April 20, 1978
The meeting of the April 20, 1978 Prior Lake Planning Commission was
called to order at 7:30 PM by Chairman Thorkelson. Members present
were Commissioners Speiker, Johnson, Cavill, Fitzgerald and City Planner
Graser.
The minutes of the April 6, 1978 Planning Commission were motioned for
approval by Speiker seconded by Cavill and upon a vote taken, motion
carried.
First item on the agenda was a discussion on different aspects of
problems on unusually shaped lots. Considerations were given to minimum
depth, square footage and the 10 foot dedication for Lakeshore.
The Kohlrusch public hearing was called to order at 7:45 PM. Mr. Graser
gave a brief description of the parcel involved noting the following
points: a) Public Utilities - this area would probably receive services
after the year 2000, b) the railroad was to provide service to this
industrial site and has now filed for abandonment, c) the other industrial
site, located in the southeastern part of the City, does not have sewer
and water but the possibility of services in the near future at this site
is adequate to handle the industrial needs of Prior Lake. Staff's
recommendation in this case was to approve the request since Prior Lake
cannot reasonably support this industrial site. On the other hand,
agricultural use is appropriate with respect to the City's Development
Framework.
Mr. Kohlrusch stated that t s area was zoned industrial for specific
reasons and those reasons r - conger exist. Commissioner Speiker motioned
to approve the rezoning as quested, seconded by Cavill. Chairman
Thorkelson stated that he thought this was too soon to rezone, maybe the
whole parcel should be rezoned agriculture in the future. Commissioner
Speiker stated that with changes coming in the Comprehensive Plan, he
still agrees with staff. City Manager McGuire stated that the plan will
take at least six months and maybe more. Upon a vote taken, Speiker
voted for the rezoning, Cavill, Fitzgerald, Johnson and Thorkelson
voted against. The rezoning was denied.
Next item was a preliminary discussion for the Almac Subdivision south
of County Road 42. Planner Graser stated there is only sewer and water
capacity for 25 acres eastward through existing systems. Mr. Hill stated
there will be 178 single family lots, 5 duplex lots and 18 lots that
will house 4 family townhomes. Motion was made by Cavill to hold the
public hearing for the subdivision at 7:45 PM June 1, 1978. Seconded
by Johnson and upon a vote taken motion carried. Motion was made by
Cavill to hold the rezoning hearing at 7:45 PM and the subdivison hearing
at 8:00 PM seconded by Fitzgerald and upon a vote taken motion carried.

Next item on the agenda was a variance request for Mr. Phil Grendahl.
Mr. Grendahl is requesting a S foot side yard variance for lot 24, Maple
Park Shore Acres. Mr. Grendahl was asked to lower the grade of the land
and slope the land on the west side of the proposed house. Motion was
made by Cavill to approve the variance as requested contingent upon
Mr. Grendahl grading and sloping the land to eliminate the erosion
problem prior to the final inspection by the building inspector seconded
by Johnson and upon a vote taken motion carried.
Next item on the agenda was a subdivision discussion for Larry Gensmore.
Motion was made by Cavill to hold a public hearing on May 18, 1978 at
7:45 PM seconded by Johnson and upon a vote taken motion carried.
Last item on the agenda was a discussion on the buildability of the lots
on Twin Isles island. Different problems that were discussed were: a) private
access and docks on the lake side, b) waste system must be worked out, c)
gray water, d) a "hold harmless" agreement stated on the building permit
in regard to public services.
Motion was made to adjourn by Johnson seconded by Cavill and upon a vote
taken the meeting was closed at 10:40 PM.

Mr. Schwartz is the planner for Leonard Brooks who is developing
the 24 acre Vic Schroeder farm. A layout proposal will be
presented at the meeting.
7:45 PM Nickelson Public Hearing. Subdivision. The applicant has
decided to discontinue the platting process.
7:45 PM George Borgerding - Variance. Mr. Borgerding is representing
Vic Schroeder. Attached please find proposal and recommendation.
8:00 PM Bruce Longevin - Home Occupation Permit. Staffs recommendation is to -
deny this request. Attached please find analysis.
8:15 PM Brooksville Hills 5th - Rezoning. Attached please find map and
staff's recommendation.

April 6, 1978
The meeting of the April 6, 1978 Prior Lake Planning Commission was
called to order by Chairman Thorkelson at 7:30 PM. Members present
were Commissioners Cavill, Speiker, Johnson, Councilman Busse and City
Planner Graser.
The minutes of the March 16, 1978 Planning Commission were motioned for
approval by Johnson seconded by Speiker and upon a vote taken were
approved as published.
Mr. Graser stated that he would like to add an item to the agenda. Motion
was made by Cavill to discuss a proposed subdivision for Carlson P, Carlson
at 10:30 PM seconded by Speiker and upon a vote taken motion carried.
First item on the agenda was a subdivision discussion for Mr. Dick Schwartz.
Mr. Schwartz is proposing to develop the Vic Schroeder 24 acre farm. Mr.
Graser gave a presentation siting low areas, grade problems and access to
Eagle Creek Avenue. Mr. Schwartz stated that he was in agreement with Mr.
Graser's proposal as to the driveways not fronting on Eagle Creek Avenue �~
(County Road 21). Questions were raised on the interceptor easements, lake 4
access, soil compaction from the interceptor and total number of lots. The
overall view of the Planning Commission was that the plan looked feasible
and the developer was asked to continue working with staff to work out
any additional problems.
Next item on the agenda was a variance application for Mr. George Borgerding.
A 63 foot Lakeshore setback variance and an 8 foot front yard variance are
requested for lot 9 and the south 42 feet of lot 10, North Grainwood. The
proposal is to remove the existing buildings and replace it with a year -
round home. Mr. Graser gave a description of the parcel inovlved. Motion
was made by Speiker to grant the variance due to the fact that the new
dwelling will encompass the old building envelope and it is a unique lot
and will be a permanent, year round home. Motion was seconded by Caviil and
upon a vote taken, motion carried.
Next item on the agenda was a Home Occupation Permit application for Mr.
Bruce Langevin. Mr. Langevin is proposing to construct light, two wheel,
horse drawn carriages at his place of residence, 16078 Cambridge Circle SE.
The parcel is zoned R -1. Planner Graser gave a brief description of the
request and Mr. Langevin then stated that he has an air conditioning unit
and extra soundproofing in the garage. He also stated that the noise does
not bother his wife who is immediately above him in the house. A petition
was then given to the Chairman with 16 signatures of the neighbors in
opposition to the home occupation permit. Cavill motioned to deny the
home occupation permit because of opposition of the neighbors and the` =�
occupation is not in compliance with the ordinance. Motion was seconded
by Johnson and upon a vote taken motion carried.

Next item on the agenda was a public hearing for Brooksville Hills St_h
Addition. The rezoning request is from R -1, single family to R -2 urban
residential. Mr. Graser presented staffs recommendations and considerations
which included: a) The parcel had at one time been considered for duplexes,
b) tLe impact on Brooksville Hills 3rd would be lessoned since the homes
directly across Franklin Trail would be facing Franklin Circle, c) a
rezoning would not result from a new residential pattern, d) the relation-
ship between Franklin Trail, a collector street and the subject parcel is
accepted by the public, e) lots must have hammerhead driveways. The
Planning Commission discussed these points during which time the public
had the opportunity to provide input. Motion was made by Cavill to grant
the rezoning as requested by staff seconded by Johnson and upon a vote
taken motion carried.
The public hearing for the Mary Eggum subdivision was opened at 8:55 PM.
Chairman Thorkelson read the answers to questions raised at the last
hearing and the memorandum from City Engineer Larry Anderson. Mr. Graser
went over additional engineering problems and items that had been discussed
with Mr. Ron Swanson. It was stated that Fairlawn Shores Trail will utilize
state aid funds and will possibly be straightened. Mr. Swanson stated that
the low area (Outlot A) may be filled and if not may be dyked and an over-
flow put in. The meeting was then opened to the public.
Mr. Schmidt objected to the road cut to Oakridge Court.
Mrs. Bluedorn asked if the purpose of the road was.:.iore of an alternative..
She does not think upgrading Fairlawn Shores is going to keep people from
using the new road.
Mr. Nelson stated that this addition is going to devalue his home.
Mr. Rygalo asked if it was aboslutly necessary to develop this land at
this particular time.
Mrs. Bluedorn asked r:'.iere the entrances onto Highway 13 would be. Mr.
Graser stated there would be no new entrances onto Highway 13 and Mrs.
Bluedorn asked why. Planner Graser stated why the Highway Department had
denied any new exits onto Highway 13. Commissioner Speiker stated that this
plan is the best he had seen of the subdivision. Chairman Thorkelson stated
that he hoped the people in the audience appreciated the work that had gone
into this subdivision. Motion was made by Johnson to recommend approval
of Prior Hills to the City Council seconded by Speiker and upon a vote taken,
motion carried. The public hearing was closed at 9:25 PM.
Next item on the agenda was a variance request for Mr. John Craig. The
variance request is for lots 3, 4 and 5, Spring Lake Townsite. The applicant
is requesting a 25' variance from the lakeshore setback. Motion was made by
Cavill to approve a 25' variance for this lot based on the zoning ordinance
section 4.1(I). Motion was seconded by Speiker and upon a vote taken, motion
carried.
Next item on the agenda was a subdivision discussion for Lawrence Schweich.
There was much discussion on the park dedication involved. Motion was made
by Cavill to hold a public hearing on May 4, 1978 at 7:45 seconded by Johnson
and upon a vote taken motion carried.

Next item was a subdivision discussion for Mr. Bob Larson. Mr. Larson'
is interested in subdividing the land adjacent to Elmer Busse's house
at 16530 Franklin Trail. The discussion was mainly concerned with the
private road leading to the four separate fourplexes. A suggestion
was made that the road go all the way through for traffic efficiency.
Commissioners all agreed that they would rather see the road go through than
have a common private drive. Chairman Thorkelson asked that the developer
come back and discuss further with staff.
Next item was a variance request for Mr. Everett Peterson. The applicant
is requesting a 7' -z foot side yard variance for the westerly 70 feet of
lots 3, 4, S and 6 of block 8, Original Townsite. Speiker asked if front
,yard setback will be the same with the addition. Mr. Peterson replied that it
would be the same. Motion was made to approve the 7!j foot side yard variance by
Speiker because ther is no variance between the existing structure and the
proposed. Seconded by Cavill and upon a vote taken motion carried.
Last item on the agenda was a discussion on the development for Carlson
& Carlson. Plenner Graser stated that he had worked out a different plan
with the engineer. The property is located between the Scott County Park
and Northwood Road. The alternative plan for the roads was given to the
gentleman who attended the meeting and he was asked to come back to staff
for further discussion.
There was some discussion on proposed building for Twin Isles. Mr. Graser
stated that he had not had time to go over all the material he had
received from different agencies. Graser stated that he would have a
write up within two weeks.
Motion was made to adjourn by Speiker, seconded by Cavill and upon a
vote taken the meeting was closed at 11:10 PM.
