CONDITIONS OF APPROVAL:
(1) Applicant must cail the Engineering Department for erosion control inspection at (952)447-9830 prior to earth moving
activities.
(2) Maximum 4:1 slopes are allowed in "maintained" areas except approved by City Engineer. Maximum 3:1 slopes are
allowed adjacent natural resources.
(3) Slopes greater than or equal to 3:1 shall have approved erosion control Best Management Practices installed
immediately after finished grading.
(4) Minimum grade for drainage swales shall be 2% or greater.
(5) Removal or depositing of material greater than 400 cubic yards requires a conditional use permit, unless it is part of a
preliminary plat application.
(6) Applicant is responsible for obtaining and meeting the conditions outlined by other permitting agencies including but not
limited to the following: DNR, Corps of Engineer, Prior Lake/Spring Lake Watershed District, Scott County, MN/DOT,
MPCA.
(7) Applicant is responsible for all damages to other property or facilities as a result of work covered by this permit.
(8) Applicant must cail the Engineering Department for final grading inspection at (952)447-9830 prior to release of grading
security.

General Construction Project Information
Describe the construction activity (what will be built, general timeline, etc):
PROJECT IS A SINGLE FAMILY DEVELOPMENT AND COMMERCIAL DEVELOPMENT FROM FARMLAND. THIS PROJECT
WILL BE COMPRISED OF MASS GRADING OF THE SITE, UTILITY CONSTRUCTION, STREET CONSTRUCTION AND HOME
AND COMMERCIAL BUILDING CONSTRUCTION. IT IS ESTIMATED TO TAKE 12-24 MONTHS TO COMPLETE.
Describe soil types found at the project:
THE SOILS ON THE PROJECT ARE SNAD AND GRAVEL SOILS.
General Site Information (III.A)
1. Describe the location and type of all temporary and permanent erosion prevention and sediment control Best Management
Practices (BMPs). Include the timing for installation and procedures used to establish additional temporary BMPs as
necessary. (III.A.4.a)
THE PROJECT WtLL BE PROTECTED BY 3 MAIN BMP'S, SILT FENCE, EROSION CONTROL BLANKET AND INLET
PROTECTION DEVICES. THE SILT FENCE WILL BE INSTALLED AROUND THE ENTIRE PERIMETER OF THE SITE AND
MONITORED AND REPARIED AS NECESSARY. INLET PROTECTION DEVICES WILL BE INSTALLED IN ALL CATCH
BASINS ON THE SITE AND ANY OFF SITE THAT WILL RECEIVE STORMWATER RUNOFF FROM THIS SITE. AS THE
PROJECT PROGRESSES AND GRADE IS ESTABLISHED ADDITIONAL BMP'S SUCH AS SEED AND MULCH &
EROSION CONTROL BLANKET WILL BE UTILIZED.
2. Attach to this SWPPP a table with the anticipated quantities for the life of the project for all erosion prevention and sediment
control BMPs (III. A. 4.b) SEE SWPPP PLAN FOR QUANTITY TABLE

If the site has a discharge point within one mile of the impaired water and the water flows to the impaired water but no specific
BMPs for construction are identified in the TMDL, the additional BMPs in Appendix A(C.1 and C.2) must be added to the
SWPPP and implemented. (III.A.7). The additional BMPs only apply to those portions of the project that drain to one of the
identified discharge points.
Training (III.A)
Training is required for all permitted projects after February 1, 2010. It must be provided by entities with expertise in erosion
prevention, sediment control or permanent stormwater management. Training must be focused on the individual's job duties as they
relate to the permit requirements (Part III.A.2). Who must be trained?

Selection of a Permanent Stormwater Management System (III.C)

Erosion Prevention Practices (IV.B)
1. Describe construction phasing, vegetative buffer strips, horizontal slope grading, and other construction practices to minimize
erosion. Delineate areas not to be disturbed (e.g., with flags, stakes, signs, silt fence, etc.) before work begins.
THE PROJECT WILL BE CONSTRUCTED ALL AT ONE TIME AND ALL APPROPRIATE EROSION CONTROL MEASURES
WILL BE IN PLACE. SILT FENCE WILL BE INSTALLED PRIOR TO CONSTRUCTION AS WELL AS INLET PROTECTION
DEVICES. WHERE POSSIBLE VEGITATION WILL BE LEFT IN PLACE AND SLOPES WILL BE GRADED WITH
HORIZONTAL TRACKING TO REDUCE EROSION.
2. Describe temporary erosion protection or permanent cover used for exposed soil. All exposed soil areas must be stabilized as
soon as possible but in no case later than 14 days after the construction activity in that portion of the site has temporarily or
permanently (part IV.6.2).

TEMPORARY EROSION PROTECTION WILL BE SEED AND MULCH AND EROSION CONTROL BLANKET WHERE
REQUIRED, WITH PERMANENT COVER BEING EITHER SOD OR LANDSCAPE FEATURES.
3. For drainage or diversion ditches, describe practices to stabilize the normal wetted perimeter within 200 lineal feet of the
property edge or point of discharge to surface water. The remaining portions of the temporary or permanent ditch or swale
must be stabilized within 14 days after connecting to surface waters and construction in that portion of the ditch has
temporarily or permanently ceased.
ALL DITCHES AND DRAINAGE SWALES SHALL BE STABILIZED IMMEDIATELY AFTER FINAL GRADE IS ESTABLISHED
LINKING SAID SWALES TO DOWNSTREAM WATERS. THIS STABILIZATION SHALL BE ACCOMPLISHED WITH
EROSION CONTROL BLANKET, ROCK CHECK DAMS, AND/OR SLOPE STABILIZATION MATTING AS REQUIRED.
4. Describe other erosion prevention practices (list and describe).
OTHER EROSION CONTROL PRACTICES INCLUDE BUT NOT LIMITED TOO; MINIMIZE SITE EXPOSURE WHEN
POSSIBLE.
Sediment Control Practices (IV.C)
Describe sediment control practices used to minimize sediments from entering surface waters, including curb and gutter systems
and storm drain inlets. At a minimum, these sediment control practices must include:
• Sediment controls for temporary or permanent drainage ditches and sediment basins that are designed as part of a
treatment system
• Installation of check dams or other grade control practice to ensure sheet flow and prevent rills (for slope lengths greater
than 75 feet with a grade of 3:1 or steeper).
• Sediment control practices on all down gradient perimeters prior to land disturbing activities.
• Storm drain inlet protection for all inlets.
• Silt fencing or other sediment control surrounding temporary soil stockpiles.
. Minimize vehicle tracking of sediments (e.g., stone pads, concrete or steel wash racks, or equivalent systems).
• Street sweeping of tracked sediment.
• Temporary sedimentation basins (see Part III.B).

Easement Agreement dated as of September �, 2012 by and between KRB
Development, LLC, a Minnesota limited liability company ("KRB"); Peter J. Knaeble and
Roberta A.O. Knaeble, Trustees of the Knaeble Living Trust dated July 14, 2005
("Knaeble"); and Paul J. Schliesman and Katherine L. Schliesman, husband and wife
("Schliesrnan").
RECITALS
A. KRB is the owner of certain real property located in Scott County, Minnesota,
legally described on Exhibit A attached hereto and made a part hereof (the "KRB
Property").
B. Knaeble and Schliesman (hereinafter collectively referred to as "K and S")
are the owners af certain real property located Scott County, Minnesota, legally described
on Exhibit � attached hereto and made a part hereof (the "K and S Property").
C. The KRB Property is adjacent to and immediately west of the K and S
Property.
D. The parties wish to create easements for sanitary sewer purposes and for
drainage and storm water ponding purposes over portions of the K and S Property for the
benefit of the KRB Property as hereinafter set forth.

NOW, THEREFORE, in consideration of $1.00 and ofiher good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
agree as follows:
1. Grant of Sanitarv Sewer Easement. K and S hereby grants to KRB a
permanent, exclusive easement on, over, under, and across that portion of the K and S
Property legally described on Exhibit C attached hereto and made a part hereof (the
"Sanitary Sewer Easement Area") for the installation, existence, establishment, and
operation of sanitary sewer lines and facilities to serve the KRB Property, including without
limitation, the right to repair, maintain, upgrade, and replace such sanitary sewer lines and
fiacilities.
2. Grant of Drainage and Pondinq Easement. K and S hereby grants to KRB a
permanent, exclusive easement on, over, under, and across that portion of the K and S
Property legally described on Exhibit D attached hereto and made a part hereof (the
"Storm Water Pond Easement Area") for drainage and storm water ponding purposes for
the benefifi of the KRB Property, including wifihout lirnifiation, the right to establish, create,
operate, repair, maintain, upgrade, and replace a storm water and drainage pond within the
Storm Water Pond Easement Area.
3. Maintenance Expenses. The owner of the KRB Property shall be
; responsible, at its expense, for all costs incurred in the installation, repair, maintenance,
' and operation of the sanitary sewer lines and facilities serving the KRB Property located
within the Sanitary Sewer Easement Area, and for all costs incurred in the creation,

maintenance, and repair of drainage and ponding facilities located within the Storm Water
Pond Easement Area.
4. No Dedication to Public. Nothing in this Agreement shall constitute a
dedication of any interest in either the K and S Properry or the KRB Property to the public
use, or give the members of the public any rights hereunder, including without limitation,
any rights in the Sanitary Sewer Easement Area or the Storm Water Pond EasementArea.
, 5. Binding Effect. The easements granted herein shall be perpetual and shall
run with the land and be a continuing benefit and burden to the KRB Property and the K
and S Property, and shall be binding upon and shall inure to the benefit of KR6, Knaeble,
Schliesman, and their respective successors and assigns as owners of the KRB Property
and the K and S Property.
6. Governinq Law. This Agreement shall be governed by and construed in
accordance with the laws of the State of Minnesota. .
7. Entire Aqreement. This Agreement represents the entire agreement between
the parties regarding the subjecfi matter hereof, and may not be amended or moclified
except in a writing signed by the parties.
