PAUL VIERECK - VARIANCE REQUEST
Attached please find a letter requesting a variance from section 6.4
paragraph "A" of the Zoning Code. The subject property is located about one
mile west of County Road 21 and abutts County Road 42. The property is
currently zoned A -1. It appears the applicant is conducting a home occupa-
tion out of his home which requires a permit. Staff recommends the applicant
apply for a home occupation permit and sign variance at the same time.

granted April 17th.

MAY 1st, 1980
The May 1, 1980 meeting of the Prior Lake Planning Commission was called to order by
Chairman Fitzgerald. Present at the meeting were Commissioners Fitzgerald, Warmka,
Arnold, Wilker, Councilman Bissonett, and City Planner Graser. Commissioner Johnson
was absent.
The minutes of the April 17, 1980 meeting were reviewed. Motion was made by Wilkey
to approve the minutes as published, seconded by Warmka. Upon a vote taken, the
motion was duly passed.
Item I, a variance request by Paul Viereck was called to order. Mr. Viereck was not
present at the meeting.
Mr. Graser noted that he had received a letter from Mr. Viereck requesting a variance
for a sign. Mr. Viereck is requesting to put up a 8' x 4' sign along County Road 42,
his property is about one mile west of County Road 21 fronting on County Road 42. He
also stated that he felt Mr. Viereck is conducting a home occupation without a per-
mit to do so.
Chairman Fitzgerald felt that it would be hard to consider a sign larger than the
ordinance calls for without knowing the circumstances surrounding such a request,
especially if there is a home occupation involved regarding traffic, the amount of
retail use conducted, etc. He felt that this could only be done with a home occupation
permit hearing.
There also was question as to whether or not Mr. Viereck had made proper application
and paid the fee for a variance request. Mr. Graser stated that he had not filled out
an application or paid a fee. He felt that the letter was sufficient.
Motion was made by Warmka to deny the variance as requested in site of the fact that it
has not been properly applied for. Application must be made through regular channels
for this variance and for the home occupation permit, seconded by Wilker. Upon a vote
taken the motion was duly passed.
Item II, a discussion by Jerry Jensen of Holiday Station Stores was called to order.
Mr. Jensen's request was that the Planning Commission reconsider their motion made at
the April 17, 1980 Planning Commission meeting requesting that the building be moved
back an additional twenty feet to conform with site lines in the area. Mr. Jensen
noted that the engineer for the Holiday Stores has found alot of problems with mov-
ing the building back due to soil conditions. one of the major concerns was the add-
itional money costs involved.

The majority of the Planning Commissioners felt that adhearing to the original motion
made at the April 17, 1980 meeting would be in the hest interest of the community.
There was much concern with the site line along Highway 13. Commissioner Arnold
felt that the needs of the community should be considered such as, the need for
gasoline as compared to the harmony of the area or the aesthetics.
Motion was made by Wilker to leave the variance stand as previously granted to con-
form with the site lines of the surrounding buildings along Highway 13, seconded by
Warmka. Upon a vote taken, the motion passed. Commissioner Arnold voted Ney.
Item I1I, a variance request by Skip Reehie was called to order. Mr. Reebie was
present at the meeting to answer que=tions.
City Planner Graser noted that Mr. Reebie is requesting variances for two seperate
homes on Lots 6, 7, and 8 of Breezy Point. The three parcels are 50' shallow lots,
with sewer and water available to all three. The request is to construct two
26' x 42' homes with decks on the respective parcels. Parcel two; North 112 of
Lot 7 and Lot 8 woald require a 44' lakeshore variance and an 11' front yard var-
iance, parcel one; Lot 6 and the south 112 of Lot 7 would require a 38' lakeshore
variance. Staff recommendation was to approve the request since the proposal _
is in harmony with existing development in the immediate neighborhood.
The Commission members discussed this variance request.
Motion was made by Warmka to grant a 44' lakeshore variance and an 11' front yard
variance for the North 112 of Lot 7 and Lot 8. and to grant a 38' lakeshore variance
for Lot 6 and the South 112 of Lot 7, as the proposal is in harmony with the existing
development in the immediate neighborhood, seconded by Arnold. Upon a vote taken,
the motion was duly passed.
Motion was made by Arnold to adjourn the Prior Lake Planning Commission meeting,
seconded by Warmka. Upon a vote taken, the motion was duly passed and the meeting
was adjourned at 8:45 P.M.

In regards to our discussion, I would like to display
a 4 x 8 sign along County Road 42 on my property.
The sign will be fastened to a prototype of my
company logo which is a rough cedar outhouse.
The sign will be of wood grain lettering and will read
"Viereck Fireplace Sales and Service ", with products
I distribute.
