The parcel is referred to as Prior View. Staff's memorandum in reference to this proposal assesses the request. Recommend to schedule a public hearing June 18th, 1981 at 9:30 P.M. 8:45 - JAMES HILL - CONCEPT REVIEW - EASTWOOD The requested action is concept :review. This proposal entails conventional platting in an area where improvements are existing. Attached please find sketch plan of Eastwood. Recommend to schedule a public hearing June 4th 1981 at 7:30 P.M. for preliminary plat approval. 9:00 - JAMES HILL - CONCEPT REVIEW - HARBOR {VEST The requested action is concept review and schedule a public hearing. Attached please find proposal of Harbor West. The plat entails conventional platting into single family lots. Lateral utility extensions are necessary to service the property. The design of the road must incorporate access to the west. Recommend scheduling a public hearing for Harbor West June f4th, 1981 at 8:1S P.M. 9:15 - RON SWANSON - CONCEPT REVIEW The requested action is concept review and schedule a public hearing. CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - MINUTES- MAY 21, 1981 The May 21, 1981 meeting of the Prior Lake Planning Commission was called to order at 7:30 P.M by Chairman Fitzgerald. Present at the meeting were Commissioner's Fitzgerald, Wilker, Arnold Roseth, City Planner Graser and Councilman Bissonett. Commissioner Foster was absent. The minutes of the May 7, 1981 Planning Commission meeting were reviewed. The following corrections are to be made to those minutes: Page 1; Paragraph 7: Change the name Greaser to Graser. Page Two; Paragraph 2; last sentence: Change the "above" to below. Motion was made by Commissioner Arnold to approve the May 7, 1981 minutes as amended, seconded by Commissioner Roseth. Upon a vote taken, the motion was duly passed. Item I, a variance request by Elmer Dellwo was called to order by Chairman Fitzgerald. Mr. C d Mrs. Dellwo were present at the meeting to answer questions. City Planner Graser made a presentation regarding this request. The applicant is requesting .' a variance from the minimum width of an agricultural lot. The minimum width is 500' on a public road, the applicant has 405.5 City Planner Graser stated that this proposal does comply with the intent of the Comprehensive Plan. He also stated that Tracts A 6 B should use a common access to County Road 42. Staff's recommendation was to approve the request since it does meet the spirit and intent of the Comprehensive Plan, contingent upon Tracts A & B using a common access to County Road 42. The Planning Commissioners discussed this item. They were in agreement with staff's recommen dation. Chairman Fitzgerald called for a motion to approve the variance as requested on the application being consistent with the comprehensive plan, subject to Tracts A 8 B having a common access to County Road 42. This was moved by Commissioner Wilker, seconded by Commis. sioner Roseth. Upon a vote taken, the motion was duly passed. Item II, a Rezoning requestby Ed Birdsong was called to order by Chairman Fitzgerald. Mr. Birdsong was not present at the meeting. City Planner Graser stated that Mr. Birdsong is requesting rezoning from R -1 to R -2 for the purpose of constructing townhouses. Recommendation to schedule a Public Hearing for 8:45 PM on June 18th, 1981 was made. W airman Fitzgerald called for a motion to schedule a Public Hearing for 8:45 P.M., on June 18, 1981, this was moved by Commissioner Arnold, seconded by Commissioner Roseth. BOX 359 PRIOR LAKE, MINNESOTA 55372 Prior Lake Planning Commission Minutes Page Two - May 21, 1981 f' Item III, a variance request by Donald Giem was called to order by Chairman Fitzgerald. Mr. and Mrs. Giem were present at the meeting to answer questions. City Planner Graser commented on this request. The application is to consider a 4' side yard variance for the construction of a 12' x 24' addition to the existing garage. The property is located at 4122 Colorado Street S.E. The orientation is to Colorado Street and this should be maintained. Staff's recommendation was to approve the request as it would not be detrimental to the health, safety and welfare of the public. The Planning Commissioners discussed this item. There was question as to who owned the adj property. Mr. Graser stated that th's is a vacant lot owned by the applicant. Chairman Fitzgerald called for a motion to approve the 4' side yard variance to construct a 12' x 24' addition to the existing garage and to maintain the orientation to Colorado Street. Moved by Commissioner Wilker, seconded by Commissioner Arnold. Upon a vote taken, the motion was duly passed. Item IV, a rezoning request by Mike Gair was called to order by Chairman Fitzgerald. Mr. and Mr. Steffan were present at the meeting. They represent Willow Lane Properties, who the applicant. -.City Planner Graser made a presentation to the Planning Commission regarding this requ der his memorandum dated May 21, 1981. He noted that the application is for an amendm the Zoning Ordinance. He noted that the 1980 Comprehensive Plan indicates medium dens `housing over the entire site comprising the Prior View proposal adjoining Five Hawks S noted that the density range of 4 -8 units per acre is possible with maximum or upper 1 of the density range possible only with a P.U.D. He stated that because the Compreheb .Plan is so recent it would be unlikely that an amendment to accommodate the proposal w receive favorable recommendation. Mike Gair made a presentation to the Planning Commission commenting on the concept of proposal. Chairman Fitzgerald called for a motion to schedule a public Hearing for June 18, 1981 at 9:30 P.M. Moved by Commissioner Roseth, seconded by Commissioner Wilker. Upon a v 'taken, the motion was duly passed. The next item, a concept review by Ron Swanson was heard early. Mr, Swanson was prese the meeting to answer questions. City Planner Graser commented on this request. He stated that the application is for division of four lots in Oakridge Court 1st Addition. He stated that a detailed draina and utility plan would have to be submitted. A recommendation was made to schedule a! hearing for July 2, 1981 at 7:30 P.M. Mr. Swanson commented on this request. It was noted that the four lots would be subdiv six smaller lots. - Chairman Fitzgerald called for a motion to schedule a public hearing for July 2, 1981 moved v Commissioner Arnold, seconded by Commissioner Roseth. Upon a vote taken, the was :£;r passed. Punning Commission Minutes Page three - May 21, 1981 ( - ,The Eastwood Concept Review request by James Hill was called to order by Chairman Fitzgerald. Mr. Hill was present at the meeting. Also present was Wes Green. City Planner Graser made a presentation to the Planning Commission. Mr. Graser noted that plans for drainage, grading and utilities would have to be submitted along with the prelim- inary plat.Staff recommended to schedule a public hearing for June 4, 1981 at 7:30 P.M. Mr. Green commented on this request. The Planning Commissioners discussed this item and asked questions of Mr. Green. They ques- tioned lake access and lot square footage. Chairman Fitzgerald called for a motion to schedule a public hearing for June 4th, 1981 at 7:30 P.M. Moved by Commissioner .Arnold, seconded by Commissioner Roseth. Upon a vote taken, the motion was duly passed. Item VI, Concept Review of Harbor West was called to order by Chairman Fitzgerald. Mr. Hill and Mr. Green were present at the meeting to answer questions. City Planner Graser made a presentation to the Planning Commission regarding this request. The plat entails conventional platting of four lots.with access being from County Road 42. At the time the preliminary plat is submitted, drainage and utility plans would also have to be submitted. A cross section for the road feasibility would also have to be submitted. Mr. Graser also noted that Lot 4 will need a variance. -..Mr. Hill commented on this request. He noted that the preliminary plat will show that the 'extension of Conroy Street is feasible with reasonable grades. He also addressed filling of Lot 4 and setbacks on this lot. The Planning Commissioners discussed this item. They questioned access to the plat from County Road 42. They felt that this was the main problem. Chairman Fitzgerald called for a motion to schedule a public hearing for June 4, 1981 at 8:15 P.M. Moved by Commissioner Roseth, seconded by Commissioner Wilker. Upon a vote taken, the motion was duly passed. Item VII, a request for concept review by Brad Rothen..was called to order by Chairman Fitzgex Mr. Brad Rothen Larry Gensmer and Ron Swanson were present at the meeting to answer question City Planner Graser made a presentation as per his memorandum dated May 21, 1981. He i.ndical that the site plan is for 20 unit townhouse development on the north side of Franklin frail. Mr. Graser felt that the plat over emphasizes the automobile, approximately one -third of the site will be paved for driveways and outdoor parking including 34 outdoor spaces in addition to one garage for each unit. Mr. Graser stated that he did not agree with the overt concept of the plan. He felt that the units should be the separation between the open area the traffic. Mr. Swanson commented on this request. He noted that the buildings will be 20' x 24 with two stories and no basements. The total finished square footage would be 960'. Each unit will be sold as individual ownership. The Planning Commissioners discussed this item. They questioned clustering of the units i order to eliminate some of the blacktopping. They suggested having the garages back up to the lot line. Planning Commission Minutes Page four City Planner Craser suggested scheduling a public hearing for July 2nd, 1981 at 8:00 P,M'. This would give the developer time to submit a new plan. Motion was made by Commissioner Arnold to schedule a public hearing for July 2nd, 1981 at 8:00 P.M., seconded by Commissioner Roseth. Upon a vote taken, the motion was duly passed. BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - MINUTES - MAY 7th 1981 The May 7, 1981 meeting of the Prior Lake Planning Commission was called to order by Assistant Chairman Wilker at 7:30 P.M. Present at the meeting were Commissioners Foster, Roseth, Arnold, Wilker, and City Planner Graser. Chairman Fitzgerald and Councilman Bissonett were absent. The minutes of the April 16th, 1981 Prior Lake Planning Commission meeting were reviewed. A Motion was made by Commissioner Roseth to approve the minutes as written, seconded by Commissioner Foster. Upon a vote taken, the motion was duly passed. Item I, a continuation of a variance request by Lawrence Schweich was called to order. Mr. Schweich was present at the meeting to answer questions. City Planner Graser made a presentation to the Planning Commission. A review of the original request and staff's recommendations were given. Mr. Schweich is requesting a 35' lakeshore -1, ariance for 15086 Fish Point Road to construct a single family home. Mr. Graser noted that -ie had received the requested permits from the Department of Natural Resources and the Prior Lake /Spring Lake Watershed Board. The Watershed permit has three conditions attached, those being; 1) That all erosion be controlled during and after the fill and construction operations and that a plan to show the control methods to be used shall be submitted to and approved by the District Engineer before construction; 2) That no work be performed in the drainageway to the lake and that no silt or other foreign matter be allowed to enter the drainageway; 3) That neither the plan or the construction cause any drainage problem to the existing adjacent house or the lot. The permit from the Department of Natural Resources stated that fill over an area 100' at proposed building site lying a maximum of SS' of the northwesterly line of Lot 1, Mave's 1st Lake Addition, all fill shall be above elevation 902.5. Mr. Graser felt the reason for the 902.5 elevation is because this is the proposed and anticipated eleva- tion of the lake. City Planner Graser also commented on a drainage problem of water coming` down Fish Point Road which seems to go across what would be the driveway area of the proposed home. He felt that some type of pipe would have to be put underneath that driveway to dis- pense the water to the drainage ditch.` Mr. Schweich commented on the request. He stated that he would rather have a swale in the driveway than a pipe under the road so that the water would run above the driveway to save it from flushing out in the spring of the year. He also commented on the elevation of the lot, he would like to keep the elevation at 906. Assistant Chairman Wilker called for input from the audience members. Mr. John Roberts, who is an adjacent property owner commented. He questioned whether a decision had been made by the City Attorney regarding the easement for access to the lake through this lot. ji ty Planner Greaser stated that the only reason that the City Attorney rendered an opinion was - toallow six months for the back lot owners to get together and decide on a course of action. The Planning Commissioners discussed this variance request. They questioned the drainage low from the lot with concern for the neighborhing property. There was also concern whether the DNR's recommendation of no fill above the 902.5 elevation could be met; and concern about erosion on the lot. Motion was made by Commissioner Foster to approve a 35' lakeshore variance for 15086 Fish Point Road subject to the following: detailed plans being submitted for arranging the drainage between the proposed house and the house to the south; also subject to the two attached permits, one from the Department of Natural Resources and one from the Watershed District being complied with; also that the existing stream bed or drainage ditch does not be altered to restrict the flow of water; and that corrective construction be done to allow proper drainage of the water as it addresses the front of the property across the driveway area, seconded by Commissioner Roseth. Discussion regarding the drainage of the road followed. Mr. Graser stated that it would' unwise to do anything to the road itself to change the drainage, he felt that it could be easily corrected through a Swale or pipe. i Chairman Wilker called for a vote on the motion. Upon a vote taken, the motion was duly II, a variance request by David Rischmiller was called to order. Mr. 8 Mrs. present at the meeting. City Planner Graser commented on this request. The applicant is requesting a 2' side variance from the south property line for Lot 5, Block 2, Boudins Manor 4th Addition.t 'construct a 8' lean to car port adjacent to the existing garage. Staff recommended de of the request because the proposed use is something not essential to the living envir of the applicants. It would be an accessory use not necessary under the circumstances could result in detrimental affects to the neighborhood. Mr. Rischmiller stated that he would like to use this lean to for storage of a boat. F plans would be to stain and shingle the lean to so that it would match the exterior of existing home. The Planning Commissioners asked whether Mr. Rischmiller had considered building an adc to the existing garage that would be enclosed. There was concern :about storage other 1 the boat, such as; gas cans, motors, anchors, etc.. The Planning Commissioners agreed' they would rather see an addition to the garage than a lean to car -port tr constructs They also asked if Mr. Rischmiller would consider building an addition to Ris garage. stated that he would. A motion was made by Commission Arnold to deny the 2' side yard variance request for Lot 5,': Block 2, Boudin's Manor 4th Addition, as it would have a detrimental affect on the neigbor - i hood, Seconded by Commissioner Roseth. The Motion was amended to recommend that a 2' side y. variance be granted on Lot 5, Block 2, Boudins Manor 4th addition for an addition to the existing garage with the new construction matching the roof line, and the color of the exter or of the home. The Planning Commissioners asked whether it would be better to deny or table this variance: request to allow the applicant time to submit a plan to the Commission as granting a 2' side yard variance may not allow the applicant enough room to build this addition. PAGE THREE - Minutes continued The Motion was amended to table this request to allow the applicant time to submit a plan to the Planning Commission, moved by Commissioner Arnold, seconded as amended by Commissioner �_Roseth. Uoon a vote taken, the motion was duly passed as amended. Item III, a variance request by William Wangerin was called to order. Mr. Wangerin was present at the meeting to answer questions. City Planner Graser gave a presentation regarding this request. The applicant is requesting a 5' side yard variance from the North property line for Lot 15, Fairview Beach. The applicant is proposing to construct a 14' x 16' addition to the existing home which would be between Fairview Road, a private road and the home. Staff's recommendation was to approve the variance' as requested since it would not be detrimental to the health and welfare of the immediate neighborhood and community. Mr. Wangerin stated that the addition would be a three season porch that would constructed to blend in with the exterior of the existing home. He also stated that his neighbors had no objections to the addition. The Planning Commissioners found no problem with the proposed addition.and the variance re- quest. Motion was made by Commissioner Foster to approve the 5' side yard variance from the North property line for Lot 15, Fairview Beach, seconded by Commissioner Roseth. upon a vote taken, f the motion was duly passed. Item IV, a request for rezoning by Fred Schweich was called tc rder City Planner Graser commented that a letter was received from Fred Schweich to consider e mending the Prior Lake City Code. The property is located across from Freddies on the which would be kitty corner this would include about two and one half acres total. The area is currently zoned R -1, Mr. Schweich is requesting R -2, medium density residential. Staff made a recommendation to schedule a public hearing for June 18,'1981 at 7:30 P.M. Motion was made by Commissioner Arnold to schedule a public hearing for the rezoning app] tion by Fred Schweich on June 18, 1981 at 7:30 P.M., seconded by Commissioner Roseth. OF a vote taken, the motion was duly passed. Item V, a variance request by Landice Wilson was called to order. Ms. Wilson was present the meeting to answer questions. City Planner Graser commented on this request. He noted that the applicant is reques' a 4.5' side yard variance from the west property line to construct a deck and a 1.5' yard variance from the west property line to add an addition to the rear of the home; property is located on Lot 23, Lakeside Park Addition, which has a converted year row home. Staff made a recommendation to approve the variance as applied for since it wol be detrimental to the residential environment of the immediate area and it is in the l interest of the neighborhood and would not be detrimental to the overall general heali welfare of the community, The Planning Commissioners asked questions of Ms. Wilson. The questioned what the addition would be used for. She stated that it would be for a kitchen addition. Motion was made by Commissioner Roseth to approve the 4.5' side yard variance for a deck .� y9 1.5' side yard variance for addition of a kitchen as this conforms with the neighborhood t,�nd it would not be detrimental to the general health and welfare of the community. Page Four, 1 1irutes continued ,tem VI, a variance request by James Keenan was called to order. Mr. & Mrs. Keenan were I s present at the meeting to answer questions. City Planner Graser commented on this request. Mr. $ Mrs. Keenan are requesting a variance from the zoning code to construct five parking spaces in front of an existing structure on Walker Avenue. The existing structure is a single family home located in the commercial district which is to be converted to commercial proposes. Walker Avenue will be reconstructed in 1982 and will allow parking on one side. Staff felt that at this time the applicant should seek to lease parking in the immediate area. Staff made a recommendation to deny the request since the proposed use would be detrimental to future road construction and the safety of pedestrians utilizing the sidewalk. Mr. Keenan commented on this request. He stated that he was in the process of purchasing this property to turn it into a travel agency. The plans are to renovate the existing building but before the purchase is made they would like to be sure that parking can be made available. They are currently utilizing the parking lot of Dr. Lukk!.s building. The Planning Commissioners discussed this item. They questioned alternative parking in area and the possibility of parking on the property. Mr. At Borchardt, who is the current power of Attorney over the home commented. City Planner Graser stated that at this time it would not be wise to allow construction of give parking spots in front of the property, however, the design of Walker Street could in. orporate some type of design that would allow parallel parking in front of the house. If the sidewalk would be moved three feet to the east, the area there could be utilized as offrr street parking. He suggested the following: .approve the request stipulating that one park! spot will be created on either side of the existing home, that the porch be removed, the building be upgraded architectural to be aesthetically pleasing, and that when Walker Street is redesigned and reconstructed, those five parking spots could be installed and the Keenan' would have to to install them and blacktop them. The Planning Commissioners were all in agreement with this proposal by Mr. Graser. The a question as to how many parking spaces would be created at this time. City Planner' stated that there would be two possibly three, with the two spots available now on `eat of the structure. Commissioner Arnold made a motion to deny the variance as requested, but to grant a variani for off street parking for two spaces, one on each side of the building, that the porch be removed and the structure be up- graded to look aesthetically pleasing, and when Walker Strei is redesigned and reconstructed the five parking spaces should be moved to the front and be blacktopped by the owner at that time and that as many trees as possible be saved, secon by Foster. Upon a vote taken, the motion was duty passed. Motion was made by Commissioner Arnold to adjourn the Prior Lake Planning Commission meetinj seconded by Commissioner Foster.
