Members present were Commissioners Houts, Ca4 -H and City Planner Graser. Klein was Present for the first 15 min ifies ° of the meeting. 0 911 % The minutes of the May 5, 1977 meeting were changed to read: Last paragraph, page 2 should state that Chairman Thorkelson did not chair the public hearing on the .lames Rezoning. In the same paragraph the motion to deny the rezoning should read, Klein made a motion to deny the rezoning request for P, -2 zoning,. . . . the vote was unamimous. Then "motion was made by Cavill to rezone the parcel to B -1, seconded by Klein and upon a vote taken motion duly passed. Hafermann voted against the motion. The minutes were then motioned for approval by Houts, seconded by Hafermann and upon a vote taken were duly passed. First item on the agenda was a rezoning request for Mr. Gary Hanson. Mr. Hanson would like to rezone the property adjacent to Franklin Trail and Highway 13. The parcel proposed for rezoning is a strip of land 343.35' by 176' in the NE corner of intersection 13 and Franklin Trail. The proposal is for R -3 and Mr. Hanson would like to put a Standard Station on the parcel. Mr. Hanson was asked if he was aware that this parcel had been up for rezoning before and was denied. Mr. Hanson replied that he was aware of that fact. Motion was made by Hafermann to hold a public hearing on July 7, 1977 at 7:45 P.M. seconded by Klein and upon a vote taken,' motion carried. Second item on the agenda was a public hearing for Mr. Jim Hill. Mr. Hill is proposing to rezone a 7.19 acre peninsula of land from C -1 to R -1. Graser gave a presentation on the parcel stating that the area is mentioned in the Comprehensive Plan as Public /Semi Public land. The 1977 Capital Improvement Program has the installation of sewer and water running to the end of Northwood Road resulting in an extremely long dead end watermain. It was staff's concensus that the rezoning request would result in a looped watermain which would benefit the property and nearby property. The newly created lots would be in a category where supply is low and therefore not add to the already oversupply of middle and lower income lots. Also the rezoning would not be detrimental to any adjacent property values or create an over- abundant amount of traffic. Mr. Jim Hill then give his presentation. The public hearing was opened to the public and Mr. Lou Jambois, City Park Director, explained that he would like at least 30 days to check out the possibilities of getting some kind of finding or grant to purchase this parcel for park land. Mr. Jambois explained - that the area was a unique spot and could be a most desirable park acquisitio Neighbors from the adjoining area were questioning the park director, wonderi� how a parking lot for a park could be built without infringing on private property. Doris Wilker asked the developer where the private outlots were THE CENTER OF LAKE COUNTRY and would there he Community docking. .Jim hill pointed out the out lots and said that it would be private docking. She also asked if the developer paid for sewer and water and was told he does. Mrs. Wilker then stated that she would rather the ten lots were develop ^d than have a park go in the area. Richard Simonson stated that he enjoys the beauty of the area and feels there is no room for parking for a park, feels that this is a good solution to the problem. Wait Shumacker is opposed to the development. Does not feel we need any more residential lots. George Anderson stated that he would like to see a park go in with access to the park from the lake only. This would solve the problem of the parking area. Mrs. Anderson stated that she would like to see something along the lines of the Richfield Woodlake Nature Center go in there preserving the wildlife in the parcel. The meeting was then turned over to the Commission members. Commissioner Houts stated that he would like to table the hearing for 30 days to see what Lou Jambois can come up with. Feels that with a price range of 3 to 500,000. that the City would have to pay plus police the area and maintain it as a park that it would be too much of a burden on the taxpayers. The revenue would go to the City with 10 single family homes on the peninsula. Commissioner Hafermann would like to see the area stay C -1. He feels that after having seen the land, the park idea is out of hand. To open it to the public the way it is would be impossible to do. Commissioner Hafermann would like to have the development take it's course. Chairman Thorkelson would like to see this parcel stay as a park. The land has taken care of itself for years and it will continue to do so. Thorkelson stated that he just received a letter from the Metro Parks asking to preserve land of this nature. Feels that the anticipation of the watermain being looped in the area does not justify rezoning this peninsula. Mr. Hill then responded that the park study has been made for the last few months and can see no reason why a study on the funding for this parcel could not have been done weeks ago. Lou Jambois explained that the Park CIP was just finished May 16 and he has not had a chance to really check into this. After a iscussion motion was made by Hafermann to approve the rezoning but failed for lack of a second. Motion was made by Houts to table the hearing for 30 days for further park information seconded by Thorkelson and upon a vote taken motion duly passed. Thorkelson and Houts voted for the motion, Hafermann voted against. The hearing was tabled to July 7, 1977 at 8:15 P.M. Third item on the agenda was a .rezoning request for Brooksville Hills 3rd Addition. The area is now zoned R -3 and the request is for R -1. Graser gave an explanation of the area involved and a new drawing of the lots was presented. Motion was made by Houts to rezone the parcel to R -1, seconded by Hafermann and upon a vote taken motion duly passed. The public hearing for the Brooksville Hills 3rd subdivision was brought to order at 9:00. Mr. Ron Swanson presented the plat with the changes made to the subdivision. Motion was made by Hafermann to approve the preliminary replat of Block 1 Brooksville Hills 3rd Addition subject to the rezoning approval of the City Council seconded by Houts and upon a vote taken, motion duly passed. Motion to adjourn by Houts seconded by Hafermann and upon a vote taken, meeting was adjourned at 9:20. PLANNING ADVISORY BOARD May S, 1977 The meeting of the May 5, 1977 Planning Commission was brought to order by Chairman Thorkelson at 7:40 P.M. Members present were: Commissioners Houts, Hafermann, Klein, Cavill, Councilman Busse and City Planner Graser. The minutes of the April 21, 7.977 meeting were motioned for approval by Flouts seconded by Hafermann and upon a vote taken were approved as published. 0 Motion was made by Houts to change the Prior Lake Planning Advisory Committee meeting from May 19 to May 26, seconded by Klein and upon a vote taken, motion carried. Motion was made by Houts to change the Public Hearing forlsland View (Jim Hill) rezoning from May 19, 1977 at 7:45 to May 26, .1977. at 7:45 P.M. seconded by Klein and upon a vote taken, . motion duly passed. Motion was made by Houts to change the subdivision public hearing for Island View (Jim Hill) from May 19, 1977 at 8:15 P.M. to May 26, 1977 at 8:15 P.M. seconded by Kelin and upon a vote taken, motion duly passed. Motion was made by Hafermann to change the Brooksville 3rd addition public hearing for rezoning from May 19, 1977 to May 26, 1977 at 8:45 P.M. seconded by Klein and upon a vote taken, motion duly passed. Motion was made by Houts to change the Brooksville 3rd Addition subdivision; public hearing from May 19, 1977 at 9:00 to May 26, 1977 at 9;00 seconded by Klein and upon a vote taken, motion duly passed. First item on the agenda was a public hearing for Mr. Dan :Will, Mr; Will is proposing to rezone a 4,9 acre tract of land that is now zoned C-1, The subject parcel is immediately south of Albany Avenue and Mr, Will would like to rezone it to R -2. Graser gave a brief explanation of the area involved stating that the developer plans on dedicating 2,33 acres to the City for park dedication. Questions were raised about the problems with the creek flowing through the property. Mr. Will stated that he would be putting culverts in. Motion was made by Hafermann to approve the rezoning,:; from C -1 to R -2 because the adjacent areas are already zoned R -2 and there are no hazards involved. Only the westerly 300 feet will be zoned R-2 and the remaining parcel will be dedicated to the City (which will remain C -1). Motion was seconded by Houts and upon a vote taken., was duly passed, ': Motion was made by Houts to hold a public hearing on the subdivision of this property on June 2, 1977 at 7 -;45 seconded by Hafermann, upon a vote taken, motion duly passed. The public hearing was closed at 8 :15 P.M, THE CENTER OF LAKE COUNTRY Second item on the agenda was the public hearing for Mr. Charles James. Mr. James is proposing to rezone 17 acres located immediately south of County Road 42 and Highway 13 from R -1 (residential) to B -2 (community business). Mr. Charles .James gave an explanation of his proposed plans for the parcel involved. The plan would be built up as the demand increased. A PDQ store has an interest in the corner of 13 and 42. Mr. .James feels that with proper screening and buffering the area will not be detrimental to the neighborhood or property values. Mr. James would like to have the area rezoned to B -2 to have more of a retail sales outlet. The meeting was then opened to the public. Mr. Leo Sukow stated he was definitely against the rezoning. Mr. Ron Wiese does not feel we need commercial property in this area. Mr. Lee Chandler is concerned about traffic on Timothy Avenue. Mr. .James assured the audience that the renters of the buildings would have long term leases. Don Willisams said he would rather see B -1 zoning in order to scrutinize new businesses and have a better planning scope of the area. Mrs. Ochs stated that she does not want a driveway near her home. Mrs. Ochs also presented a petition to the Commission. Houts read the petition to the commission. Mr. .Tames stated that there was much confusion as to where the access and egress should be. He did . not agree with Prior Lake and Sa: -Lge P:anners in that the access and egress points should be minimum of 330 tcet fror.. the intersection and Mr. James was proposing an entrance at 420 f( `. Mr. James also stated that he is not happy going to a B -1 zoning. Deis would mean coming to many meetings for him before he could tell a prospective client whether or not he could go in the shopping center. It was brought to the attention of the commission that with a B -1 zoning, 37 establishments would fit in the area. With a B -2 zoning, 132 establishments would be allowed. Klein made a motion to deny the zoning request for B -2 zoning, seconded by Cavill, reasons being that Prior Lake does not have enough' L• control over usability of parcel included, some uses do not allow for I proper buffer and B -2 allows too much availability for uses. B -2 class- ification could jeopardize planning on 3 other corners and Ordinance 77 -1 was taken into consideration. Hafermann voted against the motion stating that he does not want to see commercial development in that area. Upon a vote taken, motion duly passed.
