AGENDA REPORT
1. Norm Brown - Discussion of conditional use permit. Mr. Brown
is requesting an amendment to the conditional use permit issued
for a duplex on Grayling Circle in Boudins Manor. He wants
the part amended that states the owner of the home must live
in the home to rent the basement.
2. Steve Mueller - Rezoning Hearing. Map and recommendation is
attached.
3. Lawrence Schweich - Zoning Map Discrepancy. The zoning map
does not show an R -1 and B -2 zone which were granted to Prior
South Subdivision in 1971.
4. Arlene Dienzel - Rezoning Request. A parcel map is attached.
Recommend to hold public hearing on January 19 at 7:45 PM.
S. Charles Berhagen - Variance. Attached find a map and recommendation.
6. Discussion - Please be prepared to discuss lot size standards.

December 15, 1977
The meeting of the Planning .Advisory Commission was called to order
at 7:30 PM by Chairman Thorkelson. Members present were: Commissioners
Haformann, Houts, Speiker, Councilman Busse and City Planner Fraser.
The minutes of the December 1, 1977 meeting we•e motioned for approval
by Houts seconded by Hafermann, and upon a vote taken motion duly passed.
First item on the agenda was a request to amend the conditional use permit
granted to a duplex at 15154 Grayling Circle in Boudins Manor. Motion was
made by Houts to grant the request on the condition that the owner could
rent out the home on the basis that he is transferred or out of state for
a period of no more than one year but that the house remain his home of
record. Seconded by Speiker and upon a vote taken motion duly passed.
The public hearing for the Steve Mueller rezoning was opened at 8:00 PM.
Mr. Graser gave a brief presentation of the area involved. Mr. Mueller
stated that he would like the area rezoned because he felt that with the
adjacent area being single family the duplexes would fit in better than
apartment buildings and he would like to assist in the construction of the
buildings which would enable him to live in one of the duplexes while working
on them. Chairman Thorkelson asked Mr. Mueller is he had considered a town -
home approach. Mr. Mueller replied that he would rather have duplexes because
of ease in maintenance, longer rental periods and he could assist in the
construction. City Manager McGuire stated that the sewer and water facilities
were a result of the Comprehensive Plan and if the area is rezoned, another
area may have to be changed to facilitate an R -3 zone. Houts felt that this
was a reasonable request but that there were alternatives. Motion was made
by Hafermann to deny the request because R -3 is the intended zone, it is the
best use for this piece of land and the reasons for changing are not strong
enough at this time. Motion was seconded by Houts and upon a vote taken,
motion duly passed. The public hearing was adjourned at 8:45 PM.
The next item on the agenda was a discussion about a discrepancy in the
zoning map. The developer claims that when Prior South was platted in 1971,
six lots adjacent to Franklin Trail were granted a commercial zoning, but
the zoning map reflects an R -1 zone. Motion was made by Thorkelson requesting
the City Attorney and administration to correct and bring up to date the zoning
map with the revised zoning seconded by Houts and upon a vote taken motion
carried.
Next item was a rezoning request for Arlene Dienzel. The zoning is now
conservation and she would like it changed to B -2. The property is a small,
triangular shaped piece of land on the immediate west side of Highway 13 south
of Block 10, original Townsite. Motion was made by Houts to hold a public
hearing on January 19, 1978 . at 7:45 PM seconded by Speiker and upon a vote
taken, motion carried.

Next item on the agenda was a variance request for Mr. U—rles Bernhagen.
Commissioner Houts did not participate in this discussion. The variance
request is for a portion of Lot 11, Shady Beach #2. The applicant is
requesting a 55' variance from the lakeshore setback. The applicant is
proposing to remove the single garage and construct a triple car garage
attached to the house and add additional living space over the garage.
After much discussion, Chairman Thorkelson stated that an alternative
solution should be given to Planner Graser and the Planning Commission
members should all take a look at the lot. Mr. Graser stated that staff
will draw up a survey showing exactly where the house is situated on the
lot. Motion by Speiker to table the request until January 19. 1978 at
8:00 PM, seconded by Hafermann and upon a vote taken motion duly passed.
Commissioner Houts rejoined the meeting.
Next item on the agenda was a discussion on lot size standards. Mr.
Graser feels that it is important to have adequate housing for low and
moderate income families. A possible alternative would be to amend the
ordinance to read that a builder must have a certain amount of 6 to
8,000 square foot lots.
Motion was made by Speiker to adjourn seconded by Houts and upon a vote
taken the meeting was over at 10:00 PM.

AGENDA REPORT
1. Gary We E . 11 - Variance continuation. The reasons for tabling
this variance was the discrepancy in the lot measurements.
According to staff the east corner of the garage is 13 feet
from the front lot line rather than as shown in the drawing.
Staff was firm in it's 20 foot front yard recommendation. If
the applicant would move his home four feet to the west and
four feet back, then the 20 foot front yard setback would be
realized.
2. Pat McGinnis - Home occupation permit. The adjacent property
owners were notified of the request. Additional information
will be presented at the hearing.

The meeting of the December 1, 1977 Prior Lake Planning Advisory
Commission was called to order at 7:30 PM by Chairman Thorkelson.
Members present were Commissioners Bouts, Hafermann, Cavill, Speiker,
Councilman Busse and City Planner Graser.
The minutes of the November 17, 1977 meeting were changed in the second
paragraph to read; " Houts motioned that the Lumber Yard must meet the
conditions as stipulated in the conditional use permit, seconded by
Speiker and upon a vote taken motion duly passed." Motion was made to
approve the minutes as amended seconded by Cavill and upon a vote taken
motion duly passed.
First item on the agenda was a continuation of a variance for Mr. Gary
Wehrwein. The reason for tabling this variance was that there was a
discrepancy in the lot measurements. After some discussion on the slope
of the lot, Chairman Thorkelson stated that the ordinances and restrictions
were in effect before Mr. Wehrwein bought the lot. Chairman Thorkelson
also stated that the Commission would be setting a precedence by granting
a variance for less than five feet. Motion was made by Speiker to deny the
variance as requested but added that alternatives for the house plan could
be brought in and discussed with no extra charge to Mr. Wehrwein seconded
by Cavill and upon a vote taken motion duly passed.
Second item on the agenda was a home occupation permit for Mrs. Pat
McGinnis. The neighbors had been contacted and stated that they were not
in opposition to the request. A list of signatures and a letter from the
Scott County Human Services Department were entered into the discussion.
Motion was made by Cavill to approve the home occupation permit as requested,
to be effective August, 1975 contingent on state approval, seconded by
Hafermann, upon a vote taken, motion duly passed.
Motion was made by Cavill to adjourn seconded by Hafermann and upon a vote
taken meeting was adjourned at 9:00 P.M.
