The property is located at on the south side of TH 13 and north and west of Crystal Lake and Rice Lake. The original development plan calls for a residen- tial development consisting of 79 single family homes and 37 townhouses, along with parks and trail on a total of 80 acres. The proposed plan changes are to reduce the number of attached townhome lots by four to 33 units. Hi StOry Originally proposed for development by Tollefson Development, the City Coun- cil approved the Final Plat and Planned Unit Development for this subdivision on August 21, 2006. Since that time, the development has gone through fore- closure proceedings and was a bank-owned project. Deanovic's company purchased the Development two years ago and received approval to amend the townhome layout of the Hickory Shores PUD in November of 2011. A sub- sequent minor amendment changed the grading plan in 2012 to allow a clay- lined pond and corresponding grade adjustments to townhome lots. Current Circumstances The current PUD Amendment involves a request to modify the previously ap- proved number of townhome lots. Four lots were platted within the center is- land of Kennett Curve, a private street serving 22 of the townhomes. Mr. Deanovic has reached agreement with D.R. Horton (builder/developer) to re- move those four units and designate the four lots as part of the association common area. These lots would be further designated as non-buildable, and the center island would become a landscaped area owned and maintained by the association. The center island is approximately 0.8 acre, including previ- ously constructed guest parking stalls for about 15 vehicles. Conclusion Section 1106.711 of the City Code allows for minor amendments when changes have a minimal impact on the overall character of the approved Final PUD Plan, including decreases in residential density. The developer has pro- posed an adjustment which will not have a detrimental impact on the property, plat or PUD. ISSUES: The application for a PUD amendment removing lots and housing units also require the abandonment of corresponding utility services. A map shows de- tails on abandoning four existing water services. Staff agrees these four lots are not in an ideal location surrounded by street on all sides. Therefore, staff recommends approval of the PUD Amendment subject to the following condi- tions: 1. The developer must obtain the required permits from the city, or any other state or local agency prior to any work on the site. 2. Improvements to the center island of Kennett Curve are limited to landscap- ing features and park/play structures, as determined by the association. FINANCIAL Approval of this minor amendment may assist in facilitating the marketing of IMPACT: the remaining 33 townhome lots that were approved in November 2011 which will contribute to the City's tax base. ALTERNATIVES: 1. Adopt a resolution with conditions approving the minor PUD Amendment for Hickory Shores. 2. Deny the PUD Amendment on the basis it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances and/or the Compre- hensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of the re- quest. 1. Defer consideration of the item and provide staff with specific direction. RECOMMENDED 1. A motion and second to adopt a resolution approving a minor amendment MOTION: to the final PUD Plan for Hickory Shores, subject to the listed conditions. ATTACHMENTS: Maps showing PUD amendment. 2 O� P ���P t: U �y 4646 Dakota Street SE �rNNES�� Prior Lake, MN 55372 RESOLUTION 13-xxx A RESOLUTION TO APPROVE AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN KNOWN AS HICKORY SHORES Motion By: Second By: WHEREAS, Wyatt the Pudel Pointer H.S., LLC has submitted an application for an amendment to the Planned Unit Development Final Plan known as Hickory Shores; and WHEREAS, The proposed amentlment is a"minor amendment" for administrative and procedural purposes as allowed in Section 1106.711 of the Prior Lake Zoning Ordinance, which proposes a reduction in residential density; and WHEREAS, The City Council considered the proposed PUD Amendment on June 24, 2013; and WHEREAS, The City Council finds the PUD Amendment to be in substantial compliance with the approved Final PUD Plan; and WHEREAS, The City Council finds the PUD Amendment is compatible with the stated purposes and intent of Section 1106 (Planned Unit Developments) of the Zoning Ordinance. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Planned Unit Development Final Plan is hereby amentled to reduce the number of townhome lots by four units to 33 lots, incorporating Lots 20-23, Block 1, Hickory Shores Second Addition, into common area for the association and denoted them as non-buildable. 3. The Planned Unit Development Amendment is hereby approved subject to the following conditions: a. The developer must obtain the required permits from the city, and any other state or local agency prior to any work on the site. b. Copies of fully executed and recorded deeds conveying Lots 20-23, Block 1, Hickory Shores Second Addition to the homeowner association shall be provided to the City. c. Improvements to the center island of Kennett Curve is limited to landscaping features and park/play structures, as approved by the homeowner association.
