SUBJECT Variance Replat of Bayview Addition Variance Public Hearing — Motion to CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE PLANNING COMMISSION MEETING October 16, 1975 The meeting of the Prior Lake Planning Commission was called to order at 7:35 P.M. by Chairman Bissonett. Members present were: Chairman Bissonett, Commissioners Tercero, Jobst, Burns, Thorkelson, Executive Director Watkins, Councilman Busse, Administrator McGuire and Administrative Assistant Graser. The following corrections were made to the Minutes of October 2, 1975: Page one, paragraph six should read — Next item on the agenda was an extension of a conditional use permit for Mrs. Jeanne Conrady. Page one, paragraph seven should read: Fourth item on the agenda was Mrs. Olson applying for an extension of a home occupation permit. Motion was made by Thorkelson to approve the minutes as amended, seconded by Burns and upon a vote taken, it was duly passed. The first item on the agenda was a variance request by Cy Schweich. The item was tabled until such a time Mr. Schweich can be present to explain his variance. The second item on the agenda was a replat of Bayci.ew Addition. Mr. Grassini gave a brief presentation to the Commission. He plans to replat lots 1 and 2 of Block 2, and after a short discussion a motion was made by Jobst to hold a public hearing on November 20 at 7:30, seconded by Burns and upon a vote taken, it was duly passed. The third item on the agenda was a variance request by Marvin Mirsch. Mr. Mirsch was requesting to build a garage two feet from his front property line. His 3- easoning was that he wanted to keep the adjacent lot for open space and at some future time remove the existing cabin and build a year —round home. Tom Watkins mentioned that it has been a policy not to grant variances closer than 10 feet from the front property line. A question arose as to whether a hardship exists in this case. After a lengthy discussion, a motion was made by Busse to allow Mr. Mirsch to build 10 feet from his front property line, seconded by Thorkelson and upon a vote taken, it was duly passed. A motion was made by Jobst to hold a public hearing for Gene Berry's rezoning request from R -1 to B-1, seconded by Tercero and )ipon a vote taken, it was duly passed. Jobst made a motion to adjourn the meeting seconded by Bissonett and upon a vote taken the meeting was adjourned at 10:37. Submitted by, Horst Graser THE CENTER OF LAKE COUNTRY CITY OF PRIOR LAKE, MINNESOTA 55372 PRIOR LAKE PANNING COMMISSION MEETING - OCTOBER 2, 1975 The meeting of the Prior Lake Planning Commission was called to order at 7:25 P.M. by Chairman Bissonett. Members present were: Chairman Bissonett Commissioners Tercero, Jobst, Burns, Houts, Thorkelson, Councilman Busse and Administrative Assistant Graser. Motion was made by Chairman Bissonett to change the wording of the September 18 minutes to read "well thought out" instead of "well thought of" in the last line of the fifth paragraph. First item on the agenda was a variance for Mr. John Noel. Graser made a brio£ presentation concerning the variance request. After some discussion, motion was made by Thorkelson to approve the variance, seconded by Burns and upon a vote taken, the motion carried. Second item on the agenda was a rezoning for Mr. Gene Berry. Mr. Berry gave a brief presentation stating that he would like to acquire a liquor license for his tavern and that he would like to be rezoned to B-2 to make him eligible for this liquor license. It was decided to have Graser contact Mr. Sullivan, review the subject and advise the commission what legal steps be taken. Graser will then contact Mr. Berry on this matter. Mr. Jobst brought up the fact that he thought all members of the Planning Commission be given time to state individual views on each subject. EfYv's;en Next item on the agenda was 4conditional use permit for Mrs. Jeanne Conrady. Mrs. Conrady operates a Whitewear shop in her home. Motion was made by Thorkelson to grant Mrs. Conrady a conditional use permit for another year, seconded by Tercero and upon a vote taken, was duly passed. — W!lnC19n ®CI Fourth item on the agenda was Mrs. Olson applying for anhome occupation permit. Motion was made by Jobst to continue the permit on the condition that only service related articles be sold. Motion was seconded by Burns, upon a vote taken, was duly passed. Last item on the agenda was Mr. Dempsy Mork presenting the plans for a PUD. Streets, open spaces, and densities were discussed. Some question was raised on the legality of the zoning ordinance that states all development must have sewer and water. Motion was made by Houts to have the planning staff recommend their ideas to Mr. Mork. Motion was seconded by Burns, upon a vote taken, it was duly passed. Mr. Cy Schweich presented a variance for building a basement. Motion was made by Busse to table the variance and turn the information over to the staff so that they can review it. Burns Abstaining. It was decided the commission will meet for 15 minutes before the October 9th Public Hearing to consider Mr. Schweichs variance request. THE CENTER OF LAKE COUNTRY Houts made a motion that there will be a public hearing held for McGuire PUD on November b, 1975. Motion was seconded by Tercero, upon a vote taken was duly passed. Motion was made by Burns to rescind the criticism given to the council on Willows Beach addition. Seconded by Houts, upon a vote taken, was duly passed. Tercero made a motion to adjourn, Houts seconded, upon a vote taken, the meeting was adjourned at 10:05.
