HomeMy WebLinkAbout5F Extend The Point Liquor License O � PRIp ti � v � 4646 Dakota Street SE Prior Lake, MN 55372 `�INtvESO� CITY COUNCIL AGENDA REPORT MEETING DATE: MAY 13, 2013 AGENDA #: 5F PREPARED BY: JANET RINGBERG, ACCOUNTING SPECIALIST PRESENTED BY: FRANKL BOYLES, CITY MANANGER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING AN EXTENSION OF AN ON SALE LIQUOR LICENSE FOR THE POINTE DISCUSSION: Introduction The purpose of this agenda item is to approve a resolution approving a permanent extension of an on-sale intoxicating liquor license premise for The Pointe. H isto On November 13, 2012 the City Council approved an on-sale intoxicating liquor license and a Sunday liquor license for The Pointe, 16691 Highway 13. The ap- proved license was valid from December 1, 2012 to June 30, 2013. Liquor licens- es are issued for a specific premise and any changes to the licensed premise must be approved by the City Council. It was noted in the November 13 2012 agenda report that The Pointe was planning to add an outdoor patio area in the spring of 2013. Current Circumstances The Pointe is currently in the planning process to add an outdoor patio area on the north side of their building. The patio would be a rectangle of 24 by 52 feet or 1250 sq.ft. (see attached diagram) The patio area would be fenced off using a six foot ornamental steel picket style fence and the only access to it would be through the existing building. There will be an emergency exit gate in the fencing pursuant to code. The outdoor patio will be lighted and will contain a 48 inch gas fireplace. Conclusion Because this new patio area was not part of the original liquor license application, and they plan to serve alcohol in this new space, the Council must approve an ex- tension of the liquor license to include this new space. ISSUES: The construction of the patio is not complete at this time so the liquor license ex- tension would not be valid until the construction is complete and the Building De- partment has performed and passed all required inspections. The outdoor service area is closest to Park Nicollet Clinic and Velishek Auto Sales. While the Pointe is in the C-2 zoning district, they are not within 100 feet of a residential zoning district so no conditional use permit is required nor are there limits on the hours of operation. The Pointe is authorized to serve liquor until 2 am. It is the staff's expectation that service hours of the outdoor area would be the same as the interior. We have talked about noise issues and agreed to work to- gether to resolve them if and when they arise. FINANCIAL There are no additional license fees required for a liquor license extension, but the IMPACT: City will be collecting additional fees for the required building permit. ALTERNATIVES: 1. Approve a resolution authorizing a permanent extension of the on-sale in- toxicating liquor license for The Pointe. 2. Deny the license request. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein, 2. The permanent extension of the on-sale intoxicating and Sunday liquor license for The Pointe is conditioned upon the passing of all requiretl building inspections.
