NOVEMBER 20, 1980
The November 20, 1980 meeting of the Prior Lake Planning Commission was called to
order at 7:30 P.M., by Chairman Fitzgerald. Present at the meeting were Commission-
ers Fitzgerald, Wilkey, Foster, Roseth, Arnold, City Planner Graser and Councilman
Bissonett.
The Minutes of the October 16, 1980 Planning Commission meeting were reviewed.
Motion was made by Arnold to approve the minutes as published, seconded by Wilkey.
Upon a vote taken, the motion was duly passed.
Chairman Fitzgerald opened the organizational meeting and called for nominations
for a vice - chairperson on the Prior Lake Planning Commission. Commissioner Arnold
nominated Commissioner Wilkey, seconded by Commissioner Foster. Nomination of
Commissioner Arnold was made by Commissioner Wilkey with no second to the nomina-
tion. Upon a vote taken, motion to elect Commissioner Wilker as the Vice- Chair -
person was duly passed.
At 7:45 P.M., the variance request by Frank Miller was called to order by Chairman
Fitzgerald. Mr. Miller was present at the meeting to answer questions.
City Planner Graser gave a presentation noting that Mr. Miller is requesting a
rear yard lakeshore variance for Lot 11, Shady Beach Number Two.to enable him to
construct a 10' x 20 on to the back of his home. Staff made a recommendation
for approval of the variance due to the hardship caused from the shallow lot.
Mr. Miller made no comments regarding this request but stated that he would answer
questions from the Commission members.
The Commission members discussed this variance request and there were no objections.
Motion was made by Commissioner Arnold to grant approval of the variance as requested
as per the diagram submitted and marked Exhibit "A ", seconded by Roseth. Upon a vote
taken, the motion was duly passed.
Item II, a variance request by Skip Reebie was called to order by Chairman Fitzgerald
at 8:00 P.M. Mr. Reebie was present at the meeting to answer questions.
City Planner Graser gave a presentation noting that Mr. Reebie's request was for
a 4' front yard variance on the south property line and a 5' rear yard variance
on the north property line for Lot 6, Maple Park Shore Acres. He noted that this
is a corner lot and would require a 25' set back on both street and a "10 sett
back to the rear property line creating a hardship to the applicant. The proposed
home is 24' x 40' with a 24' x 26' attached garage.

Staff's recommendation was for approval of both the 4' front yard variance and
the s' rear yard va- ance on the condition that the garage entrance be from the
West side on Fairbanks Trail.
Mr. Reebie answered questions from the Planning Commissioners. He stated that there
would be no problem putting the drive on the west side.
The Planning Commissioners discussed this request.
Motion was made by Commissioner Roseth to grant a 4' front yard variance and a S'
rear yard variance with the stipulation that the driveway be off the south end
of the garage and that the cahin now on the lot be removed, seconded by Wilker.
Upon a vote taken, the motion was duly passed.
Commissioner Roseth made a motion to change the motion to read from the west side
of the garage instead of the south side, seconded by Wilker. Upon a vote taken,
the motion was duly passed as amended.
Item III, a variance request by James Prehal was called to order at 8:30 P.M., by
Chairman Fitzgerald. Mr. Prchal was present at the meeting to answer questions.
City Planner Graser gave his presentation noting that Mr. Prchal is requesting
a 6' side yard variance for Lots 3 4 4, Original Townsite of Spring Lake to add
an 18' x 22' addition to his existing attached garage. He noted that the existing
garage is a one and a half car garage. He also noted that the topography of the
lot does not pose any building constraints and that a 12' stall could be added
without a variance. Staff made a recommendation to deny the variance since no hard-
ships exist.
At this time Mr. Prchal stated his reasons for the variance request. He felt that
he needed more room and an 18 foot addition would be sufficient.
Commission members questioned whether Mr. Prchal could put this addition to front
or the back of his home. Mr. Prchal stated that he would rather keep the roof line
straight.
After discussion among the commission members it was the general feeling that there
was no justification for this variance request because of the other alternative avail-
able to Mr. Prchal.
Motion was made by Commissioner Arnold to deny the variance as requested because
there were no actual hardship involved and there are other viable solutions, seconded
by Commissioner Roseth. Upon a vote taken, the motion was duly passed.
Last item on the agenda was a variance request for Cy Schweich. The applicant is
proposing to construct two homes on Lots 46, 45, 44 and the North 1/2 of Lot 43,
"Conroy's Bay" which are divided into Tract A and B. Exhibit "A" was made part of
the record deliniating the variance requests. Staff recommended denial and recom-
mended an alternative building envelop which would demand smaller variances.
The applicant demanded to know, in the name of expidiency why he was not notified
of staff recommendation so he could negotiate a building envelope before the meet-
ing and not the valuable time of the Commissioner's. Mr. Schweich also claimed
hardships because the lots are so small and he had invested much money in lot
plans and architectural fees.

Aster much discussion, motion was made by Commissioner Roseth to allow the homes
as proposed but 10' closer to the front properly line with the submitted plans
being marked as Exhibit "A ", seconed by Foster. Upon a vote taken the motion
was passed. Commissioner Wilker voted ney.
Motion was made by Commissioner Foster to adjourn the Prior Lake Planning Com-
mission meeting, seconded by Arnold. Upon a vote taken, the motion was duly
passed and the meeting was adjourned at 9:45 P.M.
