AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING THE TRANSFER OF
CITY-DESIGNATED REGIONAL TRANSIT CAPITAL (RTC) FUNDS TO SCOTT
COUNTY FOR IMPROVEMENTS TO SOUTHBRIDGE CROSSING TRANSIT
STATION AND MARSCHALL ROAD TRANSIT STATION
DISCUSSION: Introduction
The purpose of this agenda item is to approve the use of the City's Regional
Transit Capital (RTC) funds for improvements to Southbridge Crossing Transit
Station and Marschall Road Transit Station, and to allow the Metropolitan Council
to distribute those funds directly to Scott County.
History
In 2006, the Prior Lake City Council adopted the Unified Transit Management Plan
(UTMP). This plan included several recommendations, including working with
Scott County and the City of Shakopee to provide express bus service to Down-
town Minneapolis. In 2007, the BlueXpress bus service began operating out of
the newly constructed Southbridge Crossing Transit Station. Planning and con-
struction of Eagle Creek Transit Station, located at the intersection of County
Road 21 and County Road 16, followed shortly thereafter. The Eagle Creek
Transit Station opened in July, 2012.
On January 28, 2013, the City Council approved a Joint Powers Agreement with
the City of Shakopee and Scott County for the operation and maintenance of the
transit stations. The JPA lays out the cost sharing responsibilities for the ongoing
maintenance and operation of both Southbridge Crossing Transit Station and Ea-
gle Creek Transit Station. These costs include utilities, insurance, and basic site
maintenance such as snow plowing and landscaping. Scott County manages the
site and bills the cities quarterly for the costs. The Southbridge Crossing Transit
Station has been in use for nearly 6 years, and is due for seal coating and restrip-
ing improvements.
In 2010, Scott County was able to take advantage of an opportunity to purchase
the now vacant Shakopee Dodge site for use as a future transit station. In June,
2012, the City Council approved a Construction Cooperative Agreement with Scott
County for the improvements to the Marschall Road Transit Station. This is a 3-
way agreement between Scott County, the City of Shakopee and the City of Prior
Lake, covering the design and construction of the facility. The BlueXpress im-
provements to the building include interior work to provide a waiting area and re-
strooms for transit riders, parking lot configuration for the park and ride and bus
lanes, a bus only ramp to Highway 169, and an optional exterior canopy. The
costs included in the agreement cover those costs associated with the BlueXpress
use of the facility. Construction of these improvements is now underway, and the
facility is expected to open in late 2013.
Current Circumstances
Scott County, on behalf of the cities of Prior Lake and Shakopee, has applied to
the Metropolitan Council for Regional Transit Capital (RTC) funds for improve-
ments to the Southbridge Crossing Transit Station and the Marschall Road Transit
Station. RTC funds are bonding funds used for transit capital, such as buses, or
for improvements to transit facilities, such as transit stations. The RTC funds are
approved by the State Legislature and administered by the Metropolitan Council.
The Metropolitan Council has included both the Southbridge Crossing Transit Sta-
tion improvements and the Marschall Road Transit Station construction in the re-
gional transit Capital Improvements Program.
The Metropolitan Council has approved a total of $883,000 for the Southbridge
Crossing and Marschall Road improvements. Normally, these funds would be dis-
tributed directly to the City, and we would then reimburse the County. However, to
simplify administration of the funds for these projects, staff is proposing the funds
be distributed directly from the Metropolitan Council to Scott County. In order to
do this, the City Council must authorize the transfer of the funds to the County.
Conclusion
Scott County is managing the construction contracts for these transit improve-
ments. Generally, the County pays the contractors and then bills the City. We
would then have to invoice the Met Council and reimburse the County. Adoption
of this resolution simplifies the administration of the funds.
ISSUES: The use of RTC funds will reduce the City's out-of-pocket costs for these im-
provements. The adoption of this resolution simplifies the administration of these
funds. Scott County will continue to provide an inventory of accumulated costs
associated with the project.
FINANCIAL There is no impact on the City's general fund as a result of this action. As noted
IMPACT: above, the use of the RTC funds will reduce costs to the City. Any costs above
the RTC funds will be taken from the City's Transit Fund. The City's 2013 Transit
budget includes $217,000 for Marschall Road Transit Station improvements and
Southbridge Crossing Transit Station repairs. We do not expect costs to exceed
this amount, even in the worst case scenario.
ALTERNATIVES: There are two alternatives for the City Council to consider:
1. Adopt the resolution approving the transfer of the City Designated Regional
Transit (RTC) funds to Scott County for improvements to Southbridge Cross-
ing Transit Station and to Marschall Road Transit Station
2. Deny this item for a specific reason and provide staff with direction.
RECOMMENDED Alternative #1.

A RESOLUTION APPROVING THE TRANSFER OF CITY-DESIGNATED REGIONAL TRANSIT
CAPITAL (RTC) FUNDS TO SCOTT COUNTY FOR IMPROVEMENTS TO SOUTHBRIDGE CROSSING
TRANSIT STATION AND MARSCHALL ROAD TRANSIT STATION

WHEREAS, The City of Prior Lake, City of Shakopee, and Scott County have existing agreements related
to joint operations and maintenance of express bus transit service; and
WHEREAS, The City of Prior Lake and City of Shakopee were awarded $225,000 in Legislatively
Designated Regional Transit Capital (RTC) bonds and $608,000 in RTC (in lieu of NTD
Earnings) for construction of the Marschall Road Transit Station and maintenance at the
Southbridge Crossings Park-and-Ride; and
WHEREAS, The City of Prior Lake and City of Shakopee have agreed to allocate the cost participation on
capital improvements for the two aforementioned park and ride facilities to 60 percent-
Shakopee and 40 percent-Prior Lake of the contracted services and construction costs;
WHEREAS, Scott County has provided contract administration and project delivery services, on behalf of
the City of Prior Lake and City of Shakopee, for infrastructure-related improvements for the
Marschall Road Transit Station and Southbridge Crossings Park-and-Ritle; and
WHEREAS, The City of Prior Lake and the City of Shakopee agree it is more efficient and in the public
interest to allow Scott County to lead the improvement project and to be the sole point of
contact with the Metropolitan Council for funding of these specific projects.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City of Prior Lake agrees to transfer $25,000 in Legislatively Designated Regional Transit Capital
(RTC) bonds and $220,000 in RTC (in lieu of NTD Earnings) to Scott County for the design and
construction of the Marschall Road Transit Station.
3. The City of Prior Lake agrees to transfer $23,200 in RTC (in lieu of NTD Earnings) for the parking lot
sealcoat and striping at the Southbridge Crossings Park-and-Ride.
4. As a condition of this approval, Scott County will enter into an agreement with the Metropolitan Council
for administration of the RTC funds on behalf of the City of Prior Lake and City of Shakopee.
