DISCUSSION: I ntroduction This agenda item considers approval of a wetland replacement plan application for the County State Aid Highway (CSAH) 12 improvement project. Hi StOry The City Council is the local government unit under the Wetland Conservation Act (WCA). On January 18, 1994, the City Council passed Resolution 94-01 adopting the permanent rules of the Wetland Conservation Act of 1991. Along with this, the Council also assumed the role of local government unit (LGU) for making WCA determinations for landowners. The purpose of WCA is as follows: 1. Achieve a no net loss in the quantity, quality, and biological diversity of Minnesota's existing wetlands; 2. Increase the quantity, quality, and biological diversity of Minnesota's wetlands by restoring or enhancing diminished or drained wetlands; 3. Avoid direct or indirect impacts from activities that destroy or diminish the quantity, quality, and biological diversity of wetlands; and 4. Replace wetland values where avoidance of activity is not feasible or prudent. On January 11, 2013 The City of Prior Lake received a WCA application for a replacement plan from Scott County (attached). As the responsible local government unit, the City Council must approve any proposed wetland replacement plan. Current Circumstances Scott County is proposing to construct the final phase of the four phase CSAH 12 improvement project in 2012. The construction of the project will result in 0.42 acre of permanent wetland impact. According to the WCA, permanent wetland impact for this project must be addressed by replacing wetlands at a 2:1 ratio. Therefore, a total of 0.84 acre of wetland replacement is required for the project. The wetland impact areas are shown in the attached maps. Most of the required wetland replacement is proposed through the Board of Water and Soil Resources (BWSR) Road Replacement Program for the impacts related to road construction. For the proposed 0.37 acre of impact, a total of 0.74 acre will be replaced by BWSR. The remaining impacts (0.05 acre, or about 2,200 square feet) are related to trails and sidewalk construction and must be replaced using Project-Specific Mitigation. Scott County will replace a total of 0.10 acre of wetland through the purchase of wetland bank credits from the Breggemann Wetland Bank in Scott County. Conclusion The project meets the requirements for a replacement plan application and proposes to replace for 0.10 acre of wetland impacts in accordance with the Wetland Conservation Act. The Application should be approved contingent on wetland credits being debited from the State Wetland Bank and the City receiving the required assurance from the State Wetland Bank prior to wetland impact. ISSUES: There are no specific issues related to the wetland replacement plan. The City Council will be considering an amendment to the Cooperative Agreement with Scott County for the construction of the final phase of the County State Aid Highway 12 Improvement Project later in this agenda. FINANCIAL There are no financial impacts to the City as a result of the approval of the IMPACT: wetland replacement plan. ALTERNATIVES: The alternatives are as follows: 1. Approve a resolution approving the wetland replacement plan for the CSAH 12 Improvement Project. 2. Deny this item for a specific reason and provide staff with direction. RECOMMENDED Alternative 1.
