THE CENTER OF LAKE COUNTRY CITY OF PRIOR LAKE, MINNESOTA 55372 Prior Lake Planning Commission Minutes September 21, 1978 The meeting of the September 21, 1978 Prior Lake Planning Commission was called to order by Chairman 7horkelson at 7 :30 PM. Members present were Commissioners Johnson, Fitzgerald, Speiker, Cavill and City Planner Graser. Motion was made by Fitzgerald to approve the minutes of the September 7, 1978 Planning Commission meeting seconded by Johnson and upon a vote taken minutes were approved as published. First item on the agenda was a home occupation permit for Richard Bothel. The request is to consider a "Pet Selection Service" as a home occupation permit. The proposed home occupation is an advisory service to help families select pets for their homes. The service will be performed at the clients home. Motion was made by Fitzgerald to approve the - application as applied for seconded by Johnson and upon a vote taken motion duly passed. Next item was a variance request for Steve Nelson. Mr. Nelson is requesting a 5' side yard variance for lot 4, Original Townsite. (16250 Evanston Avenue) The applicant is proposing to add a 20' garage to the south side, of the home where the existing driveway is. Motion was made by Speiker to approve the request for a 5' side yard variance for 16250 Evanston Avenue seconded by Cavill and upon a vote taken motion carried. Next item was a variance request for Mr. Lawrence Schweich. Mr. Schweich is requesting a 4' side yard variance for lot 40, Northwood. The applicant is proposing to construct a 28' x 38' year round home. The existing cabin will b4 torn down. Motion was made by Cavill to approve the variance of a 4' side yarl variance on the north side because of existing trees and the new structure wil? be in better conformance with the ordinance. Seconded by Johnson and upon a vote taken motion carried. Next item was a variance request for Mr. Jim Dunn. The request was to consider • lakeshore variance for lot 1, Martinsons Point. The request is to rejuvenate • dilapidated cabin presently situated at the 904 elevation. Motion was made, by Fitzgerald to deny the request based on failure of applicant to clearly demonstrate purpose of plans, suitability of location for preservation of cabin,`'; and the historic significance of the building does not appear to warrent special consideration and most of the building exists below the 904 level. Seconded by Cavill and upon a vote taken motion carried. Next item was a variance request for Gary Listrude. Mr. Listrude is requesting a 7' side yard variance for lot 4, block 16, Criginal Townsite. The applicant is proposing to construct a 22' x 26' garage 3' from the subject parcels east property line. Motion was made by Johnson to approve a 5' variance seconded by Speiker and upon a vote taken motion carried. Next item was a concept approval discussion for Gary Gibbish. Mr. Gibbish is proposing to construct two quad -homes on 160th Street between the car wash and THE CENTER OF LAKE COUNTRY the Memorial Park apartments. Mr. - ibbish explained the quad - homes " and maintenance nlans. There would be two separate homeowner associations. Motion was made by Cavill to schedule a public hearing for Mr. Gibbish on October 19, 1978 at 7:35 seconded by Speiker and upon a vote taken motion carried. Next item was a home occupation permit application for Mr. James Iverson. Mr. Iverson is requesting a home occupation permit for 14251 Timothy Avenue. The subject parcel is located in a single family neighborhood which developed in the last 5 - 10 years. The applicant is presently operating a distributing company which consists of a watts line operating outside Minnesota. Auto parts are delivered four to six times a month via semi truck then repacked and shipped to clients via UPS. It is the objective of the zoning ordinance to maintain a homogenious neighborhood. The semi truck delivering parts to the home is foreign to the neighborhood and possibly dangerous and illegal. Chairman Thorkelson read the home occupation permit regulations from the zoning ordinance. A semi truck in this neighborhood could be illegal because of load restrictions. Motion was made by Cavill to deny the request because as the use presently exists, it is in clear violation of the ordinance seconded by Johnson and upon a vote taken motion carried. Motion was made by Speiker to adjourn seconded by Fitzgerald and upon a vote taken the meeting was adjourned at 9:05 PM. IV CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE PLANNING COMMISSION September 7, 1978 AGENDA: 1. 7:30 PM Dale Reimers - Variance 2. 7:45 PM Bill Smith - Subdivision Public Hearing 3. 8:00 PM Almac, Inc. - Continuation of Public Hearing for Subdivision 4. 10:15 PM Harold Gustafson - Variance THE CENTER OF LAKE COUNTRY CITY OF PRIOR LAKE, MINNESOTA 155372 PLANNING COMMISSION MINUTES September 7, 1978 The September 7, 1978 meeting of the Prior Lake Planning Commission was called to order at 7:30 PM by Chairman Thorkelson. Members present were Commissioners Speiker, Cavill, Thorkelson, Johnson, Fitzgerald, Councilman Busse and City Planner Graser. The minutes of the Planning Comnissione meeting of August 17, 1978 were motioned for approval by Fitzgerald seconded by Speiker and upon a vote taken motion duly passed. The minutes of the special meeting for discussion on the Cor;prehensive Plan of August 31, 1978 were motioned for approval by Speiker seconded by Fitzgerald and upon a vote taken motion duly passed. First item on the agenda was a variance request for Mr. Dale Reimers. The request was a 21' rear yard variance for lot 3, block 1, Costello's Addition, to build a garage. Motion was made by Fitzgerald to grant the variance with a 20' rear yard variance and a 10' side yard variance seconded by Johnson and upon a vote taken motion carried. The public hearing for Franklin Trail Estates was called to order at 7:45 PM. Planner Graser pointed out the site on a map for the audience and the devel- oper then passed out an addendum to the commissioners. The addendum was a new proposal with five less living units to conform to the zoning ordinance. It was suggested by Mr. Graser that a berm or landscaping be done surrounding the property owned by Mr. Elmer Busse. The developer stated that when they level the area a berm will be created to shield Mr. Busse's home. 'Motion was made by Cavill to grant preliminary approval on the subdivision as submitted seconded by Johnson. Fitzgerald then asked that the motion be amended to state the driveway of the subdivision will be set back 10 feet from the property line to allow room for proposed berm or landscaping. Upon a vote taken motion carried. Next item on the agenda was a public hearing for the continuation of the Sand Pointe Subdivision. Chairman Thorkelson stated that the public notice had been published in the Prior Lake American on August 30, 1978 and September 6, 1978. Planner Graser gave a brief description of the parcel involved. Mr. Hill the developer, then described changes that had been made. Mr. Graser then discussed considerations that were desired by city staff. The meeting was then opened to the public. A gentleman asked how land could be platted before sewer and water was avail- able. Planner Graser stated that no building permit would be issued until sewer and water was available. Marge Kinney stated that the neighboring residents have have the following comments. 1. Connection. to Shady Beach Trail 2. Location of quad homes. 3. Alignment of Crest Avenue. 4. The availability of sewer and water. S. An environmental assessment worksheet should be THE CENTER OF LAKE COUNTRY completed 'before preliminary approval is given. However, the discussion centered around the alignment of Birchwood and land use adjacent to it. Don Williams stated that he is opposed to the fourplexes, feels it would set a precedence. Frank Anderson disagreed with giving any more land to Sand Point Beach as park dedication. Feels Prior Lake citizens cannot use it. Feels the park is a nuisance to some. Would also like a buffer for his property. Would like to see something else done with Shady Beach Trail. Gary Zywotko asked about water pressure in the subdivision. Wanted to know what the guarantee was that the R -1 areas would remain zoned - R -1. Wanted to know average lot sizes. Ed McCorkell thinks the sewer and water should be discussed before the subdivision is platted. A gentleman stated that he would like to see the road built back at Crest Avenue and County Road 42 because of grade problems. Mr. Hill then stated that the quad homes do have conditional use permits which gives the City control over them and the homeowners association covenants must be filed with the city. He also stated that the developer had been paying taxes on this land all these years as the residents had. Mr. Hill said that the preliminary plan must be approved before they can get EAW approval. Mr. Hill also commented on the question that had been brought up about duplexes going up on the larger lots in the subdivision, stating that if this were to happen, the overall plan of the neighborhood would be destroyed. Commissioner Fitzgerald felt that the popular concensus of the council and Planning Commission was that a tie in with Shady Beach Trail was necessary. Fitzgerald then suggested making Birchwood Avenue a Circle and move the R -2 area to one of the outlets near the park replacing the R -2 area with R -1 single family. Commissioner Cavill fel - sat R -3 area should be buffered for existing homeowners. Also felt that it was important to attach neighborhoods instead of itilizing County Roads for walking and biking. Speiker stated that he would rather see high density near the main thoroughfare. Councilman Busse asked Mr. Hill if they would consider making Birchw000d a private street with a 10' walkway on the side. Mr. Hill replied that he didn't think it would be right to charge the homeowner twice for maintenance of roads. Planner Graser stated that 10 to 1S years down the road from now people will have to go out on County Road 42 to get back in the Sand Pointe Subdivision if there is not a neigh- borhood connecting street. Mr. Hill stated that the suggestions could be checked out and he will look at the possibilities of the suggestions. Felt that he was obligated to the Shady Beach connection. Motion was made by Fitzgerald to approve the preliminary plat as presented with the following stipulations: 1. The outlots as shown be parkland. 2. Birchwood Avenue be realigned as a circle and called a circle with a connection to Shady Beach Trail. The land use for lots 1 and 2 block 14 be changed to R -1. Lots 1,2,3,4 and 11, block 13 be changed to R -1. 3. The displaced R -2 quad homes be located south of Outlet C with walkways on either side of buffer. 4. Amblewood Drive be eliminated (that portion connecting Aspen and Crest). S. The connection to Shady Beach Trail not be made until Crest and Aspen are improved. 6. The entire subdivision contingent on EAW. 7. Street grades be resolved, particularly Crest Avenue. 8. Birchwood not connect to County Road 42 until the adjacent uses are determined. 9. Sewer and water problems be resolved prior to hardshell approval. Motion was seconded by �Iavill and upon a vote taken motion carried. Last item on the agenda was a variance request for Harold Gustafson. Mr. Gustafson is requesting a 3.5' side yard variance for lot 10, Northwood. The request is to add a 19' x 24' addition to the front of the garage. Motion was made by Speiker to approve the variance as requested seconded by Cavill and upon a vote taken motion carried. Motion was made by Speiker to adjourn seconded by Fitzgerald and the meeting closed at 10:45 PM.
