WITTKOPF, CIVIL ENGINEER SUE MCDERMOTT, CITY ENGINEER CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE JOINT STORM WATER EDUCATIONAL PLAN AS PART OF THE CITY'S STORM WATER POLLUTION PREVENTION PROGRAM AND ACCEPTING THE 2004 ANNUAL REPORT FOR THE CITY'S NPDES PHASE II MS4 PERMIT History: In 1972 the Clean Water Act was amended by Congress to require National Pollutant Discharge Elimination System (NPDES) permits for any pollutants discharged to waters of the United States. The U.S. Environmental Protection Agency authorized the Minnesota Pollution Control Agency (MPCA) in 1974 to administer the program statewide. The Clean Water Act was amended in 1987 to include a national program for storm water discharges to be implemented in two phases under the NPDES program. Under Phase II, regulated small Municipal Separate Storm Sewer Systems (MS4s) were required to obtain permit coverage by March 10, 2003. The goal of the NPDES permit is to restore and maintain the chemical, physical and biological integrity of waters of the state through management and treatment of urban storm water runoff. Current Circumstances: Any entity regulated under Phase II has several requirements to fulfill as a part of obtainiqg the permit. These include developing a Storm Water Pollution Prevention Program (SWPPP), implementing Best Management Practices (BMPs) for the required minimum control measures, enforcing measurable goals and timelines for these BMPs, and submitting annual reports for the five-year duration of the permit. The six minimum control measures (MCMs) are: (1) public education and outreach on storm water impacts, (2) public participation and involvement, (3) illicit discharge detection and elimination, (4) construction site storm water runoff control, (5) post-construction storm water management for new/re-development, and (6) pollution prevention and good housekeeping for municipal operations. As part of the first MCM, the City partnered with Scott County, the Sioux Community, the Prior Lake-Spring Lake Watershed District and nearby cities and townships to develop a Joint Educational Plan for storm water issues. The plan is designed to help the City and other participants reach a diverse audience by pooling resources into numerous targeted activities. It is the City's intent to incorporate this Educational Plan into the existing SWPPP and to implement the plan during the remainder of the permit cycle (through March 2008). The Educational Plan should be signed by the City Manager to incorporate it into the City's SWPPP. Also as a part of the City's NPDES permit, the City must submit an annual report to the MPcA. Since the approval of the SWPPP last March, the City has been following the requirements of the plan and must now evaluate its success. Based on a review of staff documentation, it can be observed that the City implemented all of the BMPs outlined within the SWPPP in the past year. In addition, the City assessed its activities that have been undertaken in the past year, and is not proposing any changes to the identified BMPs or measurable goals, aside from the incorporation of the Joint Educational Plan. This Annual Report has found that the City is in full compliance with the conditions of its permit for 2003. Conditions of the permit also require that the City hold a public meeting and comment period with regard to its SWPPP and draft Annual Report (the second McM). A joint public meeting with all of the Educational Plan participants was held on Thursday, January 15, 2004, to fulfill this requirement. Written comments were also accepted at City Hall, through February 1, 2004. The City received no public comments regarding these documents. Conclusion: The Jo,int Storm Water Educational Plan has been completed to City staff's satisfaction and should be incorporated into the City's SWPPP. The Annual Report summarizes the City's success during its first year of the permit cycle and is ready for submittal to the MPCA. The Annual Report submission deadline is March 10, 2004. Copies of the Annual Report and Joint Storm Water Educational Plan are available for review in the Engineering Department ALTERNATIVES: (1) Approve a Resolution authorizing the City Manager to execute the Joint Storm Water Educational Plan as part of the City's Storm Water Pollution Prevention Program; and accepting the 2004 Annual Report for the City's NPDES Phase II MS4 permit and directing its submission to the MPCA. Prior Lake, MN 55372-1714 MOTION BY: SECOND BY: WHEREAS, the United States Congress amended the Clean Water Act to include a storm water discharge program, including the issuance of general permits for Municipal Separate Storm Sewer Systems (MS4's), and WHEREAS, the City of Prior Lake is a regulated small MS4 that developed a Storm Water Pollution Prevention Program (SWPPP) and obtained this permit on March 10, 2003,and WHEREAS, the City of Prior Lake worked cooperatively to prepare a Joint Storm Water Educational Plan as part of the SWPPP Public Education and Outreach minimum control measure, and WHEREAS, the City of Prior Lake prepared a 2004 Annual Report for compliance with the NPDES Phase II permit regulations, and WHEREAS, the City of Prior Lake held a Public Meeting and comment period regarding its SWPPP' and Annual Report as required by the permit, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that 1. The recitals set forth above are incorporated herein. 2. The City Council hereby accepts t he Joint Storm Water Educational Plan and 2004 Annual Storm Water Pollution Prevention Program Report. 3. The City Manager is authorized to execute the Joint Storm Water Educational Plan. 4. City Staff is directed to submit the documents to the MPCA. Passed and adopted this 2nd day of February 2004.
