THE CENTER OF LAKE COUNTRY CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE PLANNING COMMISSION .June 15, 1978 The meeting of the June 15, 1978 Prior Lake Planning Commission was called to order by Chairman Thorkelson. Members present were: Commissioners Speiker, .Johnson, Fitzgerald, City Planner Graser, Councilman Busse and City Manager Mike McGuire. The minutes of the June 1, 1978 Planning Commission meeting were changed in the second to the last paragraph, last page. The date of the Burmeister variance was deleted from the last sentence. Motion was made by Speiker to approve the minutes as changed, seconded by Johnson and upon, a vote taken motion carried. First item on the agenda was a variance request for Doug Larson. The request was for a S' front yard variance for lot 6 and the east 37.5' of lot 7, First Addition to Eastwood. The applicant would like to construct a 26' x 24' garage set back 20' from the curb line rather than the front lot line. Motion was made by Fitzgerald to grant the variance request, seconded by Speiker and upon a vote taken motion carried. Next item of discussion was setting a public hearing date for the Comprehensive Plan. Motion was made by Johnson to hold a public hearing on the Comprehensive Plan August 10, 1978 at 7:30 PM in the City Council Chambers seconded by Fitzgerald and upon a vote taken motion carried. The Public Hearing for Brooksville Hills 6th Addition was called to order at 7:45 PM. Planner Graser gave a description of the area involved. The meeting was then opened to the public. Mr. Bill Bond asked what the density would be. Mr. Graser explained the R -2 and R -3 areas. Mr. Bond then asked what type of zoning the parcel was previously. A woman asked if R -3 applied to commercial uses. Mr. Graser read her the list of different zones. She also wanted to know how the Redi -Mix Plant could stay in a residential neighborhood. Mr. Graser explained that it was there before the zoning ordinance was drawn up. She then voiced her concern about the high volume of traffic already using Franklin Trail and was afraid that this new division would generate more. Another woman asked how Franklin Trail came to be a county road in the first place and wanted to know what type of apartments would be built. Gary Eastland explained that the apartments would have underground garages with accesses on County Road 44 and Franklin Trail. Feels that they will utilize County Road 44. Collin Exsted stated that he lives on Franklin Trail and is mainly concerned with the traffic and his property values going down when the apartments are constructed. Wanted to know if there was another location for the apartments. THE CENTER OF LAKE COUNTRY Rill Bend asked what kind of tune frame the developer 141M be using;. Gory I ::I tIand stated that cons ruction would begin within the n! t one to 'wo voars with the single faini1V homes built 11!",I 'Ibe meeting was then closed to the public and motion was made by Speiker to approve the preliminary plan for Brooksville lulls 6th Addition rezoning seconded by Johnson and upon a vote taken motion carried. The Public Hearing for the subdivision of Brooksville Bills 6th was opened at 8:45 Pm. Planner Craser gave a description of the area stating that there were some drainage problems that would have to be corrected. Mr. Ron Swanson stated that he was not aware of the problems and that they would be corrected. Bill Bond asked if storm sewers had to be created for the new sub- division would all people utilizing the water runoff be assessed. Mr. Graser stated yes, everyone could be assessed. Commissioner Fitzgerald asked if the Redi -Mix Plant were included in the plat. Mr. Graser replied no. Hammerhead driveways required in lots off of Franklin Trail. Motion was made by Johnson to grant preliminary approval contingent on the drainage problems being worked out between the City Engineer and the developer and hammerhead driveways on the R -2 lots facing Franklin Trail seconded by Speiker and upon a vote taken motion carried. Next item on the agenda was a subdivision discussion for Cy Schweich. Mr. Schweich is proposing to subdivide the R -2 area between Albany and Park Avenue. Two adjacent areas are being platted near this parcel. Graser stated that all three areas would be discussed with the developers together to work out a solution to the road system. Motion was made by Johnson to hold the subdivision hearing at 8:15 PM seconded by Speiker and upon a vote taken motion carried. Next item was a discussion for Ron Swanson for Brooksville Center 2nd Addition. The current zoning is B -3. The reason the lots are laid out like this is because lot 1 will be added to the Center property. Staff will not issue a building permit until it is subdivided. The parcel's must conform to the setback requirements. Chairman Thorkelson asked if the lots were of size to handle any new commercial building. The concensus was that they were. Motion was made by Speiker to hold a public hearing on July 20, 1978 at 8:45 PM seconded by Johnson and upon a vote taken motion carried. Next item was a discussion for Ron Swanson representing G & E Industrial Park. The subdivision consists of 10 lots, each one acre. The soil condition is suitable for industrial - mostly gravel. There is no sewer and water in the area so the council and planning commission will have to decide on this matter. Motion was made by Speiker to hold a public hearing on G $ E Industrial Park on August 3rd,' 1978 at 7:45 PM seconded by Johnson and upon a vote taken motion carried. Next item was a concept discussion with Ron Swanson about Sunset Hills Addition. The proposal contains 94 lots. Concept approval was given. Motion was made by Johnson to schedule a public hearing on August 3, 1978 at 8:15 seconded by Speiker and upon a vote taken motion carried. -2- Next item was a variance request for Charles Bernhagen. The variance request is for the northerly part of lot 11, Shady Beach N2. The subject parcel has a year round home on it with a detached garage. The applicant is proposing to remove the existing garage and replace it with a double garage with living quarters above. After some discussion, motion was made by Fitzgerald to grant the variance as requested, contingent upon submitted material be part of the record. Building permit must conform to the guidelines of the recorded material. Seconded by •Johnson and upon a vote taken motion carried. Ncxt item was a variance request for Mr. Paul Larson. The request is for iot 13 and the south 25' of lot 14 Sunset Shores. The subject parcel is a 75' x 136' lakeshore lot zoned R -1. Sunset Shores was platted about 40 years ago into 50' lots and recently has been used as a summer resort. The request is for 2.5' on each side yard setback. Motion was made by Speaker to deny the variance as applied for because he concurred with staff's recommendation stating that there is no hardship involved nor is the lot unique with respect to the adjacent properties. Next item was a concept discussion for Larry Loucher. The parcel involved is along Northwood Road on the Prior Lake side. Sewer and water is going through this area now and would handle the additional subdivision. Motion was made by Johnson to hold a public hearing on this subdivision on August 3, 1978 at 8:45 PM seconded by Fitzgerald upon a vote taken, motion carried. Members present were Councilman Busse, Commissioners, Johnson, Fitzgerald, Cavill, Speiker and City Planner Graser. The minutes of the May 18, 1978 Prior Lake Planning Commission were motioned for approval by Cavill seconded by Johnson and upon a vote taken were approved as published. First item on the agenda was a variance request for Mr. Phil Grendahl. Mr. Grendahl came before the Planning Commission on April 20, 1978 requesting a 5' side yard variance from the west property line at lot 24, Maple Park Shore Acres. The applicant is now requesting a 5' side yard variance from the east property line. Motion was made by Fitzgerald to deny the variance request because placing the building on the lot as shown would not constitute a hardship add lack of accurate information seconded by Johnson and upon a vote taken motion carried. Second item on the agenda was a variance request for Joe Czech. The applicant had applied for a building permit for lot 8, block 3, Brooksville Hills 2nd Addition. Apparently, a misunderstanding resulted in the footings being poured too close to the front property line. The original lot plan showed the home wit'i its proper setback. Mr. Czech then explained to the Commission how the problem arose, stating that the copies of the building plans that were given to the building inspector were marked with the 2' change but the one received by the mason was not changed. Commissioner Cavill stated that he would consider granting a variance in this case because it was an honest mistake and because of financial hardship. Motion was made by Speiker to deny the variance because he does not want to set a precedence and there is no hardship being created by the topography of the lot, seconded by Thorkelson and upon a vote taken, the motion was defeated. Voting against were Commissioners Fitzgerald, Cavill and Johnson. Motion was then made by Cavill to grant the variance request because literal enforcement would result in undue hardship to the builder based on an honest mistake. The degree of harship to Mr. Czech should also be considered if the building had been completed and a fine imposed on the finished building. In this case, the hardship is quite severe. Motion was seconded by Johnson. Commissioner Speiker then stated that this is a manmade hardship and it was a dangerous precedent to set. After this discussion, a vote was taken and motion carried. Speiker voted against. Because staff had recommended denial of this variance, this will now go before the Council on June 12, 1978 at 7:30 PM. THE CENTER OF LAKE COUNTRY Next item or, the agenda was a variance request for Mr. Wayne Laurence. Mr. Laurence's single car garage had been converted into living space and he now needs a variance for 15' from the pavement. Staff recommended denial of the variance but suggested that the proposed garage be moved back S additional feet leaving a 20' setback from the pavement. This seemed to be an acceptable solution to Mr. Laurence. Motion was made by Fitzgerald to recommend approval of the variance 20' from the paved portion of Rutgers Street seconded by Speiker and upon a vote taken motion carried. Last item on the agenda was a variance request for Mrs. R.E. Burmeister who resides at 3140 Butternut Circle. The request is to consider a variance to move an existing boathouse back 40' from the lake to save the building from extensive water damage. T,ne request is for a two foot side yard variance and a 6S' Lakeshore variance. The building is currently being used as a guest house with a storage area below. There was a suggestion to put the guest house in front of the existing home. After more discussion a motion was made by Speiker to grant the variance with the following stipulations: 1. The guest house (boat house) be moved back at least 40 feet from the lake and the side yard setback be 10' based on the size of the structure. 2. This must remain a guest house. Under no circumstances it is to become a year round home and it may not be rented out. Motion to approve the variance with these stipulations because, Commissioner Speiker felt that an effort is being made to comply with the ordinance. Also, not to allow the owners to move the dwelling would lead to a less desireable situation, seconded by Cavill and upon a vote taken motion carried. Commissioner Fitzgerald voted against the motion.
