Attached please find memorandum and map. 8:30 PM Roll Thieling - Concept Approval for Subdivision The applicant is proposing to subdivide a parcel of land about 250' x 150 fronting on Estate Avenue and 150th Street. The parcel is vacant and has sewer and water available. Routine subdivision procedures should be followed. Recommend a public hearing be scheduled December 21, 1978 at 7:35 PM. Attached please find map. 9:00 PM Erickson Corporation - Variance Attached please find supporting materials. Staff encourages all Planning Commission members to site check this area because this decision could affect future traffic planning. 9:15 PM Warren Israelson - Concept Approval This plan appeared before the Commission about two months ago. At that time the applicant was to develop alternate schemes due to the severe topographical limitations. Attached please find the latest scheme. THE CENTER OF LAKE COUNTRY CITY OF 7RIOR LAKE, MINNESOTA 55372 PLANNING COMNIISSION MIN UTES November 16, 1978 The meeting of the November 16, 1978 Prior Lake Planning Commission was called to order by Chairman Ihorkelson at 7:30 PM. Members present were Commissioners Cavill, Speiker, Fitzgerald, City Council- man Busse and Planner Graser. The minutes of the November 2, 1978 Planning Commission were motioned for approval by Fitzgerald seconded by Speiker and upon a vote taken motion carried. Mr. Graser stated that there was to be a joint meeting with City Council and Planning Commissioners on Monday, November 20, 1978 at 8:00 PM for the purpose of the Comprehensive Plan discussion. The public hearing for the Prior West subdivision was called to order at 7:40 PM. Concept approval was given October 11, 1978 for a plat similar to this. Sewer and water is available to the plat. Mr. Graser stated that Scottland, Inc. was interested in putting up an additional 51 unit apartment building behind this subdivision. Scottland would like to gain access through the proposed plat. Mr. Wagner, representing Prior West, asked who would be paying the utility and road fees. Mr. Eastland was not available for comment. Chairman Thorkelson felt that the road could be put in by rearranging the lots. Mr. Graser felt the developer should not be charged for the entire road. Private negotiations between developer and Scottland precede a decision. Motion was made by Cavill to table the public hearing for three weeks so the possible extension of the street to the south and the drainage problem could be resolved, seconded by Fitzgerald and upon a vote taken the meeting was scheduled to be continued on December 7, 1978 at 7:35 PM. The public hearing for the Wayne Hanson subdivision was called to order at 8:15 PM. Mr. Graser gave a description of the property and discussed the staff recommendation. Easements were discussed. Motion was made by Cavill to approve the subdivision subject to a 17' road easement from the south property line and a 10' utility easement from the east property line seconded by Fitzgerald, upon a vote taken motion carried. Next item was a subdivision discussion for Mr. Rollie Thieling on the corner of Estate and 150th Street. This is a simple division of two lots. Motion was made by Speiker to hold a public hearing on January 4, 1979 at 7:35 PM seconded by Fitzgerald and upon a vote taken motion carried. THE CENTER OF LAKE COUNTRY Next item was a variance request for the proposed Holiday Station, adjacent to the Dairy Queen and Highway 13. Mr. Graser gave a description of the parcel involved. Jerry Jensen passed a picture around of what the proposed station will look like. Parking stalls were discussed. Representatives from Erici< son Petroleum stated that they have 16 stalls and eight additional stalls including the gas pump area. Commissioners were asked how they felt about reducing the lot size. Commissioner Cavill stated that he could not go along with reducing the lot size. Speiker could go along with reducing the lot size if there were some hardship. Fitzgerald is opposed to the reduction. Chairman Thorkelson stated that the lot size could be lowered in the appropriate place. Motion was made by Cavill to deny the variance because there is no hardship, therefore setting a precedence in this B -3 area, seconded by Fitzgerald and upon a vote taken motion carried. Next item was a discussion on subdivision concept approval for Mr. Warren Israelson. The parcel is located on the east side of Highway 13 adjacent to Fish Point Road. Upon polling the commissioners, the concensus was that this type of plan was much more acceptable to everyone with the .enlarged lot sizes than the previous plat submitted. Mr. Israelson was told that he can proceed with plan preparations and submit them to the City Engineer and Mr. Graser. Mr. Graser stated that at the next Planning Commission meeting they would review the Harbor PUD and go over sign problems in the City. Mr. Graser stated each owner of a flashing sign should be sent a letter stating they were in violation of the Prior Lake Sign Ordinance. Motion was made by Cavill to adjourn, seconded by Fitzgerald and upon a vote taken the meeting was closed at 9:45 PM. CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE. PLANNING COMMISSION November 2, 1978 Agenda: 1. 7:30 PM Gary Gibbish Public Hearing (Preliminary Plat) 2. 7:45 I'M LeRoy Bohnsack Conditional Use City Planner Graser will not be at this meeting, however, Consultant Planner Tooker will be present. Mr. Tooker will also discuss the housing portion of the Comprehensive Plan since there was not a quorum at the regular scheduled time of this element. THE CENTER OF LAKE COUNTRY CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE PLANNING COMMISSION November 2, 1978 The meeting of the November 2, 1978 Prior lake Planning Commission was called to order by Chairman 91;nrkelson at 7:30 PM. Members present were Commissioners Speiker, Fitzgerald, .Johnson, City Planner Tooker and City Manager McGuire. First item on the agenda was a public hearing for Gary Gibbish. Mr. Gibbish is subdividing the parcel between the car wash and Memorial Park Apartments on 160th Street. The plans for the parcel are two quad homes. Mr. Tooker explained where the parcel was and described the circulation system. Mr. Tooker also stated that the Assistant Scott County Engineer had suggested one driveway onto County Road 44. Mr. Gibbish explained that these are not apartments and for aesthetics he preferred to have three driveways. Mr. McGuire stated that the City does not control where an access goes on a County road - the County does. Mr. Gibbish stated that he would like to feel he had the support of the Planning Commission for the three driveways before he went down to talk with the County Engineer. Motion was made by Speiker to recommend preliminary approval of the subdivision with the stipulation that a satisfactory resolution be worked out with staff, the developer and the County Engineer on the access to 160th Street and that a copy of the homeowners agreement will be attached at the time of hardshell, seconded by Johnson and upon a vote taken motion carried. Next itew was a conditional use permit application for Mr. Leroy Bohnsack. Mr. Bohnsack is requesting a conditional use permit to construct an equipment storage building in a B -3 zone. The subject parcel is approx- imately one acre in size fronting on Franklin Trail for 150'. The proposal is to construct a 60 x 70' metal structure towards the rear of the lot for additional storage of equipment and repair. Mr. Bohnsack stated he could not see what the difference was whether it was a retail outlet or what. Commissioner Fitzgerald stated that he thought the use and structure would not be conducive to the surrounding area. Commissioner Speiker stated that he flet that new developers had an idea what was existing around their area before purchasing land. If Mr. Bohnsack could clean up the area he had no objection. Commissioner Johnson stated it would be hard to find another spot for this use. Would like to see the area cleaned up. Chairman Thorkelson stated that the Planning Commission was making a serious mistake by allowing this use to expand. The existing building would also stay which would be in opposition to the Planning Commission. Motion was made by Fitzgerald to deny the request because the proposal would not be site oriented to produce a harmonious effect with existing area and environment. Motion was seconded by Thorkelson and upon a vote taken the was a tie vote. Commissioners Johnson and Speiker voted against the motion. The conditional use application will now go before the Council for their decision on the split vote. THE CENTER OF LAKE COUNTRY Speiker then stated that last October, the Planning Commission discussed the screening of the Prior Lake Lumber Yard. To date, nothing has been done. .Approximately a month ago, Mr. Graser discussed the situation with Steve Frendshuh of the lumber yard. Mr. Frendshuh told Mr. Graser at that time that they would be putting slats in the cyclone fence. Mr. Tooker then discussed the housing development for the Comprehensive Plan. The Metro Councils concern is that there be housing for low and moderate income families. The Metro Council has revised the population forecase somewhat but they still do not agree with staffs opinion. The smaller lot size concept was also discussed. Motion to adjourn was made by Speiker seconded by Johnson and upon a vote taken the meeting was adjourned.
