MINUTES - MARCH 6, 1980
The March 6, 1980, meeting of the Prior Lake Planning Commission was called to order by
Chairman Fitzgerald. Present at the meeting were Commissioners Warmka, Fitzgerald, Arnold,
Johnson, Wilker, Councilman Bissonett and City Planner Graser.
The minutes of the February 21, 1980 Planning Commission meeting were reviewed. Motion
was made by Warmka to approve the minutes of the February 21, 1980, Planning Commission
Meeting, seconded by Wilker. Upon a vote taken, the motion was duly passed.
Item I, Public Hearing for a rezoning request by Dr. Michael Babcock, was called to order.
Mr. Gary Gibbish was present at the meeting to answer questions. The request is to change
the present zoning of B - 3, General Business to B -2, Community Business.
,,,$taff gave a presentation as per his memorandum dated March 6, 1980. Staff recommendation
1s to deny the request since the present zoning of the subject parcel is compatible to
existing zoning patterns of the area. If rezoned the site could be subject to small lot
sizes and vastly different set backs than adjacent uses. Also, the zones should be kept
separate from a public service and utility standpoint. He stated that an alternative to
rezoning is to amend the zoning ordinance and add office and banks to the permitted use
category under the 8 zoning.
The Commission Members discussed this request and the alternative as suggested by Staff.
Motion was made by 'Warmka to deny the request as 3posed and to make a recommendation
to the City Council to amend the zoning ordinance include offices and banks as permitted
uses under B -3 zoning, seconded by Johnson. Upo- vote taken, the motion was duly passed.
At this time staff reviewed the procedure to follow for amending the zoning ordinance.
At this time Chairman Fitzgerald called for a five minute recess.
The meeting was reconveined at 8:15 P.M., and the Variance request by Ted Hukriede was called
to order.
Mr. Hukriede was present at the meeting along with his son, Wes Hukriede.
Staff gave a presentation to the Commission noting that Mr. Hukriede is requesting a 3'
variance from the East property line and a I' Variance from the West property line for
�.he East 40' of Lot 8, Subdivision of Outlot "A ", Grainwood Park. Mr. Hukriede is pro-
� posing to add a 24' x 20' living structure to the rear of the existing 24' x 24' garage.

adjacent property values and the general health and safety of the neighborhood.
Motion was made by Johnson to grant the 3' Variance to the East and a P Variance to the

West of the property as the improvements will enhance the subject property and the neigh-
borhood, this is subject to the siding being uniform throughout the garage and proposed
addition, seconded by Warmka. Upon a vote taken, the motion was duly passed.
Item III, a Conditional Use Permit request by John Packer, Jr. Mr. Packer was present
at the meeting to answer questions.
Staff gave a. presentation to the Commission as per his memorandum dated March 6, 1980.
He noted that Mr. Packer is requesting a Conditional Use Permit for rental of the lower
level of his home located at 15325 Edgewater Circle N.E. He noted that the entire area
is zoned R -1.
Staff recommendation was to table this matter for a period of six weeks to allow time to
develop a set of guidelines for the purpose of granting Conditional Use Permits.
Mr. Packer took the podium and made the following comments. He envisioned in 1975
that a five year supplementary income as being sufficient to augment his own income
to help him overcome the financial burden of new house construction. Mr. Packer
stated that his family might endue financial hardship if the rental unit is lost.
He submitted several signed statements by neighbors not objecting to his rental
unit. The letters were made part of the record. Mr. Packer noted that his renters
have not caused any neighborhood problems because they are scrutinized before allowing
to rent. He also stated that his home is difficult to tell that it is being used as
a duplex.
Planner Graser presented a letter from James Olexa opposing the request. The letter
was made part of the record. Planner Graser also conveyed Fred Grothe's position
which was received by telephone at City Hall. Mr. Grothe stated he was in opposition
to the use.
After discussion among the Commission members it was their feeling that because of
the objection by his immediate neighbors and the R -1 zoning of the area this request;shoul?
be denied. They did feel, however, that the current lease should be honored, this lease`",'
expires the end of June, 1980. ,.;'.
Motion was made by Wilker to deny the Conditional Use Permit request on the grounds

precidence could be set for Conditional Use in R -1 zoning, also because of the objeciions
by neighborhoods, however, that the current lease could be honored until June 1980, Sec
ended by Johnson . Upon a vote taken, the motion was duly passed.
Motion was made by Arnold to adjourn the Prior Lake Planning Commission Meeting, seconded
by Warmka. Upon a vote taken, the motion was duly passed and the meeting was adjourned
at 9:01 P.M.
