PRIOR LAKE, MINNESOTA 56372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION MINUTES OCTOBER 18, 1979 The October 18, 1979 meeting of the Prior Lake Planning Commission was called to order. Present at the meeting were Commissioner's Fitzgerald, Johnson, Arnold, Warmka, Chairman Speiker, Councilman Busse and City Planner Graser. Motion to approve the minutes of the October 4, 1979 Planning Commission meeting was made by Warmka, seconded by Arnold. Upon a vote taken, motion was duly passed and the minutes were approved as published. Chairman Speiker read a letter that was received from Maxine L. Miller, Secretary of the Grainwood West Townhouse Association. The letter requested that notice be given to the Grainwood West Townhouse Association of any hearings regarding buildings permits, variances, zone changes, or anything else concerning changes in Lakeside Marina. .. -.Item I, Public Hearing for Sorlien and Hoffman 1st Addition. There were no representatives )resent at the meeting. City Planner Graser was called upon, he gave his presentation as per his memorandum dated October 12, 1979. He noted that the property consists of 1.43 acres of R -1 zoned land. He noted that Island View Circle which provides access to Island View II Road had to be cut in front of the subject plat to meet grade restriction on the peninsula, because of this staff is requesting a 20' slope easement for lots 1 -5. He noted that very little regrading is necessary to develop the lots, however, precautions must be taken to limit potential erosion onto the lot to the south,which is about 10' lower than the subject parcel. Staff recommended preliminary approval contingent on the following: The Northwest corner of the plat be changed to reflect a road easement; a 20' slope easement be shown on the plat on lots 1 -5; at the time of grading or sodding, special precautions are taken such as straw bailing to reduce erosion potential on adjacent property to the south. Input from the public was taken. Mr. Alan Wilker was concerned about drainage onto his property. Mr. Jack Fiereck was also concerned about drainage onto his property. Walt Shoemaker questioned why the lots are going to be so small. Tom Watkins stated that he would like to see a drainway installed. The general concern of the Commission members was the drainage. They felt that some sort of plan should be submitted. City Planner Graser noted that the park dedication would be cash in lieu of land, the amount being $858.00. � lotion was made by Warmka to grant preliminary approval with the following contingencies: -2) The Northwest corner of the plat be changed to reflect the road easement; 2) a 20' slope easement be shown on the plat; 3) a satisfactory drainage and grading plan be submitted for the City Engineer's approval ':o resolve the drainage problem particulary the -1- (612) 447 -4230 4629 DAKOTA STREET S.E. I , Idcd to the motion was the request that the intended use of outlot "A" be made known. Upon a vote taken, motion was duly passed as amended. Item I1, variance request by Robert Klehr. Mr. Klehr was present at the meeting, he gave a short presentation to the Commission regarding this variance request. Mr. Graser stated that Mr. Klehr is requesting a 23' rear yard variance and an 8' side yard variance for Lot 21, Cates Addition, to erect a 28' x 26' garage. He stated that Mr. Klehr has purchased a 20' strip from Lot 2s, contingent upon the approval or denial of this variance request. He stated that the applicant is also proposing a turnaround. Staff recommendation was to approve this variance request, with the stipulation that if the neighbors complain of glare from headlights, the applicant shall erect a fence to remedy the problem. Motion to approve the variance request was made by Warmka with the stipulation that the driveway for lot 23 and this variance request be combined. Also, that if the neighbor's complain about the glare from headlights, he would have to erect a fence, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item III, Discussion lead by City Planner Graser regarding building restrictions in B- zones .< in Prior Lake. Mr. Graser stated that something must be considered with respect to building of the commercial area. He stated that his intentions are to limit, restrict, or establish 't an ordinance regulating the exterior or structures of metal buildings in a commercial zone,' Mr. Graser stated that the City Attorney, Mark Sullivan suggested that the building code could be amended to eliminate pole barns and metal buildings, in contacting the "League" -.,it was there opinion that this would be exclusionary zoning totally and anything that is _ '.n uniform building code must be allowed to be built. He stated that an ordinance could b( established to regulate the facade in the business district. It was suggested by the Commission that a board be established to address the aesthetic; questions of a building. It was felt that this need not apply to all building permits but to four plexes and higher densities, and commercial buildings. Motion was made by Speiker that the Planning Commission recommend to the City Council to address themselves to the question of commercial buildings, specifically steel buildings, ? pole sheds that would be conforming to the uniform building code, that their exterior be aesthetically pleasing to the general health and welfare of the commerical community and to consider the possibility of an architectural review board, seconded by Fitzgerald.. Upon a vote taken, motion was duly passed. Motion to adjourn the Prior Lake Planning Commission meeting was made by Fitzgeral by Johnson. PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PRIOR LAKE PLANNING COMMISSION MINUTES OCTOBER 4 1979 The October 4, 1979 meeting of the Prior Lake Planning Commission was called to order. Present at the meeting were Commissioner's Fitzgerald, Arnold, Warmka, Chairman Speiker, Councilman Busse, and City Planner Graser. Motion to approve the minutes of the September 20, 1979 Planning Commission meeting was made by Fitzgerald, seconded by Warmka. Upon a vote taken motion was duly passed and the minutes were approved as published. Item 1, variance request by Harold Dellwo. Mr. Dellwo was present at the meeting but had no opening comments. Graser was called upon to give a presentation to the commission. It was noted that Mr. Dellwo is requesting an 8 foot front yard variance for lots 14 and 15, Grainwood Park. It was noted that the City, through 15 foot easements on both: sides of the original roadway made Grainwood Circle a public road with 50 feet of right -of -way. As a result of the increased right -of -way many of the structures on the circle are less than the required 25 feet from the public right -of -way. It was also noted that a few years ago a similar variance appeal was made and the Council found that the set back should be from the original right-of-way. Staff recommendation was to approve the variance as requested.' Because there was no hardship involved and because the topography of the land will allow the garage to be moved back another eight feet, Fitzgerald felt that this variance request should be denied. Motion to reject the variance request because of alack of a defined hardship and that the precedent that has been established in the past has typically been one whereby we have been sensitive to the needs of an individual building a residence in conjunction with other buildings was made by Fitzgerald, motion failed for want'.' of a second. Chairman Speiker stated that he would like to see what is going on the property.. He also felt Mr. Dellwo has a legitimate right to put a garage on the property providing that it conforms to the ordinance and it is not a detriment to the neigh- borhood. He also noted that the commission must be concerned with the long range.`. impact of this. He stated that he could see no hardship demonstrated by the lot «.. or the ordinance. Busse questioned whether this would be a permanent structure. Mr. Dellwo stated 1 this would be a permanent structure and in the future he would be building a home with an attached garage. -1- (612) 447 -4230 4629 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 55372 -2- Motion was made by Warmka to deny the variance request on the grounds that no hardship has been shown and because she felt that earlier precedent has no e- bearing on this request, seconded by Arnold. Upon a vote taken motion was duly passed. Item 1I, Discussion of Agricultural lot sizes was called to order. Mr. Graser gave a brief presentation to the commission. He noted that basically what was discussed at the past commission meeting was setting up a density for a lot size regulating rural service areas. He noted that there are two basic ways of approach- ing this; one is a density; 4 units per acre, or 8 units per acre. He noted that one of the benefits of this would be that yrou could never be charged with exclutionar zoning, the other way would be by going 20 acre minimum or 10 acre minimum. You could be charged with exciutionary zoning, he noted that this is a much simpler' way to administer it but it consumes rural land. After much discussion amoung the commission members regarding this, it was noted that three members present felt it should be four building permits per forty acres and one member felt that it should be three per forty. It was noted by .Chairman Speiker that he had received a letter from Commissioner Johnson stating . that if he were at the meeting he would vote for four building permits per forty acres with 400 linear feet minimum fronting on a public road. Chairman Speiker stated that he would like to make a two part recommendation to the Council. One on density addressing the one per forty or four per forty. The second part being the front footage minimum lot size versus cluster. Motion was made by Warmka for four building permits per forty acres in rural seryi urea, seconded by Arnold. Upon a vote taken the motion was duly passed. Fitzgera, voted negative because he felt that there should have been a 10 acre minimum added to the motion. Motion was made by Fitzgerald to suggest to the Council that agricultural lands in ` the City of Prior Lake require a 10 acre minimum lot size and 440 feet of public road frontage per building permit this being predicated on the most sensible devel"'" opment of forty acres while maintaining the rural image, seconded by Warmka. Upon a vote taken, motion was duly passed. Motion was made by Arnold to adjourn the meeting, seconded by Warmka.
