'Che June 19, 1980 meetin g of the Prior Lake Planning Commission was called to order
by Chairman Fitzgerald. Present at the meeting were Commissioners Warmka, Milker,
Fitzgerald, City Planner Graser and Councilman Bissonett. Commissioners Johnson and
Arnold were absent.
The minutes of the June S, 1980 meeting were reviewed. Motion was made by Warmka to
approve the minutes as published, seconded by Wilker. Upon a vote taken the motion
was duly passed.
Item I, a Home Occupation Permit request by Mr. Paul Viereck. Mr. Viereck was
present at the meeting to answer questions.
At this time Mr. Graser gave his presentation noting that Mr. Viereck is requesting
a home occupation permit for RR1, Box 306, Shakopee to sell and display fireplaces,
wood stoves and related glass items to the general puhlic. He also noted that with
this permit the appl�.cant wishes to display a 4'x8' sign which will be fastened to
a rough cedar outhou4se. This would be adjacent to County Road 42. Staff recommen-
dation was to approve the request to sell wood stoves, fireplaces and related glass
items, but only to approve a 3 sign. He also recommended that this permit be
approved for a five year period and at that time it would expire and the applicant
would have to come before the Planning Commission to renew this permit.
At this time Mr. Viereck stated that he is also in the wholesale aspect of the busi-
ness, and at times contractors would be coming in to look at these items. He stated
that most of the sales would be done from his warehouse as spec items.
Commission members commented on this request. There was concern as to how many cus-
tomers Mr. Viereck would have per day. Mr. Fitzgerald also questioned the size of
the sign as recommended by staff.
It was noted that the proposed sign ordinance would allow a 4' x 3' sign in an
agricultural area.
Staff also suggested that the products sold on the premises be noted in the permit
and if there would be an expansion of this it would have to come before the Planning
Commission for approval.
Motion wrs made by Warmka to approve the request for a Home Occupation Permit on the
grounds .hat Mr. Viereck is living in the home and that he would have only one addi-
tional employee to sell wood stoves, fireplaces and related glass items. Any intended
expansion of products should come before the Commission, this motion also includes
the approval of a 4' x 3' sign. The Home Occupation Permit will expire at the end

'tuff's presentation noted that 'Ir. 8 `lrs. Kruse are requesting a 3' front yard
variance and a 5' side yard variance to construct a 22' x 2 °' detached garage for
Lot 26 and 112 of 27, Red Oaks. This is a vacant 92' x 164' lake,hore parcel and
zoned R -1. The lot ad iacent to the north is developed with a detached garage set
back 13' and 3' from rear and front corner respectively. The garage is set back
19' from the blacktop roadway, the iot lines are not at right angles with the
road and therefore causing a difference in set backs. The proposed garage is
facing the same set of circumstances, it would be approximately 18' from the
other garage. Staff noted that the reason for the 3' variance rather than the
6' variance is that the zoning code calls for that, if there are two adjacent
structures having different set backs from the front property line you may take
the average of those two structures. In this case the distance between the pro-
posed garage and existing garage would be 18' which is only 2' short of code re-
quirement. The subject garage will be a side loading garage, or parallel to the
road.
Staff made a recommendation to approve the variance on the condition that it is con-
structed as a side loading garage and it be moved back one foot. A 20' front yard
setback is a precedence this Commission has recommended in the past. Also, the
variance would not be detrimental to established construction character of the
neighborhood.
The Commission members commented on this. Commissioner Fitzgerald questioned why
a variance request was being considered for a lot that has not been developed.
It was noted that there would be a home constructed on this lot in the future.
Commissioner Warmka questioned whether the proposed building could be moved back an
additional foot from the roadway making it 20 Mr. Kruse had no objections
to this request.
Motion was made by Wilker to approve the request for a variance to construct a
22' x 22' detached garage giving tie applicant a 5' side yard variance and a 2'
front yard variance -:ith the restriction being that the garage be a side loading
garage, as it would not be detrimental to the neighborhood, seconded by Warmka.
Upon a vote taken, the motion was duly passed.
Item III, a variance request by Gary Revak. Mr. Revak was present at the meeting
to answer questions.
Mr. Graser noted that this variance request was tabled two weeks prior so that Mr.
Revak could obtain more detailed information regarding elevations, construction
materials and a more detailed lot plan. Also he was to obtain a detailed parking
scheme and overall traffic flow plan. Staff noted that he Lad received these doc-

uments. Staff gave the following, recommendations: The addition to the south be eliminated.
The driveways should not lie less than 24' from the street. The roof line should project
.with the existing buildings. At this time Chairman Pit_gerald questioned whether there
would be a turning radius by eliminating spaces 5, 6 F. 7. Staff felt that the northern
stall would be converted to warehouse space and would not reouire an exit. Staff also
stated that because the additional space is uncommitted a certain amount of parking
spaces would be required if this space is to be used for retail. Ile felt that four
spaces would be sufficient at this time. Staff also recommended that all driving
surfaces be blacktopped and that the remaining portions be seeded or sodded. Staff
recommended that the 20' x 4s' nroposed addition to the east be eliminated as it would
not meet zoning code requirements for set backs, and could cause future problems. Staff
also felt that the applicant should provide some type of screening from the residential
area directly to the east. He noted that this car wash unit would carry high connection
fees for city sewer and water. The unit would carry nine Metropolitan Sewer Availability
Charges.
At this time Mr. Revak came to the podium to make additional comments on his variance
request. Ile noted that the front of the b- ii.ding would be made to look even all the
way across. He was not sure if it would be feasible to have a continuing roof line
due to the drop of four feet in the buildings. He also was concerned with the recom-
mendation by staff to eliminate the 20' x 45' addition.
The Planning Commission members commented on this request. Commissioner Plarmka asked
how Mr. Revak felt about staff's recommendtion to eliminate the proposed addition over
the existing slab. Mr. Revak stated that if he could enclose this outside bay it would
be a way of upgrading the building and area. He also noted that the water and meter
are already there.
Commissioner Wilkey questioned what Mr. Revak's plans were for future use of the
downstairs area. His concern was traffic and parking congestion in the future should
there be a retail business at this location.
Additional comments were made on this variance request by the Commission members and
staff.
Motion was made by 1Varmka to grant a 40' front yard and a 40' side yard variance as re-
quested, also to permit the southern enclosure over the open bay as proposed.

2. To require the extension of the roof over the car wash bay to tie -in with the pro-
posed north addition for uniform appearance not necessarily the same height as
the addition and the truck bay but a continued roof line.
3. Landscaping between driveway and on the back line, landscaping and /or a fence line
at the back lot line to the east Property line to divide the area from the R -3. The
Planning Commission would suggest a wood fence or plantings be used to divide the
car wash and the adjacent quad homes area. All approaches, driveways and parking
spaces be blacktopped. The entire exterior of the building should be uniform.
The motion was seconded by Wilkey.
Discussion:
Staff suggested that the Portion of the motion regarding the exterior of the building
might read as follows: The fascia of the entire building should be of a central theme.
Staff also nroposed that the sign should not be on the roof, it can be anywhere on the
Property and the size will be governed by the sign ordinance'.
Commissioner Wilkey felt that the landscaping part of the motion should be changed to;

is no curb cut for these.
Warmka amended the motion to read es follows:
The exterior of the building lie of a central theme.
The sign or any signs would have to conform with the new sign ordinance regulating
signs.
The fence as suggested would have to serve as a visual screen, if it is not a wood
fence, the plantings would have to serve as a visual screen.
Parkings spots 5, 6 $7 be eliminated and that area should be landscaped or seeded.
Wilker seconded the amendment. Upon a vote taken, the motion was duly passed as amended.
An additional amendment to the motion would include a 30' front yard variance on Jordan
Avenue, seconded by ?Milker. Upon a vote taken, the motion as amended was duly passed.
At thi> time, Chairman Fitzgerald excused himself from the Planning Commission as he is
directly involved with the next scheduled Item on the agenda. Chairman Warmka, assistant
Chairwoman took his place.
Councilman Bissonett will participate as a voting member of the Prior Lake Planning
Commission, in order to have a quorum.
AEM IV - Concept review of John Trulson Subdivision was called to order. Mr. Trulson
was present at the meeting to answer questions.
Staff noted that Mr. Trulson is proposing to subdivide a piece of property adjacent to
Highway 13 and Boudin Street with two existing structures. The proposal is to divide
the properties and form independent lots. The easement to the west would provide access.
to Tract D, which approximately 1 - acres with a low elevation, fronting on Highway 13.
Outlot B came into being from a previous subdivision. Presently the property is zoned
C -1, Conservation, however, our Comprehensive Plan has recommended change to B -1 for
Tract A, Tract B will be zoned R -2, with the remainingarea being zoned B -1.
Warmka questioned why there would probably be no building permits issued for Tract D
as mentioned by staff. Staff stated that the property would have to be greatly improved
before any building permits could be issued.
At this time Mr. Trulson commented on this matter. (Mr. Trulson's comments were inaudible
on the tape}
Commission Members commented on this request.
Motion was made by Wilker to approve the concept of - ombining Dutlot B and Tract A into
one seconded by Bissonett. Upon a vote taken, the motion was passed with Councilman
Bissonett abstaining.
At this time Mr. Fitzgerald resumed the position as Chairman.

`-'item V - A variance request by Kathleen Speilman was called to order. Ms. Speilman was
present at the meeting to answer questions.
Staff noted that the variance request is for Lot 16, Breezy Point. The applicant is

propos_ng to add 1 16' x 20' deck to an existing 1' clock. The variance required would
be 66` from the 9'14 elevation. Lot 1G, l;rcezy Point: is the end lot on the road is
oordered by Prior Lake on three. sides. Staff noted that most of the homes in this par-
ticular area are extremely close to the lake. The proposed deck and the existing home
have compatible set backs with other homes in the neighborhood.
Staff recommendation was to approve the request since it would not he detrimental to
the general health, safety and general welfare of the community.
Commission members made additional comments on this variance request. They all felt
that this was a reasonable request. Chairmen Fitzgerald suggested that this be worded
as a variance for an addition rather than from the lakeshore. Staff found no problem
with this.
Motion was made by Wilker to approve the variance for a 12' x 20' deck onto the existing'..,::
house for a total deck size of 16' x 20 as it would not be detrimental to the _
general health, safety and welfare of the surrounding community, seconded by Warmka,
Upon a vote taken, the motion was duly passed.
Motion was made to adjourn the meeting at 9:33 by Warmka, seconded by Wilker. Upon
a vote taken, the motion was duly passed and the meeting was adjourned.

The June 5, 1980 meeting of the Prior Lake Planning Commission was called to order by
Chairman Fitzgerald. Present at the meeting were Commissioners Fitzgerald, Johnson.
Warmka, Arnold, Wilker, and City Planner Graser. Councilman Bissonett was absent.
The minutes of the May 1, 1980 meeting were reviewed. Motion was made by Warmka to
approve the minutes as published, seconded by Arnold. Upon a vote taken, the motion
was duly passed.
Item I, a rezoning request by James Dunn was called to order. 5fr. Dunn was present at
the meeting and made a brief presentation to the commission members. Mr. Dunn is re-
questing to rezone all or part of five platted lots involving three seperate parcels on
Grainwood Peninsula from R -1 to R -2.
Staff made a presentation at this time as per his memorandum Baled June 5, 1980. He
noted that the acreage involved in the request consists of about 1.6 acres. Mr. Graser
felt from a planning standpoint the request to rezone from R -1 to R -2 is a basic step
in the ultimate achievement of the Comprehensive Plan objectives. The adjoining site
is already being utilized in conformance with the plan. Staff recommendation was to
approve the request for rezoning.
At this time Chairman Fitzgerald called for input from the audience. Comments were made
by Mr. Reimer, Mr. Wayne Miller, Mr. Ed Martini F, Mr. Rollie Theiling, all in reference
to future use of the land.
Commission members commented on this matter of Rezoning this parcel from R -1 to R -2.
There were no negative feelings from the commission members.
Motion was made by 14armka to grant the request to rezone from R -1 to R -2 on the basis that
it is a step in the ultimate achievement of the comprehensive plan objectives and the ad-
joining site is already being utilized in conformance with the plan and this request will
further the implementation of both comprehensive plans, seconded by Arnold. Upon a vote
taken, the motion was duly passed.
At this time Chairman Fitzgerald called for a 45 minutes recess.
The meeting was reconvened at 8:45 P.M. and the Home Occupation Permit request by Janet
Thompson was called to order. hIs. Thompson was present at the meeting to answer questions.
Staff gave a presentation to the commission stating that Ms. Thompson is requesting this
permit to open a dog grooming shop in the basement of her home. Her home is located at �....
16066 Cambridge Circle South East. Staff recommendation was to grant the permit for one
year and that this permit be reviewed at that time with regards to renewal of the permit.

Commissioner bilker questioned whether this permit could be revoked if there were objections
from the neighborhood. ^1r. Craser felt that if there w-is just cause and violation of the
home occupation permit as per the ordinance the commission could revoke the permit.
Commissoner ,Arnold questioned whether there would be a limit as to how many permits could
he issued in one neighborhood. Mr. Craser stated that there might be a problem with three
or more home occupation permits in the same neighborhood where clients would leave there
cars parked there.
Motion was made by .Johnson to approve the rcluest as there is a home occupation permit in
existance in the immediate neighborhood and this permit would not create alot of problems
as far as traffic, this permit would he granted for one year and subject to reviewal at
t�at time by staff, seconded by Warmka. Upon a vote taken, the motion was duly passed.
At his time Chairman Fitzgerald called a six minutes recess.
The meeting was reconvened at 9:00 P.M. and the variance request by Robert and Jane
Engel was called to order. ^'rs. Engle was present at the meeting to answer questions.
Staff gave a presentation to the commission noting that the Engel's are reauesting
a 3 foot side yard variance from the east property line for Lot 6 and the East 1/2 of
Lot 7, Block 3, Lakeside Gardens. The applicant is proposinp to build a 24' x 34'
attached garage to the east side of their home. Mr. Graser noted that after a site
inspection of the developme in the immediate area most of the properties have re-
,..,,spected the 10' side yard setback. Mr. Graser did state that some of the homes that
,., nave been developed on 50' lots have violated the setback requirements.
Staff recommendation was to deny the request sincethere exists little justification for
approv'.ng the request. There is no supportive evidence in the immediate neighborhood
for presidence supporting the 3' side yard variance. He felt that there was nothing
unique or unusual about the property and it could easily be developed in compliance
with the Prior Lake Zoning Code.
At this time Mrs. Engel took the podium and gave their reason for requesting this
3' side yard variance, she stated that they have a four foot wide step that would
protrude into the middle of the garage and this would only leave them 20' to park
their cars.
Commission members questioned whether the garage could be moved in front of the steps,
but staff felt that this would look out of proportion and to move it back, they would
loose a good portic:n of their yard. the commission members suggested building a 22'
garage instead of a 24' garage. This would only require a one foot variance. Mrs.
Engel felt that this was fine.
Motion was made by Wilker to grant a 1' side ,yard variance because of construction
methods and steps protruding into the garage, seconded by !?armka. Upon a vote taken,
the motion was duly passed.
The variance request by Gary Revak was called to order at 9:15 P.M. Mr. Revak was present
at the meeting to answer questions.
�—Ataffs presentation noted that Mr. Revak is requesting to add and convert portions of the
car wash located at the intersection of 160th Street and Jordan Avenue. The applicant
proposes a 24'x60' addition to the northern side of the existing building which would
require a 30' front yard variance and a 40' variance from the East property line. This

8-S. Staff noted that the :,pnliconts intentions for the north addition is storage for
his husincss. 5hc northerly 'n' of the existing structure are to he converted to a shop.
']he southern addition would provide the third =,all to wash cars. Staff also felt that
it was the applicants intention to move another husiness onto the site which could cause
problems in the future with regards to pr.rking, traffic and the general incompatibility
that a car wash carries. .Staff recommendation was to tab!, this matter for a period of
two weeks until the applicant can submit a lgndscapping plan. Staff also felt that the
commission should make definite recommendations with regard to the requested variances.
Staff felt that the southern extension of the building is totally inconsistant with
general development of the area, and the northern addition is too large for the lot and
should be reduced to a 24' x 40' addition. Staff also recommended that a traffic plan
for proper ingress and egress be submitted.
Mr. Revak made a few comments at this time.
The Commission members made comments regarding the traffic flow and set backs. It was
the general feeling of the commission members to adhere to staff's recommendation to
table this matter..
Motion was made by Arnold to table this variance request for a two week period until
a more comprehensive plan is received with detailed traffic patterns, landscaping
and actual usage of the proposed additions and construction materials to be used,
seconded by Johnson. Upon a vote taken, the motion was duly passed.
At this time Commissioner Wilker excused himself from the Planning Commission as he
is directly involved in next agenda item.
At 9:30 P.M. a variance request by Al Wilker was called to order.
Staff gave a presentation regarding this request. Mr. Wilker is proposing to construct
a free standing Radio -TV tower on his property at 16001 Northwood Road N.W. This tower
would be 55' high and would require a 20' height variance. The subject lot is a large
lakeshore lot with over story consisting of primarily large oak and ash trees in forty
to sixty foot height category.
Staff recommendation was to approve the variance rquest as applied for since it would
not be detrimental to the general health, safety and welfare of the immediate neighborhood
and the trees provide a buffer for the abnormal height. Staff also recommended that pre-
caution be taken at the time of construction.
After some discussion among the commission members, motion was made by Arnold to approve
the variance as requested as it would not be detrimental to the general health and welfare
of the neighborhood, also that the tower he constructed to follow all safety procedures
as not to pose a safety hazard to the owner or the immediate neighborhood, seconded by
Johnson. Upon a vote taken, the motion was duly passed.
Motion was made by Johnson to adjourn the Prior Lake Planning Commission meeting, seconded
by Wilker. Unon a vote taken the motion was duly passed and the meeting was adjourned at
10:00 P.M.
