DISCUSSION: Introduction
The purpose of this agenda item is to consider the request by Central Bank to re-
move a commercial parcel from the scope of Ordinance 113-05 and the Study au-
thorized by Resolution 13-027.
His tOry
On March 11, 2013, the City Council adopted Ordinance No. 113-05 that prohibits
building permits, development and subdivisions along a designated area on the
County Highway 42 corridor during a 6-month period. The ordinance became ef-
fective on March 16 upon its publication. City staff initially proposed the inclusion
of property within a study area to include undeveloped and unplatted property
abutting CSAH 42 totaling approximately 600 acres. The City Council subse-
quently included additiona� property, increasing the size of the study area to ap-
proximately 1,150 acres. The City Council also adopted Resolution 113-05 which
commissioned a study to determine what amendments to the Comprehensive
Plan and City Code will be required to deal effectively with the development and
subdivision of property within the study area.
Current Circumstances
One of the areas added to the study area on March 11 includes three outlots with-
in Jeffers Pond First Addition at the southwest corner of the CSAH 21/42 intersec-
tion. Two outlots are designated for commercial development in the approved
PUD, while the third parcel is designated for high-density residential development.
The three outlots are property subject to the moratorium.
One of the commercial outlots in Jeffers Pond is owned by Central Bank (Outlot B,
Jeffers Pond First Addition). The parcel is 9.3 acres gross and 4.5 acres net (de-
velopable). This parcel has been marketed by Gonyea Land Company. A letter
from Lindquist & Vennum LLP on behalf of Central Bank dated March 18, 2013
requests that Outlot B be removed from the scope of Ordinance 113-05. The let-
ter states that Gonyea has received a letter of intent for retail/commercial devel-
opment. A moratorium will not allow a development project to receive develop-
ment approval during the moratorium period.
The commercial designation was approved for Outlot B in the Final Jeffers Pond
PUD and Final Plat in 2005. The Outlot is therefore zoned commercial. A final
plat is necessary for a development project to proceed to formal approval, but
public utilities are available to this site, including sewer, water, and storm ponding.
Local public street access was completed upon the construction of Jeffers Park-
way and Fountain Hills Drive, including a round-a-bout near CSAH 42. The ac-
cess point at CSAH 42 is also established with a 3 /4 intersection that will not
change. Other than the final plat process, this parcel is nearly pad-ready for one
or two commercial development projects.
Conclusion
Staff originally proposed that undeveloped and unplatted parcels of land abutting
CSAH 42 be included in the Interim Ordinance study area. Property located within
Jeffers Pond First Addition at the southwest corner of the CSAH 21/42 intersection
are part of an approved and platted Final PUD in 2005. Since the city desires to
expand its commercial tax base, the loss of a potential commercial development
does not appear to support that economic development objective.
ISSUES: In order to not open up requests to all affected properties in the study area, the
City Council should consider its response to the following questions:
1. Could this parcel potentially be recommended as a different land use other
than its PUD-approved commercial designation? If yes, what are those
other potential land uses along CSAH 42?
2. Would any improvements in or around this parcel warrant further land use
analysis?
3. If there is a need to reduce or move commercial land uses due to market
demand, is this a likely candidate site for change?
4. If this parcel is removed from the study area, should any other similar par-
cels be considered for removal (i.e., commercial outlots in Shepherds Path
PUD)?
5. What would the potential harm be in removing this parcel?
6. Should the outlot be removed from the moratorium, but be retained in the
planning study area (a potential benefit if a retail/commercial project does
not move forward in the near-term)?
It is quite possible the City will receive additional requests to remove property from
the study area. Another question the Council should consider is whether or not it
wishes to handle additional requests on a piecemeal basis.
The City Attorney has reviewed this request and prepared the attached ordinance
and resolution in the event the Council chooses to amend the interim ordinance.
FINANCIAL The City may lose an opportunity to secure a commercial development near the
IMPACT: intersection of CSAH 21/42, including additional jobs and tax base.
ALTERNATIVES: 1. Motion and second to adopt an ordinance amending Ordinance 113-05 by re-
moving Outlot B, Jeffers Pond First Addition, from the scope of Ordinance
113-05, including but not limited to Section 5 and Exhibit A thereof.
2. Motion and second to adopt Resolution 13- XXX removing Outlot B, Jeffers
Pond from the scope of Resolution 13-027.
3. Motion and second to direct staff to consider Outlot B, Jeffers Pond First Addi-
tion in the Study authorized by Resolution 13-027 even though Outlot B is no
longer subject to Ordinance 113.05 or Resolution 13-027.
4. Table action and provide the staff with direction.
RECOMMENDED Alternatives 1 and 2, with 3 as an option for the Council to consider.

113-05 BY REMOVING A PARCEL FROM THE SCOPE OF ORDINANCE NO. 113-05
The City Council of the City of Prior Lake, Minnesota, hereby ordains:
Section 1. Purpose. The City of Prior Lake ("City") has adopted Ordinance No. 113-05
("Interim Ordinance") related to property along County Highway 42, which
has been guided for a mix of residential, commercial and industrial uses. The City
further identified a Study Area as identified in Exhibit A.
In the Interim Ordinance, the City Council found that the City's current Comprehensive
Plan, zoning and subdivision regulations do not adequately address the development
and subdivision of property along County Highway 42 in the City of Prior Lake due to
changes within the City and on Highway 42 that were not anticipated by the City
including, but not limited to:
• Acquisition of Pike Lake Park by the City.
• Construction and opening of CR 21.
• Acquisition of land by the Shakopee Mdewakanton Sioux Community,
including the YMCA property (80 acres) and North Berens Drive
property (75 acres).
• Completion of a SCALE Commercial / Industrial Corridor Study including
CR 42 in Prior Lake.
• Preliminary platting and plat expiration of Summit Preserve.
• Development of the Shepherds Path property.
• Dramatic and perhaps permanent reduction in development activity in
the residential, commercial and industrial sectors locally, regionally, and
nationally.
In the Interim Ordinance, the City Council found that the City must conduct a study to
determine what amendments to the Comprehensive Plan and the City Code will be
required to deal effectively with such development and subdivision. This study will
include analysis and master planning for the County Highway 42 corridor, analysis
of commercial and industrial property within the Study Area, analysis of land use
and access control for the Highway 42 corridor, research of ordinances and land
use in other jurisdictions, review of relevant studies and a legal analysis of
applicable case law. Upon completion of the study, potential Comprehensive Plan
and ordinance amendments would be reviewed by the Planning Commission and
City Council. The City Council concluded that the public health, safety and welfare
and sound planning require that a moratorium be imposed on the approval of any
permits for development o"r subdivision of property within the Study Area during the
pendency of the study and the various public hearings preceding possible adoption
amendments to the Comprehensive Plan, and zoning and subdivision regulations.
Section 2. Authorization. Pursuant to Minn. Stat. § 462.355, subd. 4, the City was authorized to
adopt interim ordinances to regulate, restrict, or prohibit any use or development in all
or part of the City, for a period of one year (subject to exceptions as stated in Section
462.355), while the City is conducting studies, or has authorized a study to be
conducted, or has scheduled a hearing to consider adoption or amendment of official
controls, including ordinances, regulating physical development of the City.
Ordinance No. 113-05 established a moratorium period of six (6) months.
Section 3. Study. Pursuant to this Interim Ordinance and as approved by separate Resolution
No. 13-027, the City has determined to conduct a study to determine what
amendments to the Comprehensive Plan and City Code will be required to deal
effectively with the development and subdivision of property along County Highway 42
in the City of Prior Lake that is identified in Exhibit A due to the unanticipated changes
in the City. This study will include analysis and master planning for the Highway 42
corridor, analysis of commercial and industrial property within the City and along
County Highway 42, analysis of land use and access control for the Highway 42
corridor, research of ordinances and land use in other jurisdictions, review of
relevant studies and a legal analysis of applicable case law and will develop
recommendations as to appropriate Comprehensive Plan and ordinance
amendments, if any, that are required in the interest of the public safety and welfare.
Section 4. Reasons for the removal of Outlot B, Jeffers Pond First Addition. The Council
finds it appropriate to remove Outlot B, Jeffers Pond First Addition from the scope of
Ordinance No. 13-05 for the following reasons:
� Outlot B was approved for commercial development within the Final PUD for
Jeffers Pond per Ordinance No. 105-03, adopted by the City Council on
January 18, 2005 and as published on March 5, 2005.
• Outlot B was approved in the Preliminary Plat of Jeffers Pond per Resolution
No. 05-17 for commercial development.
• Outlot B was approved in the Final Plat of Jeffers Pond First Addition as
recorded in Scott County on June 7, 2005.
• Local streets and utilities have been constructed to serve Outlot B for
commercial development.
• The access to/from CSAH 42 to Outlot B is provided at a constructed 3 /4
intersection at Fountain Hills Drive and CSAH 42 as the permanent access
point on the north side of Jeffers Pond.
� Outlot B is currently being marketed for sale by a brokerage firm.
Section 5. Amendment of Ordinance No. 113-05. Ordinance No. 13-05 is amended by
removing Outlot B, Jeffers Pond First Addition from the scope of Ordinance No. 13-05
including Section 5 and Exhibit A attached thereto. Exhibit A of Ordinance No. 13-05
is hereby amended and replaced in its entirety by the attached Amended Exhibit A.
Section 6. Effective Date. This Ordinance shall become effective from and after its passage
and publication.

WHEREAS, the City of Prior Lake has adopted Resolution 13-027 on March 11, 2013 which
authorized a study to be conducted to determine what amendments to the
Comprehensive Plan and City Code would be required to deal effectively with the
development and subdivision of property along the Highway 42 corridor in the
City of Prior Lake as further described in said Resolution.
WHEREAS, Central Bank the Owner of Outlot B, Jeffers Pond First Addition has requested
that said property be removed from the scope of Ordinance 13-05.
WHEREAS, if the property is removed from the scope of Ordinance 13-005 it is necessary to
remove Outlot B, Jeffers Pond First Addition from the scope of the study
authorized by Resolution 13-027
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Outlot B, Jeffers Pond First Addition is hereby removed from the study authorized by
Resolution 13.027.

Re: Request for removal of Jeffers Pond parcel from interim ordinance
Dear Mr. Rogness:
I represent Central Bank in connection with the Jeffers Pond development in Prior Lake (the
"City"). We just recently learned of the action taken by the City on March 11, 2013 to pass an
interim ordinance temporarily prohibiting development of numerous properties abutting County
Road 42. It appears that the interim ordinance encompasses a parcel owned by Central Bank on
the southwest corner of the intersection of CR 42 and Jeffers Parkway NW, within the Jeffers
Pond development (the "Jeffers Pond Parcel") (see attached map).
With this letter, I am hereby requesting on behalf of Central Bank that the City take swift action
to remove the Jeffers Pond Parcel from the scope of its interim ordinance. This parcel is part the
comprehensive Jeffers Pond PUD that was approved by the City several years ago. To freeze
development of the parcel now is inconsistent with the City's approval of the PUD and would
i deprive Central Bank of its property rights.
� In addition, the City Council Agenda Report from the March 11, 2013 meeting makes clear that
there are no sound reasons for extending the interim ordinance to the Jeffers Pond Parcel. The
report discusses the City's desire to see increased commercial and industrial growth in the CR
42/CR 21 area and to ensure that the land is "ultimately developed." Central Bank has received a
letter of intent from a developer on behalf of a national retailer to purchase and build a
commercial/retail development on a portion of the Jeffers Pond Parcel. The Bank firmly
believes that this plan is consistent with the PUD, will benefit the residents of Prior Lake, and
will make the neighborhood more attractive and livable for years to come. Including the Jeffers
Pond Parcel in the interim ordinance, however, will almost certainly prevent the sale from
happening and the store from being builz

Further, unlike the properties that the interim ordinance purports to be targeting, the Jeffers Pond
Parcel is not "undeveloped and unplatted." Not only is the parcel platted as part of the PUD, but
all necessary infrastructure has already been approved and completed, including water, sewer,
curbs, roads, and access points. Stated differently, there is simply no justification for including
this site in another City-wide study; the Jeffers Pond Parcel is primed and ready for construction.
Finally, the fact that the interim ordinance was enacted suddenly and without any notice to
Central Bank or other interested parties is very disappointing. Central Bank owns the Jeffers
Pond Parcel along with a consortium of 21 Minnesota-based community banks. Since the banks
assumed ownership and development responsibilities for Jeffers Pond, they have worked
diligently to partner with Prior Lake and to contribute in a positive way to the community. The
Jeffers Pond development has already set aside a significant amount of land for public purposes,
to be used for an elementary school, a fire station, and a park. By attempting to impose the
interim ordinance on the Jeffers Pond Parcel, the City is inadvertently casting doubt on its
subdivision process and is deterring Central Bank and its partners from further contributing to
the orderly development of the Prior Lake community.
For these reasons, Central Bank respectfully requests that the City promptly act to remove the
Jeffers Pond Parcel from the scope of its interim ordinance. If you have any questions or
concerns about the request, please do not hesitate to contact me.

AN INTERIM ORDINANCE OF THE CITY OF PRIOR LAKE, MINNESOTA,
TEMPORARILY PROHIBITING ALL DEVE�OPMENTAND SUBDIVISION OF
PROPERTY NEAR COUNTY HIGHWAY 42 WITHIN THE CITY OF PRIOR LAKE THAT
IS IDENTIFIED IN EXHIBIT A; ADOPTING ENFORCEMENT PROVI510NS; AND
ADOPTING BY REFERENCE CITY CODE PART 1 WHICH, AMONG OTHER THINGS,
CONTAINS PENALTY PROVISIONS.
The City Council of the City of Prior Lake, Minnesota, hereby ordains:
Section 1. Purpose. The City of Prior Lake ("City") has adopted a Comprehensive Plan which
guides long term property uses throughout the City. The property near County
Highway 42 has been guided for a mix of residential, commercial and industrial
uses. The City of Prior Lake also regulates zoning and subdivision of property within
the City in order ta
1) Protect the residential, business, industrial and public areas of the
community and maintain their stability.
2) Promote the most appropriate and orderly development of the residential,
business, industrial, public land and public areas.
3) Provide adequate light, air and convenient access to property.
4) Limit congestion in the public rights - of - way.
5) Prevent overcrowding of land and undue concentration of structures and
population by regulating the use of land and buildings and the bulk of
buildings in relation to the land surrounding them.
6) Provide for compatibility of different land uses by segregating, controlling
and regulating unavoidable nuisance producing uses.
7) Require that development proceed according to the goals and policies
established in the City's Comprehensive Plan.
8) Maintain a tax base necessary to promote the economic welfare of the City
by insuring optimum values for p�operty in the City.
9) Enhance th� aesthetic character and appearance of the City.
10) Conserve natural resources and environmental assets of the community.
11) Provide adequate off-street parking and loading facilities.
12) Provide effective administration of this Ordinance and any future
amendments to this Ordinance and prescribe penalties for the violation of its
requirements.
13) Establish a continuing system of review of this Ortlinance to insure it will
be amended to meet changing needs of the community and advances in
science and #echnology.
The City Council finds that the City's current Comprehensive -Plan, zoning and
subdivision regulations do not adequately address ths development and subdivision of
property near County Highway 42 in the City of Prior Lake that is identified in Exhibit A
due to changes within the City and on County Highway 42 that were not anticipated
by the City including:
• City acquisition of Pike Lake Park.
• Construction and opening of CR 21.
• Availability of additional land along CR 21 corridor for commercial
purposes.
• Acquisition of the YMCA property (80 acres) and North Berens Drive
property (75 acres) by the Shakopee Mdewakanton Sioux Community.
• Completion of SCALE Commercial / Industrial Corridor Study including
CR 42 in Prior Lake.
• Preliminary plattmg and plat expiration of Summit Preserve.
• Development proposal of the Shepherd property.
• Dramatic and perhaps permanent reduction in economic development
activity in the residential, commercial and industrial seetors locally, in the
metropolitan area and in the region.
The City Council finds that the City must conduct a study to determine what
amendments to the Comprehensive Plan and the City Code will be required to deal
effectively with such development and subdivision. This s#udy will include analysis
and master planning for the County Highway 42 corridor, analysis of commercial
and industrial property within the City and near County Highway 42, analysis of land
use and access control for the County Highway 42 corridor, research of ordinances
and land use in other jurisdictions, review of relevant studies and a lega( analysis of
applicable case law. Upon completion of the study, potential Comprehensive Plan
and ordinance amendments would be reviewed by the Planning Commission and
City Council. The City Council has cancluded that the public health, safety and
welfare and sound planning require that a moratorium be imposed on the approval
of any permits for development or subdivision of property near Counfy Highway 42
within the City of Prior Lake that is identified in Exhibit A during the pendency of the
study and the various public hearings preceding possible adoption amendments to
the Comprehensive Plan, and zoning and subdivision regulations.
Section 2. Authorization. Pursuant to Minn. Stat. § 462.355, subd. 4, the City is authorized #o
adopt interim ordinances to regulate, restrict, or prohibit any use or development in all
or part of the City, for a period of one year (subject to exceptions as stated in Section
462.355), while `#he City is conducting studies, or has authorized a study to be
conducted, or has scheduled a hearing to consider adoption or amendment of official
controls, including ordinances, regulating physical development of the City.
Section 3.' Study. Pursuant to this Interim Ordinance and as authorized by separate Resolution,
the City determines to conduct a study to determine what amendments to the
Comprehensive Plan and City Code will be required to deal effectively with the
development and subdivision of property near County Highway 42 in the City of Prior
Lake that is identified in Exhibit A due #o the unanticipated changes in the City. This
study will include analysis and master planning for the County Highway 42 corridor,
analysis of commercial and industrial property 'within the City and near County
Highway 42, analysis of land use and access control fior the Highway 42 corridor,
research of ordinances and land use in other jurisdictions, review of relevant
studies and a legal ana�ysis of applicable case law and will develop
recommendations as to appropnate Comprehensive Plan and ordinance
amendments, if any, that are required in the interest of the public safety and welfare.

Section 4. Study Area. This Interim Ordinance shall appty to all property near County Highway
42 within fhe City of Prior Lake as of the Effective Date of this Interim Ordinance as
identified on Exhibit A, attached hereto and incorporated herein.
Section 5. Interim Ordinance. Pending the'completion of the above-referenced Study, and the
adoption of appropriate ofFicial controls, for a period of six months (subject to
exceptions as stated in Section 462.355) after the Effective Date of this Otdinance,
there shall be no development or subdivision of property near County Highway 42 in
the City of Prior Lake #hat is identified in Exhibit A as of fhe Effective Date of this
Ordinance. The City shall issue no building permits, or zoning or subdivision
approvals, for any such properly, for said time period as above noted, unless such
was granted or approved prior to the Effective Date of this Ordinance.
Section 6. Exceptions. This moratorium shall not apply to any permits or,approvals that were
approved or granted by City s#aff or the City Council prior to the Effective Date Df this
Ordinance. Further, this moratorium shall not apply #o improvements necessary to
correct violations of state law or city ordinances
Section 7. Enforcement 7he City may enforce this Ordinance by mandamus, injunction or any
other appropriate civil remedy.
Section 8. Violation. City Code Section 103 entitled "Definitions" and Section 104 entitled
"General Penalty" are hereby adopted in their entirety, by reference, as though
repeated verbatim herein.
Section 9. Effective Date. This Ordinance shall become effective from and after its passage
and publication.
