Staff did not have detailed plans at the time the
agenda was completed. The applicant will have a full
presentation before the Planning Commission. The
conditional use is for only the apartments. However,
conditions within reason may be attached.
Staff recommends strong consideration of the following
items:
1) blacktopping of parking lot
2) continuation of sidewalk
3) landscaping

PRIOR LAKE PLANNING COPMdISSION MINUTES
AUGUST 2, 1979
The meeting of the Prior Lake Planning Commission was called to order. Present
at the meeting were Commissioner's Warmka, Fitzgerald, Johnson, Chairman Speiker,
and City Planner Graser.
Motion to approve the minutes of the July 19, 1979 meeting was made by Johnson,
seconded by Warmka. Upon a vote taken, the minutes were approved as published.
Item I, request by Doug Brinkman for a 6' side yard variance. Mr. Brinkman made
no comments. Mr. Graser stated that this request was for a garage to be constructed
on an existing foundation. The previous garage had been destroyed by a windstrom.
Staff recommendation being to approve the request since the foundation exists, and
this would be in the best interest of the neighborhood and City. Motion to approve
this variance as requested was made by Warmka, because of the existing foundation
and that this would be in the best interest of the neighborhood, seconded by Johnson.
Upon a vote taken, motion was duly passed.
Item II request for a 30' variance from lakeshore setback and a 5.3' front yard
variance for Lot 16 Boudin's Manor Second Addition. The applicant had no comments.
Mr. Graser noted that this is a vacant parcel zoned R -1. The lots in this addition
are all lakeshore lots and are extremely low and narrow. The addition is about
95% developed with all homes being non - conforming in some manner or having a var-
iance. The 30' lakeshore setback request would be equal to those of the immediate
neighborhood. The 5.3' front yard variance is request to construct a three car
garage. Motion to approve this variance as requested was made by Johnson, seconded
by Warmka. Upon a vote taken, motion was duly passed.
Item III, request by Peep Raid for a 2' side yard variance to construct an outside
chimney. The applicant was present and made no comments. Graser gave his presentation
noting that the adjacent lot to the West has similar topography and was recently
developed. This lot also contains a 15' easement for backlot access. The request
would not affect the property value of the adjacent home. Motion was made by Warmka
to approve the variance as requested as it would not be detrimental to the general
health, safety, and welfare of the community, seconded by Johnson. Upon a vote taken,
motion was duly passed.
Item IV request for a Conditional Use Permit by Harry Tupy. Mr. Tupy :stated that he
would be converting "Busse Supermarket" at 4671 Colorado Street SE, into four apart-
ments, office and retail space. Mr. Tupy noted that there would be four one bedroom
apartments at about 450 square feet each. There would also be office and retail space.

of walk ways would be provided for the people. Tupy said that there would be walk ways.

P1r. Graser questioned the landscaping. Tupy stated that he would have the parking
lot hlocktopped and that he would be putting in shr,hbery.
"M ere was concern about the building meeting the state fire code. It was noted that,
this is mandatory at the time of applying for a building permit. There was also
concern about the length of time taken to finish the exterior of the building. Mr.
Tupy stated that the apartments and the exterior of the building should be done in
site of three to four months starting in September of this year. The blacktopping
for the parking area will be done in the spring.
"Ihore was concern about residential housing, or apartment dwellings being provided
in the down town business area. It was the feelings of the commissioner's that
apartments over commercial enterprise is a good idea, and should be encouraged.
k1o: -on was made by Fitzgerald to approve the Conditional Use Permit for the conversion
of 3usse's Supermarket into office, apartments and retail space with the following
contingencies:
1. There be a structural certification and Fire Marshal certification
stating that the property is safe and usable as dwelling units.
2. The plan be substantially completed as presented here on this date
including exterior painting, blacktopping, and landscaping, and
exterior finish work including windows within 1 year's time.
seconded by Johnson. Upon a vote taken, motion was duly passed.
Item V, concept review on proposed plan for a quad home development on Franklin
Trail and County Road 44. Representing K. Bordner Consultants, was Mr. Dumonceaux,
Architect for the firm. Mr. Dumonceaux stated that they are basically trying to
provide in the plan, or be sensitive to the traffic movement through the project,
also they are trying to provide access to the remaining portion of the corner.
The approximate finished size of the units will be about 1500 to 1600 square feet
excluding the garage.
Graser stated that there must be an access onto the public road and this concept
does allow that. Sewer and water are of capacity to the site. He felt that there
would be no problem with traffic circulation for the two access points. He felt
that the concept was good.
Concern of the commissioner's was parking. Graser stated that the zoing ordinance
requires two off street parking spots per unit. He stated that each unit will have
a double car garage and the design provides for enough depth for parking in front of
each garage. Mr. Graser stated that the road will be public. There was also concern
about the size of the driveway on the corner lot, as to whether or not this would be
large enough for two cars to pass through at the same time. It was suggested that this
be made larger.
Motion to approve the concept of the quad homes and drawing marked exhibit "A" was
made by Johnson, seconded by Warmka. Upon a vote taken motion was duly passed.

Johnson, seconded by Fitzgerald. Upon a vote taken the meeting was adjourned at
9:25 P.M..
