PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION - MINUTES- October 16, 1980 The October 16, 1980 meeting of the Prior Lake Planning Commission was called to order at 7:30 P.M., by Chairman Fitzgerald. Present at the meeting were Commission- ers Fitzgerald, Wilker, Foster, Roseth, Arnold, City Planner Graser and Councilman Bissonett. The minutes of the September 18, 1980 Planning Commission meeting were reviewed. Motion was made by Roseth to approve the minutes as published, seconded by Wilker. Upon a vote taken, the motion was duly passed. Item I, a Conditional Use Permit request for Doug Carlson was called to order by Chairman Fitzgerald. Mr. Norm Erickson was present at the meeting to answer questions. Staff gave a presentation to the Planning Commission. At this time he noted that ( ) the application is to consider a Conditional Use Permit to construct two twin homes (or duplexs) on Lots 2 and 3, Block 1 Centennial Addition. Staff also noted that this proposed site is presently zoned R -1 and is approximately 1.1 aeres -with each individual lot consisting of about 26,000 square feet. Staff made a recommendation to deny the request since the structure would not fit the homogeneity and established characteristics of the neighborhood. All property owners have been notified within 300 feet of the subject. At this time Norm Erickson came to the podium and made his presentation. He noted that he is one of the developers involved, and Mr. Carlson is the builder. He noted that their plan is to have a zero lot line on this property. Mr. Carlson also added comments to this presentation. Input was taken from the audience at this time. Mr. Jim Simon, who resides on Cen- tennial Avenue stated that he was opposed to this type of housing in this neighbor- hood. Comments were made by Norman Hedges who resides at 5400 Centennial Avenue, it felt that this type of housing would take away from the value of the neighborhood and he was also opposed; comments were also made by Bob Stelter, Jim Jorgenson and Gladys Gruetzmacher who are all from this neighborhood, and who were all opposed to this type of housing. At this time the Commission members asked questions of the developer and the builder. Commissioner Roseth stated that he was uncomfortable with concept. Commissioner Wilker stated that he would like to see this area remain single family or R -1 zoning. BOX 359 PRIOR LAKE, MINNESOTA 55372 Page two, Planning Commission minutes Motion was made by Roseth to deny the Conditional Ilse permit as this type of structure would not fit the homogeneity and established characteristics of the neighborhood, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item II, Public Hearing for Brad Rothen Preliminary Plat was called to order by Chairman Fitzgerald. Mr. Rothen was present at the meeting to answer questions. City Planner Graser gave a presentation as per his memorandum dated, October 16th. He noted that the proposal calls for the redivision of Lot 3, Block 2, Bluff Heights Addition. This property is zoned R -3 high density or 14 units per acre. Mr. Graser also noted that in order to plat three lots and make use of the rear property a public road is necessary with utilities dedicated to the public. Staff recommended preliminary approval. The Planning Commissioners discussed this item. Comments made by all the Commissioners members were all favorable towards this proposed redivision. At this time the developer commented on this request for redivision. Motion was made by Wilkey to grant preliminary approval of this plat with the follow- ing stipulations: 1) that there be a 6" water line and an 8 sewer line; and 2) an additional easement for the utilities, seconded by Commissioner Foster. Upon a vote taken, the motion was duly passed. The Public Hearing was closed at this time. Item III, Zoning Violation by Harry Tupe was called to order by Chairman Fitzgerald. Mr. Tupe was not present at the meeting. Motion was made by Commissioner Arnold to table this matter until the next scheduled Planning Commission meeting as Mr. Tupe was not at the meeting to answer questions, seconded by Commissioner Foster. Upon a vote taken, the motion was passed. There were two negative votes on this matter. Motion was made by Commissioner Arnold to adjourn the meeting, seconded by Commissioner Roseth. Upon a vote taken, the motion was duly passed and the meeting was adjourned at 8:45 P.M. Puff CITY OF PRIOR LAKE MICHAEL A. MCGUIRE, MANAGER Harry Tupe - Zoning Violation Mr. Tupe was issued a Conditional Use Permit in August of 1979. A condition of the permit which has not been complied with is the blacktopping of the adjacent parking lot. Mr. Tupe is in violation of the City Zoning Code unless an extension is recommended by the Commission. Mr. Tupe will be at the meeting.
