McGUIRE, MANAGER PLANNING COMMISSION MINUTES April 19, 1979 The meeting of the April 19, 1979 Prior Lake Planning Commission was called to order by Chairman Speiker at 7:30 P.M. Present were Commissioners Johnson, Cavill, Speiker and Warmka and City Planner Graser. Commissioner Fitzgerald and Councilman Busse were absent. Motion was made by Cavill to approve the April 5, 1979 Planning Commission Minutes as published, seconded by Johnson and upon a vote taken it was duly passed. Chairman Speiker called the Len Grassini Rezoning Public Hearing to order. Mr. Skip Reebie and Mr. Len Grassini were present regarding the request to rezone from R -1 to R -3 10 lots directly northwest of Highway 13 and southwest of County Road 81, along with R -2 zoning for three lots in the same area, the total area being 29.66 acres. The intention is to develop this area with quad homes with individual ownership. Mrs. Marlys Huwe was present stating that she was against rezoning to R -3 or R -2. Mr. Jerry Feldten was present also stating that he was against rezoning to R -3 or R -2. City Planner Graser presented his recommendations as stated in his memorandum dated April 19, 1979 to the Planning Commission Regarding Len Grassini - Rezoning R -1 to R -3. Mr. Jim Weninger expressed a concern of what quad homes will do to the neighborhood and setting a precedent of high density housing along Highway 13. Mr. Don Huwe was concerned about the road, and requested a restriction of accesses to County Road 81 from the development. Ms. Ginger Lally stated that her property is zoned agricultural and she did not want dwellings across the street from her agricultural property, she has animals and has been there for 10 years and the kids from all these apartments would come running over into her pasture and suing her. Mr. Weninger was concerned about traffic. Mr. Ron Swanson explained why the high density is being planned for the area shown. (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 55372 Commissioner Warmka suggested a tree line or break between the homes and Highway 13. Commissioner ,Johnson questioned the 29,040 square foot minimum lot size for quad homes as recommended by the Planning Staff. Commissioner Cavill stated that he sees an overall density that is less than R -1 would allow, it is way below the 3.S units per acre that could be a R -1 density, which is better than if the R -1 units were jammed into the same area. There are some aspects of this plat that could be pleasing to the neighborhood, such as the adjoining park. The quad homes, as he can see the concern of the neighbors, is the thing that they are concerned about. They have been very cautious in proceeding on these units and by allowing what the staff has recommended, where each unit is developed and protected so that the upkeep does not degenerate the neighborhood, each individual _. has to belong to the association, the total unit is responsible for the upkeep of the grounds in the area, he feels that the R -2 with the conditional use and the overall density of the plat produces something possibly better than what could be effective in a high density R -1. Commissioner Speiker stated that he is very sensitive to the testimony from the adjoining property owners and if he could capitalize on the comments ' that he has heard. One is the major concern about density, too many people, and two, apartment dwellings. He is not adverse to apartment dwellers, he thinks they are decent human beings, like we are, but the objection is one he would raise if he were an adjoining property owner himself. The developer` has come forward, and you are going to have to give him a fair shake, with the total number of acres in the development, he could put R -1 in there and put more housing units in than he is proposing. Also, the developer has stated they will be individually owned units. Based on these two concessions by the developer it is difficult for him to consensually disagree with the plat that has been proposed. If in fact the lots are going to be a higher density, it is not nigher density but is just multi -uniti it is an effort to lower per unit cost of the home and not increase the number of homes in the parcel. Based on this he is in full concurrence with what the developer is recommending conditioned upon staff recommendation that there be no rental income, rental properties in this development and that the lot size be increased Mr. Grassini stated that they are not trying to pull a, fast one;, this is a difficult piece of land and they are trying to do their best with it and he does not think that quad homes are going to hurt property values and thinks the lots are adequate in size for quad homes. Motion was made by Cavill to deny the R -3 zoning requested for the 10 lots directly northwest of Highway 13 and southwest of County Road 81 as outlined on the map in red and grant rezoning to R -2 on the three lots requested and lieu of the R -3 zoning requested grant R -2 zoning with a 1 conditional use that townhouses could be built as staff recommends on all lots zoned R -2 and the lot sizes will be as platted on the plat, seconded by. Speiker and upon a vote taken it was duly passed. Chairman Speiker adjourned the Len Grassini Rezoning Public Hearing. -2- Chairman Speiker called the WGOdview First Addition Subdivision Public Hearing to order. Mr. Weninger stated he was still concerned regarding the driveway accesses on County Road 81. Commissioner Warmka asked about the driveways onto County Road 81. City Planner Graser stated that the driveways have been accepted by the County Engineer. Commissioner Warmka stated that she still feels there should be a break made between Highway 13 and the development. City Planner Graser presented his recommendations as stated in his memo- randum dated April 19, 1979 to the Planning Commission Regarding Grassini Subdivision - Woodview First Addition. Mr. Weninger expressed concern regarding drainage and made suggestions regarding Lots 1.6 and 17. Motion was made by Johnson to recommend preliminary approval for Woodview First Addition with the following provisions: Hammerhead driveways on lots fronting County Road 81, also common driveways whenever possible, also a minimum of five parking spots in the adjoining park, and that there be 31 single family lots and 11 R -2 lots, seconded by Cavill and upon a vote taken it was duly passed. Chairman Speiker adjourned the Woodview First Addition Subdivision Public Hearing. Chairman Speiker call the G $ E Industrial Park Public Hearing to order. City Planner Graser presented his recommendations as stated in his memo- randum dated April 17, 1979 to the Planning Commission Regarding G g E Industrial Park. Mr. Jim Elander was present regarding the subdivision and questioned an easement on Lot 6. Mr. Archie Pavek was present regarding storm drainage to the west over his property. Mr. Ron Swanson explained the drainage plan. Motion was made by Cavill to table the G $ E Industrial Park Public Hearing until May 17, 1979 at 8:30 P.M. pending submission to staff of a detailed grading plan and a detailed drainage plan, seconded by Warmka and upon a vote taken it was duly passed. Mr. Bryce Huemoeller presented information regarding the proposed platting by Mr. Don Fellon of Tracts A and B, RLS 111. -3- Motion was made by Johnson to hold a Public Hearing regarding the proposed platting by Don Pellon of "tracts A and B, RLS kl on May 17, 1979 at 7:30 P.M., seconded by Ccvill and upon a vote taken it was duly passed. Motion was made by Cavi11 to adjourn, seconded by Warmka and upon a vote taken this meeting was adjourned at 11:00 P.M. Recommend to hold a public hearing May 3, 1979 at 7:30 PM. Attached please find proposal labeled as 'Bluff Heights Second Addition ". 8:00 PM Bill Smith - Subdivision Discussion This parcel is presently in the subdivision process however Mr. Smith wishes to discontinue this concept and petition the city for a new hearing. The new proposal consists of five quad homes. Staff recommends a public hearing be scheduled May 3rd at 8:00 PM. 8:15 PM Cv Schweich - aue — eloper is petitioning for subdivision into townhouse lots. This parcel has severe drainage and subsoil problems. PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PALNNING COMMISSION MINUTES April S, 1979 The meeting of the April 5, 1979 Prior Lake Planning Commission was called to order by Commissioner Fitzgerald at 7:30 PM. Members present were com- missioners Cavill, Warmka and City Planner Graser (Chairman Speiker arrived 8:30 PM, Councilman Busse and Commissioner Johnson arrived 10:00 PM). The minutes of the March 15, 1979 Prior Lake Planning Commission were motioned for approval by Fitzgerald, seconded by Warmka and upon a vote taken, minutes were approved as published. First item on the agenda was a variance request by Russell Johnson. The sub- ject parcel fronts for 664.80' on County Road 42 and consists of 10.11 acres. The parcel lies adjacent to and directly west of Haas Lace. There are no buildings presently on the parcel but there are two single family homes directly west. The parcel is wooded with much topographical difference. The current Comprehensive Plan shows most of this parcel as industrial land. Both Planning Commission and Council recommend an agricultural zoning for this area. Motion by Cavill to approve variance, the highest and best use for the parcel is res- idential with lot sizes as in A -1 zone, seconded by Warmka and upon a vote taken motion carried. Next item was the Gary Gibbish subdivision discussion. Gibbish, the developer of Lot 3, Block 1, Bluff Heights Addition is proposing to subdivide the entire lot, wh4ch is presently zone R -3 into 40 seperate lots with the intent to develop quad homes on them. The total area is 1.7 acres. Each individual lot meets the square footage set forth by the zoning ordinance. The uses on the map meet the set -back and there is sewer and water available to the property. Fitzgerald asked if a service road of some sort should be considered. Planner Graser said no service road but a street must be constructed. Graser sees no hyndrance of traffic in that area. Cavill commented on this use of presently R -3 zoning as an asset to Prior Lake. Cavill motioned for a public hearing for May 3 at 7:30 PM, seconded by Warmka and upon a vote taken, motion carried. Next item was the subdivision discussion for Bill Smith. Planner Graser re- viewed briefly the proposal of the property. It is a redivision of the lot to allow 5 quad homes. On access to Franklin Trail, the road would be private and under a joint ownership. People buying a townhouse would under Townhouse Law, buy the ground underneath and the outlet, with the remaining space main- tained by the Association. Motion by Cavill to hold public hearing on May 3 at 8:00 PM, seconded by Warmka and upon a vote taken, motion carried. -1- (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE Next item was the subdivision disusssion for Cy Schweich. Fitzgerald questioned the difference of condominiums and townhouses. Schweich explained the difference as in selling condominiums, you sell space. Everyone in the building has equal rights whereas in townhouses you buy the lot you're building and you have common walls. Questions about drainage and subsoil problems on the property were discussed. Cavill motioned to hold a public hearing on May 3 at 8:45 PM, seconded by Fitzgerald and upon a vote taken, motion carried. Next item was a variance request by Arnest Pavek. Staff recommends a 20' set -back instead of the 17' set -back request from Pavek. Pavek will accept the 20' set- back. His use for garage would be for a hobby shop. His main reason was to keep; large shrubs in front yard. Fitzgerald motioned to grant a 5' front yard variance for the construction of the garage for preservation of the natural area, seconded by Cavill and upon a vote taken, motion carried. Planner Graser recommended to schedule a public hearing for subdivision. The time factor is important in this case and start construction of utilities this year. Also high density at Co. I and Hwy 13. Motion to adjourn by Fitzgerald, seconded by Cavill and upon a vote taken, motion carried.
