote on this motion. Upon a vate taken, the motion was
duly passed.
At this time Chairman Fitzgerald called for a three minute recess. The meeting was re-
conviened and Item II, a concept approval request by James Hill was called to order. Mr.
Hill was present to answer questions.
City Planner Graser gave his presentation as per his memorandum dated March 5, 1951. Mr.
Craser noted that the developer is proposing to plat Island View 3rd and '4th Addition's.
To install all roads and be provided utility services, the total new lots will equal 86.
The property is zoned R -1. A portion of this area is outside the urban service area.
Planner Graser recommended no expansion of the urban service area and capital plant. He
felt that a connection to County Road 83 at this time is in the best interest of the City.
1Tis should be accomplished by allowing the developer to plat the road and abutting lots
brth of Island View Road to the intersection with the proposed alignment of Northwood
Road. The City should then acquire the sight -of -way sufficient for collector status to
County Road 83.
Mr. Hill commented on this request. He stated that the idea of the sketch plan was to de-
termine future alignments of roads. Almac, Inc., has no intension of platting the entire
area. The property owner to the North, Ditmer,might want saleable lots in return for road
way dedication. Almac, Inc., is primarily interested in serving those lots adjacent to
Island View Road.
The Planning Commissioner's discussed this item. Chairman Fitzgerald questioned development
outside the urban service area, he felt that development should stay within the .urban servic
area. There was also discussion on the alignment of Northwood Road with Island View Road..
The Planning Commissioner's found the sketch plan in general compliance with the Comprehensi
Plan.
Motion to grant approval of the concept review as stated with the expressed provision that
the approval is not to imply that permission is given or committing the City to any proposal
that would expand the urban service or commit to the expansion of the Capital Plant was
made by Commissioner Wilker, seconded by Foster. The motion was amended to read: that the
sketch approval be given if Almac, Inc., reacheF an agreement with staff regarding a resolu-
tion of the corner of Northwood Road and Island View Road as this could be potentially
dangerous. upon a vote taken, the motion was duly passed as 'amended.
Commissioner Wilker made a recommendation that Staff have an evaluation done of the traffic

tem III, a variance rquest by Russell Osness was called to order by Chairman Fitzgerald.
Mr. Osness was present at the meeting to answer questions.
City Planner Graser gave his presentation. He stated that Mr. Osness is requesting a
17' front yard variance to construct an addition to his home on Lots 9 $ 10, Fairview
Beach. The subject parcel is 100' x 150 and the applicant also owns two 50' lots
directly across from his property.
Staff recommended to approve the variance request since it would be compatible with the
existing development pattern in the neighborhood.
Mr. Osness stated that he is proposing to construct a 45' x 30' addition to the front of
his home. The addition will consist of a 22' x 30' garage, a kitchen and a dining and
garden room for solar heat storage.
Motion was made by Arnold to approve the variance as requested for a 17' frcmt yard varianc4
as this would be beneficial to the applicant and compatible with the neighborhood, seconded'
by Commissioner Wilker. Upon a vote taken, the motion was duly passed.
Item IV, a Concept approval for Howard Lake Estates by Jim Filippi was called to order by ,
Chairman Fitzgerald. Mr. Filippi was present at the meeting to answer questions.
Planner Graser gave a presentation to the Commission. Mr. Graser commented on the prior
action taken by the Planning Commission and the City Council regarding this plat. Mr.
Graser noted and outlined parameters the Council gave for future consideration. The
'' arameters include: 1) dry land can only be used to calculate density; 2) lots only with
wilding area accessible by auto may be developed; 3) clustering on the smaller five acre ,
lots would be permissible.
Discussion followed. The Commission did not approve of the land locked building area
Lot 2. The plan did not incorporate clustering in the planning sense.
Chairman Fitzgerald called for a motion on this request. Commissioner Roseth m
