CONSIDER APPROVAL OF ASSESSMENT POLICY
REVISIONS RELATED TO ADMINISTRATIVE LAND
DIVISIONS.
NOVEMBER 20, 1995
The City Council had directed staff to review the City's assessment
policies as they relate to Administrative Land Divisions. The
assessment policies have been reviewed with the City's Finance
Director, Ralph Teschner. This memorandum is intended to respond to
the Council's directive.
The City adopted the current "Assessment Policy for Public Initiated
Improvements" on February 21, 1989. A copy of this Policy is attached
to this report. The Policy has been amended twice in 1990 and once
each in 1992, 1994 and 1995. (See attached copy)
The purpose of the policy is to provide a fair and equitable manner of
recovering and distributing the costs of public improvements. (See
page 3 of the policy)
Under the City's assessment policy, all new subdivisions are subject to
the following charges;
1. Trunk Sewer Acreage Charge - $3500.00/acre
2. Collector Street Charge - $1500.00/acre
3. Stormwater Charge -16.8 cents/sq. Ft.
Administrative Land Divisions are simply another form of subdivision.
thus the above-listed charges are applied to them as well. In order to
insure payment of charges, payment is required to be made prior to
issuance of the letter approving the Division. In determining whether
these charges are applied to a specific Administrative Land Division,
two tests are applied;
1. Does the Division result in the creation of new lots without
existing homes, or
2. Has the parcel previously been assessed for these
charges.
Where no new vacant lots are created the charges would not be
assessed, and where assessments have previously been paid, the
property which is the subject of the Division would be credited for those
payments.

The Council was concerned that Administrative Land Divisions be
treated the same as any other land division. Based upon the foregoing
information, they are treated the same. Consequently, there appears
to be no reason to revise the policy unless the Council wishes that
such divisions be treated more or less favorably than other types of
divisions.
1. Accept the Assessment Policy as currently written.
2. Direct Staff to prepare an amendment(s) based on the Council's
discussion.
3. Continue or table the matter for additional information or other
specific reasons.
A motion accepting this report and the Assessment Policy as is, or
directing Staff to prepare a m ification of the Policy based on its
discussion.
