PRIOR LAKE PLANNING COMMISSION MINUTES
January 13, 1979
The meeting of the January 18, 1979 Prior Lake Planning Commission
was called to order by Vice Chairman Speiker. Members present were
Commissioners Johnson, Cavill and City Planner Graser.
Motion was made to approve the Prior Lake Planning Commission minutes
of January 4, 1979 by Johnson seconded by Cavill and upon a vote taken
minutes were approved as published.
First item on the agenda was a variance request for Mr. Paul Markstrom.
The request was for a 4' side yard variance and a 3' rear yard variance
for Lot 21, and the west 23' of Lot 22, Butternut Beach. The applicant
is proposing to add a 4 x 10' deck onto the west side of the home leaving
20' between the homes. Motion was made by Cavill to approve the variance
as requested because the lot fits in with the neighborhood and i•, not
detrimental to the health and general welfare of the community seconded
by Johnson and upon a vote taken motion carried.
Next item on the agenda was a discussion on the Harbor PUD. Planner, -
Graser gave a brief description of the work completed since the preliminary
outline approval was given in 1976. Motion was made by Cavill to approve
the preliminary development plan which is in compliance with the outline
development plan, with the conditions that the drainage problem be solved
with staff and an alternate plan be submitted showing guest parking. Mr.
Putnam stated he would take care of the conditions. Motion was seconded
by Johnson and upon a vote taken motion carried. Mr. Graser stated that
the City Engineer will handle the utility and drainage problems.
Motion was made by Cavill to adjourn seconded by Johnson and upon a vote
taken the meeting was closed at 9:10 PM.

January 4, 1979
The meeting of the .January 4, 1979 Prior Lake Planning Commission was
called to order by Vice Chairman Speiker. Members present were
Commissioners Fitzgerald, Johnson, Speiker and City Planner Graser.
The minutes of the December 7, 1978 Planning Commission were motioned
for approval by Commissioner Fitzgerald seconded by Johnson and upon
a vote taken, motion carried.
The public hearing for the Rollie Thieling property on 150th Street and
Estate Avenue was called to order at 7:45 PM. Mr. Graser gave a brief
description of the parcel involved. Staff recommended preliminary
approval be granted. The meeting was then opened to the public. A
gentleman asked what was proposed for the lots. Mr. Graser stated =that
the area is zoned single family and the developer's intent istobuild
single family dwellings. Commissioner Fitzgerald made a motion to
recommend preliminary approval of the subdivision, seconded by Johnson
and upon a vote taken motion carried.
Planner Graser stated that a reorganizational meeting will be held at
the outset of the first meeting in February by which time a new Comm -
missioner will have been appointed by the Council.
Next item on the agenda was a conditional use permit for Mr. Wes
Mr. Hukriede is requesting a conditional use permit for 15191 Gr
Trail to utilize his basement as an apartment. Planner Graser g
brief explanation of the parcel involved. Commissioner Johnson,
if bedroom windows in the lower level were in compliance with 19
building codes. Mr. Hukriede stated that windows are in complia
79 codes. Staff felt that the conditions recommended by staff w
the building code. Commissioner Fitzgerald felt that the propos
needs review and guidelines for future application.

Commissioner Speiker asked if neighboring lots are of equal size. The
neighboring lots are slightly smaller than this one. Motion was made by
Fitzgerald to approve the conditional use with the following stipulations:
1. The owner of the home must be a resident of the home.
2. Construction must be according to fire and building codes.
3. Two off street parking spaces must be provided for the apartment.
4. The permit be reviewed each year.
5. A double car garage be built prior to renting the basement apartment.
6. Conditional use permit would expire upon sale of home.
Motion was seconded by Johnson and upon a vote taken motion carried.
Last item was a discussion for Brooksville Center 2nd Addition. Planner
Graser gave an explanation of the area involved for the people in the audience.
Mr. Graser stated that the applicant must enter into a developers agreement

with the City. Motion was made by Johnson to recommend preliminary
development approval seconded by Fitzgerald and upon a vote taken motion
carried.
Motion by Fitzgerald to adjourn, seconded by Johnson and upon a vote
taken the meeting was adjourned at 8:45 PM.
