CONSIDER APPROVAL OF A RESOLUTION ACCEPTING
FEASIBILITY REPORT AND SCHEDULING A PUBLIC HEARING FOR
THE MAIN AVENUE AND DAKOTA STREET IMPROVEMENT
PROJECT (CITY PROJECT #04-01)
HISTORY
Each year the City reconstructs street segments that are worn out. At the
September 15, 2003 City Council meeting, Council adopted Resolution No. 03-
159 authorizing staff to prepare a Feasibility Report for the Main Avenue and
Dakota Street Improvement Project as approved by the Council in the 2004-2008
Capital Improvement Program (CIP) since this street segment has not been
reconstructed since 1966 and is showing its age. Moreover, the reconstruction of
the downtown streetscape will continue to support our downtown redevelopment
efforts and the goals of the 2020 Vision and Strategic Plan.
The project area considered in the report includes Main Avenue from County
Highway (CH) 21 to Kop Parkway and Dakota Street from Trunk Highway (TH)
13 to Erie Avenue. A map of the project area is included as Exhibit 1 of the
Feasibility Report. The proposed project includes street reconstruction, storm
sewer, concrete curb and gutter, sidewalk, streetlights, buried power, streetscape
amenities and appurtenant work. Watermain replacement is proposed for Main
Avenue and Dakota Street. Sanitary sewer pipe lining is proposed for Dakota
Street under a separate contract.
CURRENT CIRCUMSTANCES
The attached report indicates the estimated costs for the project, along with
preliminary assessment estimates. At the end of the Feasibility Report, a project
financing summary is included to show project cost splits. The total estimated
cost of the project is $2,582,000.
Main Avenue and Dakota Street have failing bituminous surfaces and concrete
curb and sidewalk in need of repair. The existing streets vary from 56 feet to 28
feet in width. Main Avenue was formerly TH 13 and was last paved in the mid-
1960's when it was turned over to the City. Dakota Street was last paved in 1989.
The proposed street widths will be approximately the same as the existing street
widths with the addition of decorative bump-outs at the intersections. The streets
will remain on a similar alignment and be constructed with B618 curb and gutter.

The water main system on Main Avenue and Dakota Street was installed in 1937.
It cqnsists of 6-inch steel pipe. The 6-inch pipe is proposed to be replaced with
12-inch ductile iron pipe. Businesses along Main Avenue and Dakota Street will
have the option to replace their water services into the building with this project.
The sanitary sewer system that serves the buildings along Main Avenue and
Dakota Street from Main to TH 13 is 8-inch vitrified clay pipe located in the
alleys behind the buildings. There is no work proposed on the alley sewer lines
with this project. There is 8-inch vitrified clay pipe located in Dakota Street west
of Main Avenue which was installed in 1937. The sewer line has been televised
and is in satisfactory condition. This segment of sewer will be slip-lined under a
separate contract after the base course is placed.
There is currently no existing storm sewer on Main Avenue or Dakota Street.
Storm sewer improvements will include the addition of pipe and catch basins.
Storm water will be directed to the Erie Avenue rainwater garden, the existing
storm water pond in Lakefront Park and an existing storm system located in CH
21.
An informational meeting is scheduled for February 18th, 2004. The proposed
improvements, project schedule and assessments will be presented.
The'attached Feasibility Report outlines which portions of the cost for the above
project will be assessed to the benefiting properties.
If the Council approves the Feasibility Report, the Chapter 429 special assessment
statute requires a public hearing be conducted prior to proceeding with the project
to determine if it is to move forward.
ISSUES: The Special Assessment Committee met on January 23rd at which time the
following issues were discussed and recommendations made:
Street and Storm Sewer Reconstruction
. Pursuant to the assessment policy, the street and storm sewer reconstruction
should be assessed at up to 40% of the project costs against the benefiting
properties, depending upon the special benefit created for each such property.
The remaining amounts should be recovered through the general ad valorem
property tax and TIF bond proceeds.
Streets cape Amenities
. The special assessment committee discussed two scenarios: 1) assessing 100% of
the cost the streetlights and 2) assessing 40% of the cost of the streetlights. The
com,mitlee's recommendation is to assess at the 40% rate as there are some
existing streetlights in the downtown area. In addition, 40% of the landscaping
costs that are not eligible for MSA funding are proposed to be assessed.
Water Main Replacement
. Water main replacement should be funded through the Enterprise Fund.

Assessment Method
· The Special Assessment Committee recommends the front foot method of
assessment due to the fact that lots in the project area are of varying size and
value. The estimated assessment rate is $125/front foot.
Water Sef11ices
· In the event water services are replaced from the curb box into the buildings,
property owners will be assessed for the actual cost of the work. This cost will
vary from property to property depending on the service location and condition.
For the purposes of the feasibility report, service replacement has been estimated
at $2,700.
CONCLUSION
In summary, the project is feasible from an engineering and economic standpoint.
Approval of the Feasibility Report does not grant final approval ofthe project.
FINANCIAL
IMPACT:
The 2004 improvement project is proposed to be financed by MSA, special
assessments, Enterprise Fund, tax levy, and TIF bond proceeds. Funding sources
and amounts are as shown below:
Assessments (429 Bonds) $486,000
Tax Levy (429 Bonds) $679,000
TIF Bond $270,000
Municipal State Aid $900,000
Water Enterprise Fund $247,000
Project Total Cost $2,582,000
The Council should note that less than 19% of the total project cost is proposed to
be paid through special assessment. The TIF funding received from Lakefront
Plaza together with a tax levy (as is done with other reconstruction projects) will
assist the Municipal State Aid and Water Enterprise Fund to pay for this project.
The property tax levy would increase by approximately 1.2% as a result of the
special levy for the issuance of$1,165,000 G.O. Bonds.
AL TERNA TIVES:
The alternatives are as follows:
1. Approve Resolution 04-XX accepting the Feasibility Report and establish a
Public Hearing date as per the attached Resolution.
2. Table the resolution for a specific reason.
3. Deny the Resolution.
RECOMMENDED
MOTION:
A motion and a second to adopt a Resolution accepting the Feasibility Report and
calling for a Public earing for the Main Avenue and Dakota Street Improvement
project (City Projec 04-01).

CALLING FOR A PUBLIC HEARING ON MAIN AVENUE AND DAKOTA STREET
IMPROVEMENT PROJECT (CITY PROJECT #04-01)

WHEREAS, pursuant to Resolution 03-159, the City Council, on September 15, 2003, ordered
a feasibility report to be prepared by the City's Engineering Department with
reference to the improvement of Main Avenue and Dakota Street; and
WHEREAS, the report provides information regarding whether the proposed project is
necessary, cost-effective, and feasible.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the Feasibility Report as submitted.
3. The Council will consider the improvement of such streets and areas in accordance
with the report and the assessment of property as described in the report for all or a
portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429
at an estimated total cost of the improvements of $2,582,000.
5. A Public Hearing shall be held on such proposed improvements on the 151 day of
March, 2004 at the Fire Station No.1, with the address of 16776 Fish Point Road,
City of Prior Lake, Minnesota at 7:00 p.m. Statutory notice and publication
requirements shall be followed.

Notice is hereby given that the City Council of the City of Prior Lake, Minnesota will meet in the
Council Chambers in Fire Station No.1, 16776 Fish Point Road, on Monday, the 1 sl day of
March, 2004 at 7:00 P.M. to consider the improvements for the following streets:
PROJECT DESCRIPTION
Reconstruction of Main Avenue from County Highway 21 to Kop Parkway and reconstruction of
Dakota Street from Trunk Highway 13 to Erie Avenue, including grading, storm sewer, aggregate
base, concrete curb and gutter, bituminous surfacing, sidewalks, watermain improvements,
streetlights, landscaping and appurtenant work.
The area proposed to be assessed is every lot, piece, and parcel benefiting from said
improvement, whether abutting or not, within the following described areas:
Portions of the northeast quarter Section 2, Township 114 north, Range 22 west, Scott
County, Minnesota.

are as follows:

The Council proposes to proceed under the authority granted by Minnesota Statutes Chapter 429.
The total estimated cost of improvements is $2,582,000. A reasonable estimate of the impact of
the assessment will be available at the hearing.

this meeting. Written or oral comments will be considered.
