SUBJECT: CONSIDER AMENDMENT TO SPECIAL ASSESSMENT POLICY
DATE: FEBRUARY 21, 1995
INTRODUCTION:
The purpose of this agenda item is for the City Council to consider
amending the City's Special Assessment Policy regarding the cost for
excess right-of-way acquisition for city street collectors.
DISCUSSION:
The City Council authorized an increase in the acreage rate, for purposes
of calculating park dedication, from $8,000 to $12,000/acre effective at
the beginning of this year as part of the adoption of the City's 1995 Fee
Schedule. Since the City is basically establishing an average cost of land
at $12,000 per acre it is important that we are in applying this dollar
amount not only in our park dedication charges but in our land acquisition
efforts as well.
Specifically identified under our Special Assessment Policy is Section III,
Collector Street Improvements, (page 13) is the following excerpt:
"The developer shall dedicate up to a maximum of 60 feet of right-of-way
and the City will reimburse any right-of-way in excess of 60 feet at a
current rate cost of $8,OOO/acre. "
It is the intent of City policies to be consistent with each other. It would
seem appropriate that the current rate cost utilized for ROW
reimbursement should reflect the same per acre cost as the rate approved
by the City Council within the City's 1995 Fee Schedule which is
$ 12,000/acre. The best way to insure that both are consistent would be to
reference an annually determined amount as opposed to a specific dollar
amount that is always subject to change.
ALTERNATIVES:
The following alternatives are available to the City Council for
consideration:
1. Amend the language in the Special Assessment Policy to
incorporate the following statement.
"The developer shall dedicate up to a maximum of 60 feet of
right-of-way and the City will reimburse any right-of-way in
excess of 60 feet at a per acreage rate to be determined
annually by the City Council."

2. Amend the language in the Special Assessment Policy to
change the current rate cost amount from $8,OOO/acre to
$ 12,OOO/acre.
3. Leave the amount within the Assessment Policy unchanged.
RECOMMENDATION: Staff would recommend that the Council adopt Alternative #1 so that both
our park dedication and ROW acquisition rates are consistent.
