PETERSON March 22, 2013 Dan Rogness Community & Economic Development Director 4646 Dakota Street Southeast Prior Lake, MN 55372 Re: Interim Ordinance 113-OS i j Dear Mr. Rogness: We are counsel for Shepherd of the Lake Evangelical Lutheran Church ("Church"}, owner of property affected by City of Prior Lake ("City") Ordinance 113-OS ("Interim Ordinance). The Interim Ordinance imposes a moratorium on development or subdivision of , property near CSAH 42, including part of the 80 acres depicted on the attached E�iibit A where the Church is located (the "Campus"). The Church seeks a confirmation that the Campus is I excepted by Section 6 from the Interim Ordinance, so that development may continue, consistent with the Planned Unit Development ("PUD") approved for the Campus by the City in 2006. Short History of Campus The purpose of the Campus is to provide for the residential, physical, medical and spiritual needs of the citizens of Prior Lake. The Campus and its impact on public facilities was approved in 2006, based on the attached phased development plan and a Contract for Development with the City ("Development ContracY'). Streets, utilities, drainage facilities, and park dedications are in place and are coinplete. The Campus connects to CSAH 42 by a right in/right out intersection at Shepherd's Path on the east side, and on the west side by a full intersection with a stoplight at McKenna Road, in compliance with applicable highway access guidelines. There are currently four significant facilities that operate on the Campus in which over $55 million has been invested for planning, development and construction all in reliance upon the PUD. Efforts to complete the Campus are ongoing. March 22, 2013 Page 2 Reasons Why the Moratoriuin Should Not Ap�plv to the Campus l. The Campus continues to directly advance all 13 objectives of the Comprehensive Plan stated in Section 1 of the Interim Ordinance. 2. By virtue of the PUD, the subdivision of the Campus was approved and has already occurred, even though the initial use and user of all of the parcels in the Campus have not yet been determined. 3. The stated purpose of the moratorium in Section 3 of the Interim Ordinance is to study the impact of certain "unanticipated changes in the City." The continued development of the Campus pursuant to the approved PUD certainly cannot be deeined to be an unanticipated change, especially since the completion of the Campus is contemplated by the Development Contract and will be subject to review by the City. 4. Section 6 of the Interim Ordinance exempts prior "approvals," which should be deemed to include previously approved planned unit developments. See also Minn. Stat. 462.355, Subd. 4(c). 5. The moratorium is inconsistent with the obligations of the City and rights of the Church, and its Campus partners, under tlie Development Contract for the Campus.
