PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION MINUTES The meeting of the .June 21, 1979 Prior Lake Planning Commission was called to order by Chairman Speiker at 7:30 P.M.. Present at the meeting were Commissioner's Cavill, Fitzgerald, Johnson, Warmka, Speiker, Councilman Busse, and City Planner Graser. Motion to approve the minutes of the June 7, 1979 Planning Commission meeting as published was made by Johnson, seconded by Warmka. Upon a vote taken, motion was duly passed. Item I - Concept Plan, Steve Friendshuh was called to order. Mr. Friendshuh was present at the meeting and gave his comments on this plan to the commission. Mr. Friendshuh noted that the lot he would like to divide is on Millers Circle. The lot is approximately two acres. Mr. Graser gave his presentation to the commission. He noted that Mr. Friendshuh was asking for concept approval to splitting of lot 3, Millers Addition. Mr. Graser stated that the main reason for this discussion was that Mr Friendshuh upon sub- division would not have the required frontage. Chairman Speiker asked the commission members for their opinions regarding this proposal. Fitzgerald questioned whether the variance aspect should be addressed from the 25' set back to the 80' road frontage. Mr. Graser stated that this was basically the only question, however, he did say that in doing so it would have to be taken into consideration the configuration of the entire property and how it relates to the adjacent property. Fitzgerald stated that he felt he would have to have a compelling force before he could feel that a variance is warranted. Johnson questioned how the stub outs were handled on the other pan handle drives. Mr. Graser stated that allow- ances were made for the other lots because of topography. He also questioned whether the proposed lot could give a driveway easement back to the existing lot or would a variance be needed. Mr. Graser stated that he would have to go through the entire platting process. Commissioner Warmka questioned if only one building permit was issued z would he have a house closer to the other or a house that may infringe on the views of the others. Commissioner Warmka stated that she could find no fault with two buildable lots on a two acre lot. Chairman Speiker showed concern about the number of cul -de -sacs that would have 30 to 40 foot frontage that would be subject to sub- division. Mayor Stock stated his feelings on this subject. He felt that this was a unique lot and that there were not many lots of this size on a cul -de -sac. Motion to reject concept approval was made by Fitzgerald, he felt this is a variance request and a variance would not be warranted. There was no second to the motion, therefore motion failed. Motion to conceptionally approve this was made by Warmka with no stipulations at this time, seconded by Johnson, upon a vote taken, motion was' duly passed. Commissioner Fitzgerald voted against this. 'W -I- (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 55372 Item 1I - Variance for Karl Bohn was called to order. This variance was tabled from the June 7, 1979 Planning Commission meeting. Mr. Bohn was not present at the meeting. Mr. Graser stated that he and City Manager McGuire met with Mr. Bohn's attorney who requested that this variance be withdrawn at this time for another two weeks. Mr. Graser made a recommendation to honor this request at this time and to table this hearing until .July 5, 1979 at 8:45 P.M.. Motion was made by Fitzgerald to table until .July 5, 1979, at 8:45 P.M., seconded by Warmka. Upon a vote taken, motion was duly passed. Commissioner Johnson asked to be excused from the next item on the agenda as he is directly involved. Item III - Concept Plan for Kenson Builders was called to order. Mr. Ken Hoppenrath, owner of Kenson Builders was present at the meeting and gave his presentation to the commission. He stated that he is proposing to develop townhouses. Mr. Graser gave his presentation to the commission stating that the proposal is for 16 units of town - homes. Mr. Graser recommended that the applicant install and consider the develop- ment of guest parking spaces, five or six per unit. Sewer and water is available to capacity but there is question as to whether or not stubs correspond to each building. He noted a walk way to the service road where children living in the units could then walk to Westwood Elementry School. Park land is not shown and will be_cash. Topography is virtually flat. Mr. Graser stated that he could see no major problems with this. Concern about parking was shown by Commissioner Warmka. Fitzgerald stated that he could see no problems with this, he also stated that he felt the waly %r= were a good idea. Cavill stated that he could see no problem with the r also agreed that the walk ways were a good idea. He did feel that r as necessary. Motion was made to conceptionally approve this proposal with the _here will be 25' set backs from the service road, guest parking for fiv ,biles be provided in several areas by Fitzgerald, seconded by Warmka. Upou L ;,en, the motion was duly passed. Item IV - Home Occupation Permit for Don Fahrenkamp was called to order. Mr. Fahrenkamp was present at the meeting. Mr. Graser gave his presentation to the commission with a recommendation to approve the request with the following conditions: Clients park on subject property at all times, the applicant shall be the only employee of the ser- vice, the use shall be reviewed on or about the anniversary of the Planning Commission hearing. Motion to approve the Home Occupation permit with the conditions as stated above was made by Fitzgerald and seconded by Warmka. Upon a vote taken, motion was duly passed. Item V - Variance for Diane Krum was called to order. Mrs-Krum was present at the meeting. Mrs. Krum stated that they were requesting a 5' variance instead of a 4' variance. Mr. Graser gave his presentation to the commission for the variance request for lot 5, Jo -Anna Stepkas Hi -View Addition. Mr. Graser gave his recommendation to deny the request because there is nothing unique nor is there a hardship involved. He felt that the applicant could construct a 20' garage without a variance request as she does have 16 feet remaining to side property line. Commissioner Warmka questioned why the addition would have to be that large. Commission Johnson stated he agreed with staff recommendation. Commissioner Fitzgerald disagreed with staff, he was in favor of granting the variance, he felt that because of the way the house is situated on the lot, this would be the only way that any remodeling could be done. Mayor Stock made note to the fact that due to the way this addition was platted, every- -2- one who has built a garage has had to apply fox a variance, because of the way the homes were positioned on the lots. He stated that because of the original platting of these lots he felt that there is a hardship involved and a unique situation, be- cause of the way the homes are positioned on the lots. Mr. Graser stated that the OA lot lines had all been readjusted in this addition of Stepkas whereas the adjacent property owners could swap property. It was also noted that there was a letter from the adjoining property owner Pressing their approval of this variance request. Due to the unique topography and patting problems of this addition, motion was made to approve the variance request by Fitzgerald, seconded by Johnson. Upon a vote taken, motion was duly passed. Unscheduled on the agenda was a discussion with the Planning Commission by Mayor Stock. It was noted that Commissioner's Warmka, Johnson, and Cavill's terms have expired and he would be talking with them about renewal of these terms. Item VI was called to order. This was a discussion lead by staff on agricultural zoning. Motion was made to adjourn the meeting by Johnson, seconded by Warmka. PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LANCE AGENDA REPORT June 7, 1979 7:30 - Anthony Thelon - Variance Attached please find supporting materials 7:45 - I ke Rygajlo - Zoning Discussion The applicant is proposing to subdivide his corner lot whicb fronts on Green Oaks Trail and Highway 13. The question that arises is whether or not Highway 13 can be used as frontage on a public road (required frontage is 80 However, it can be preconcluded that direct access from Highway 13 is impossible to obtain. Recommend to cancel hearing. 9:00 - Jerry Grendahl - Schedule Public Hearing Please schedule a public hearing July 5th at 8:15 P.M. 9:15 - Karl Bohn - Variance Attached please find supporting materials 9:30 - City of Shakopee - Review Subdivis The City of Shakopee has asked the Prior Lake Planning Commission to review a plat which is adjacent to Prior Lake City limits. It is a plat consisting of 2 acre lots and is adjacent to and east of Titus 1st Addition. The Commission should provide constructive comments only to the City of Shakopee. Of major interest to Prior Lake is the roadway which is shown as connecting to Titus 1st Addition. Plans were not available at the time this agenda went out. (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE MINUTES OF THE PRIOR LAKE PLANNING COMMISSION JUNE 7, 1979 The meeting of the June 7, 1979 Prior Lake Planning Commission was called to order by Commissioner Cavill in the absence of Chairman Speiker, at 8:00 P.M. Present at the meeting were Commissioner Cavill, Commissioner Johnson, Commissioner Warmka, Council- man Busse and City Planner Graser. Chairman Speiker and Commissioner Fitzgerald were not present. Motion to approve the mintues of the May 17, 1979 Planning Commission meeting as pub- lished was made by Commissioner Warmka, seconded by Johnson. Item I -the Anthony Thelen variance request was called to order. Mr. Thelen was pres- ent at the meeting. Mr. Graser gave his presentation to the commission. Mr. Thelen is applying for a 75' lakeshore variance to construct a 26.6' x 44' home with a 24' x 28' attached garage. It was noted by staff that the entire lot is below the 905 eleva- tion and over half of it below 904 elevation. Staff made a recommendation to approve the variance and allow the construction of the home as shown and not to allow any con- struction closer to the lake than the adjacent home. Also a certified lot plan must be submitted of the adjacent parcel to determine house location and set back of the subject parcel when building permit is applied for. Mr. Thelen was called upon to give further comments on this variance request. Mr. Thelen noted that the adjacent lot belonged to him and he planned to build the new home even with the existing home on the adjacent lot. Commissioner Johnson asked if this would be hooked up to city sewer and water. Mr. Graser commented that as per ordinance, he would have to hook up to city sewer and water. He noted that there would be a problem with the flood plain ordinace, which is the 910 elevation, no living area below 910. Mr. Graser noted that he had asked City Attorney to qualify what a living area is; as to what can and cannot be allowed. Motion to approve the 75' variance request but the applicant must submit a certified lot plan showing where the adjacent house and lot are upon applying for a building permit, was made by Johnson, seconded by Warmka. Upon a vote taken the motion was duly passed. Item II -Ike Rygajlo zoning discussion was called to order. Mr. Rygajlo was present at the meeting. City Planner Graser was called upon to give his presentation. Mr. Graser stated that Mr. Rygajlo wished to subdivide lot 12, Green Oaks Addition. It was noted that Mr. Rygajlo has 144' on Green Oaks Trail and 159' on Highway 13. The zoning ordinance for 80' on a public road and 10,000 square feet minimum. Staff's re- quest being whether or not Highway 13 can be used as frontage for a lot, assuming that -I- 0 WIM (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA SS372 no drive =way access can be legally used from Highway 13. !ilso, if this property is to be subdivided, Mr. Craser noted that staff would not allow any kind of drivewa) access directly to Highwav 13, it would have to come off Green Oaks Trail. In asking the commission members present their opinions as to the re- zoning of this property, Commissioner .Johnson asked if one lot could be subdivided, City Planner Graser stated that this could be done with no problem and that it could be subdivided by resolution with no public hearing. Commissioner Johnson also stated that he would like to see access to Green Oaks Trail if approved. Commissioner Warmka stated that it looked good to her, and she could see no problem approving this. Commissioner Cavill stated that the access to the property should be on Green Oaks Trail, he also stated he felt that the size of the lot 19,000 square feet was adequate. Commissioner Cavill stated that at this time there would be a majority opinion of the commission and wondered if a zoning hearing date should be set up. Mr. Graser felt that this should not have to come before the commission again. 'text item of the meeting was unscheduled. Mr. Ron Schmidt of Award Realty addressed the commission as to subdividing a lot on Breezy Point Road. He stated that there was a house on that lot at this time. Mr. Schmidt stated that he was proposing to divide this lot into two lots. He stated that the way this is being divided, the present home would only have 20' on the roadway rather than the required 80', he also stated that this was the driveway and it was the only driveway being used. He stated that the new lot would be facing Breezy Point Road. Mr. Graser noted the zoning ordinance calling for 80' on the public roadway. Commissioner Cavill stated that he felt the zoning ordinance would really have to be stretched to come up with a way to approve this subdivision request with the 20' frontage. Noting that this was just a discussion Commissioner Cavill asked for opinions from the commissioners present. Commissioner Johnson stated that he felt the lot was large enough but he felt that there would be a problem with the drive way. Councilman Busse questioned whether land could be purchased from the owner of the RLS property. Commissioner Cavill stated that with the existing proposal he would have trouble approving the 20' frontage. He felt that possibly this could be divided in a better way. This was also suggested by Councilman Busse. Com- missioner Warmka felt that if it was approved, would that drive possibly be used for access to lot two also. Suggestion was made that different proposals be submitted to staff. Item III - Milo Stephens variance request. Mr. Stephens was present at the meeting. City Planner Graser gave his recommendation to the commission to consider a variance to allow the construction of a single family home in an industrial area. City Planner Graser noted that the land use plan recently adapted by the Planning Commisson and the Council will call for an agricultural zoning. He stated that Mr. Stephens wished to sell the parcel but cannot market it as a buildable residential lot until this is done. Recommendation was made by Mr. Graser to approve the request since the intent of the comprehensive plan would make this a buildable lot within one year. Also this would not be detramental to the general health, welfare, and safety of the community. Motion was made by Warmka to approve the variance as requested, seconded by Johnson. Upon a vote taken the motion was duly passed. Item IV - Scheduling a public hearing for Don Fellon Subdivision. Mr. Graser noted that the preliminary plat was in his office. Motion was made by Warmka to schedule a public hearing for July 5, 1979, at 7:30 P.M., seconded by Johnson. Upon a vote taken, motion was duly passed. Item V - Cy Schweich Subdivision Public Hearing was called to order. Mr. Schweich was not present at the meeting. Mr. Graser noted that preliminary plans were not received by staff. His recommendation was to cancel this public hearing. Motion was made by Johnson to cancel the public hearing, seconded by Warmka. Upon a vote -2- taken, motion was duly passed Item VI - Scheduling of a public hearing for Jerry Grendahl. Mr. Graser noted that all of the material had been received. Motion was made to schedule a public hearing for Jerry Grendahl on July 5, 1979, at 8:15 P.M., by Warmka, seconded by Johnson. Upon a vote taken, motion was duly passed. Item VII - Karl Bohn variance request was called to order. Mr. Bohn was not present at the meeting. Mr. Graser stated that he had received a telephone call from Mr. Bohn after he found out what the recommendation was, saying that he could not make it to the meeting and requested that the variance request be tabled until the next meeting, which is June 21, 1979. Mr. Graser suggested re- scheduling for June 21, 1979 at 7:45 P.M.. Motion was made to table the hearing until June 21, 1979 at 7:45 P.M. by Johnson, seconded by Warmka. Upon a vote taken, motion was duly passed. Item VIII - City of Shakppee - Subdivision Review was called to order. City Planner Graser gave his presentation to the commission regarding this subdivision. Mr. Graser noted that this plat consists of 2?i acre lots and is adjacent to and east of Titus 1st addition. The major concern to Prior Lake would be the roadway which is shown as connecting to Titus 1st addition. Mr. Graser stated that the main issue is whether this roadway should end on a cul -de -sac, to not allow traffic flow. Imput was called for from residents of the Titus 1st addition for discussion of the proposed Sandlewood addition in Shakopee. Those present at the meeting stated their feelings regard- ing this proposed addition. Major concerns were the connecting of the roadway from Shakopee to Prior Lake Titus 1st addition, concern about the flow of traffic and the safety of the children in the area. Also there was concern about the construction traffic along roadway and if damage was done, who would be responsible for the repairs to the roadway. Another concern was drainage. Residents stated that there were no drainage plans at this time, and they were concerned about damage that may be done to Martindale Road and properties in Titus 1st Addition. The commissioners felt that there would be no advantage to Prior Lake to have this roadway ^� connect. There was also concern about the drainage plans proposed for this area. It was noted that there were no plans at this time. Commissioner Cavill noted that the recommen- dations made to the City of Shakopee should be in the best interests of the people of the Titus 1st Addition. Those recommendations would be as follows; drainage study to determine the additional effects on adjacent property, especially that of Prior Lake, plat should be redrawn and redesigned taking into consideration easements to adjoining properties, especially;;_ to the south and that Martindale and Sandelwood not be connected.
