AGENDA #: PREPARED BY: SUBJECT: DATE: BACKGROUND: ALTERNATIVES: STAFF AGENDA REPORT 8B DONALD RYE, PLANNING DIRECTOR PRELIMINARY PLAT APPROVAL WITH VARIANCES FOR WINDSONG ON THE LAKE SECOND ADDITION FEBRUARY 21, 1995 Application was made for preliminary plat approval of Windsong on the Lake Second Addition in November of 1994. The staff review determined the need for a lot width variance to allow one lot with a width of 52 feet instead of the required 86 feet at the front yard setback line. The Planning Commission reviewed this request on January 5, 1994. Specific concerns were raised at that time regarding the need for increased right-of-way at the intersection of County Road 21 and Lord's Street and the effect this would have on the proposed plat. In addition, comments from neighbors raised concerns relating to safety problems associated with the intersection of proposed Schroeder Circle and Windsong Circle as well as concerns about increased density within the subdivision. Staff recommended the request be postponed at that time to allow the developer time to work with staff and Scott County to resolve any right-of-way issues and the issues raised by neighborhood residents. Meetings were held with the Scott County Highway Engineer and the applicant and the preliminary plat has been modified to reflect the increased right-of-way needs resulting from the County Road improvement as well as other issues raised by the Engineering Department during their review. With the exception of the items called out in the Resolution of Approval for the preliminary plat, the remaining issues identified by staff have been addressed satisfactorily. It was further staff's opinion that the concerns raised by neighborhood residents regarding the safety of the intersection of proposed Schroeder Circle and Windsong Circle are adequately addressed through the proposed design and staff does not believe that further modification of the layout is necessary or desirable. RESOLUTION 95.' _ WHEREAS, The Prior Lake Planning Commission conducted a public hearing on the 5th day of January, 1995, and 13th day of February, 1995 to act on a petition submitted by H & H Land Development to approve the preliminary plat lot width variance, of Windsong on the Lake, Second Addition; and Notice of the public hearing on said application was duly published and posted in accordance with the applicable Minnesota Statutes and City Code requirements; and WHEREAS, WHEREAS, On February 13, 1995, the Prior Lake Planning Commission approved the lot width variance for proposed Lot 9, Block 1, Windsong on the Lake Second Addition to permit a lot width of 52 feet at the front yard setback instead of the required 86 feet and it further recommended approval of the preliminary plat as amended. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, That it hereby approves the preliminary plat of Windsong on the Lake Second Addition as shown on amended plan sheets dated January 26, 1995, subject to the following conditions: 1. Approval of the lot width variance on Lot 9, Block 1, Windsong on the Lake Second Addition to permit a lot width of 52 feet at the front yard setback is hereby acknowledged, 2. The name of the plat shall be changed from Windsong on the Lake Plat 2 to Windsong on the Lake, Second Addition, 3. All necessary permits and approvals from other State, local and Federal government agencies shall be obtained by the developer which are required due to this development. 4. All utilities and drainage easement necessary shall be provided and shown on the plat acceptable to the City Engineer. 5. The erosion control plan shall be revised acceptable to the City Engineer. . 6. The Metropolitan Wastewater Services division shall be contacted for review of possible widening of the existing easement for the Metropolitan Wastewater Services interceptor to this plat. 7. Street and cul.de-sac typical sections and street profiles and grading plans shall be advised acceptable to the City Engineer, 9. 100 Year O-H-W level elevations of low areas on the site with calculations shall be submitted to the Engineering Department and 100 Year flood elevations established to determine a low building pad elevation on lots. 10. The berm on the westerly side of Lot 1 shall be extended to the south along the west edge of Lots 1 and 2 to the southerly end of Lot 2, 11. The inter-office memorandum comments from Jeffrey Evans dated February 1, 1995 shall be addressed acceptable to the City Engineer. Passed and adopted this 13th day of February, 1995.
