INTRODUCTION:
The purpose of this agenda item is to accept the Feasibility Study
and call for a Public Hearing on Improvement of 1996 Projects and
conduct the Assessment Hearing associated with Project #94-02.
BACKGROUND:
The Feasibility Report identified the 1996 Improvement Proj ects
as:
1. Northwood Road from CSAH 12 to Island View Road by the
construction of grading, storm sewer, aggregate base, concrete
curb and gutter, bituminous surfacing, walk and appurtenant
work.
2. CSAH 21 from CSAH 82 to CSAH 42 by the construction of
storm sewer, utility crossings, concrete curb and gutter,
sidewalk, bituminous surfacing, and appurtenant work.
3. Paving of Lakefront Park roads, trails and parking lots by the
construction of grading, storm sewer, aggregate base, concrete
curb and gutter, bituminous surfacing, and appurtenant work.
4. The bituminous sealcoating of bituminous paved streets
throughout the City.
At the January 16, 1996 Council Meeting, a Public Hearing was
held and the council approved plans and ordered advertisement for
bids for Project 94-02, Northwood Road. Bids were received and
opened on February 20, 1996. The results of the bids have been
tabulated and a contract amount has been determined. The low
bidder is Valley Paving, Inc. of Shakopee, MN in the amount of
$880,525.38. Their bid was slightly below the engineers estimate.

At its regular meeting of February 20, 1996, the Council approved
Resolution 96-23 which declared the cost to be assessed and
ordered the preparation of the assessment roll. Also Resolution 96-
24 establishing the date of the Assessment Hearing for the
Northwood Road improvements was passed.
DISCUSSION:
On December 18, 1995, the Council approved the attached
Resolution 95-125 which accepted the Feasibility Study and called
for a Public Hearing on the 1996 projects. Resolution 95-125 was
flawed as the first part of the Resolution referred to the four
projects which are to be included in the 1996 construction bonding.
The second part of the Resolution which called for the Public
Hearing included Northwood Road but not the other three projects.
Thus the Resolution is flawed and a new Resolution 96-39 needs to
be approved which would include Northwood Road, CSAH 21,
Lakefront Park and bituminous sea1coating. Staff apologizes for
the inconvenience this has caused.
A new Public Hearing is required on May 6, 1996 to include the
four project areas. The Assessment Hearing should be conducted
on April 1 and continued to May 6, 1996 for adoption after the
Public Hearing for the 1996 Improvements has been conducted.
The following steps would be taken on May 6, 1996.
1. Approve Resolution ordering all 1996 Improvements as
indicated in the Feasibility Report.
2. Approve Resolution adopting the assessments for Northwood
Road street improvements.
3. Approve Resolution awarding bid for Northwood Road.
4. Authorize MSA Consulting Engineers to perform construction
engineering services.
All benefiting property owners have been mailed a Statement of
Special Assessments which included all appropriate information
pertinent to their property such as the total amount of the
assessment and the assessment rate. A Public Hearing notice has
been mailed and published indicating time and place of the
Assessment Hearing.

At the February 5, 1996 meeting, council approved a revision to
the Assessment Policy. The revision changed the percentage that
the City assesses the benefiting properties. The policy was changed
from assessing 60% of the total project cost against the benefiting
properties to 40%. Using the new percentages and Ordinance 85-01
(Special Assessment Policy) the proposed rate per front foot is
$42.28F IF.
Project cost shall be recovered by State Aid Funds, Trunk Reserve
Funds, Collector Street Funds, and Special Assessment.

The assessment frontages were determined as per the City's
assessment policy and utilizing the existing plat drawings for this
area on file. In the event that a property owner provides a surveyor
justification that the frontage for a parcel is incorrect, the City
Council can adjust the frontage for the parcel and the resulting
assessment.
The assessment terms are to be for ten (10) years for paving.
Added to the first installment (1997) will be an additional 274 days
of interest which accounts for the remaining days of 1996
following the Public Hearing. An interest rate of 8% will be
charged in accordance with City Assessment Policy.
Prior Lake Code, Chapter 1-13 allows for the deferment of
assessment principal and interest if the following four criteria are
satisfied:
1. Applicant must be 65 years of age or older.
2. The qualifying property must be the homestead of the
applicant.
3. Annual gross income shall not exceed the income limits as
set forth by family size according to Attachment "A" of
Ordinance 86-3.
4. Total special assessment to be deferred must exceed
$1,000.00.
ISSUES:
The Assessment Hearing needs to be continued to May 6, 1996 due
to the flawed notice in order to conduct the Public Hearing for the
1996 projects. Once the Public Hearing on May 6 is approved, the
Assessment Hearing can be concluded and the roll adopted.
Subsequent to adopting the roll, the bids can be awarded on the
project.
Residents at the public hearing may raise a number of issues
regarding the proposed assessments. The assessment rate given at
the January 16, 1996 public hearing was $54.47IFF compared with
today's proposed assessment amount of $42.28/FF. Property
owners should receive this as good news.

This project required several easements from various property
owners throughout this project. The property owners have not
received payment for the required easements. All payments for
signed easements and the required deposit for condemnation will
be included with the invoices to be paid on April 15, 1996.
The focus of the hearing is the accuracy of the proposed
assessment roll. Previous meetings have addressed concerns about
the proposed construction.
AL TERNATIVES:
The alternatives are as follows:
1. Approve Resolutions 96-39 accepting the Feasibility Study
and calling for a Public Hearing on Improvement of 1996
Projects and continue the Assessment Hearing to May 6,
1996.
2. Approve Resolutions 96-39 subject to Council approved
changes.
3. Continue the hearing for a specific reason.
RECOMMENDATION: The recommendation is Alternative No.1.
FINANCIAL IMP ACT: The project costs will be recouped from Trunk Reserve, State Aid
Funds, Collector Street Funds and assessments.

WHEREAS, Resolution 95-125 was originally approved on December 18, 1995 which
incorrectly identified the improvements project area for the public hearing; and
WHEREAS, pursuant to Resolution 95-119 of the City Council, adopted on December 4, 1995,
a report prepared by the City's Engineering Department and the City's
Engineering Consultant (MSA Consulting Engineers, Inc.) with reference to the
following improvements and the generally described project areas:
1. Northwood Road from CSAH 12 to Island View Road by the construction of

portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429
at an estimated total cost of the improvements of $2,025,000.00.
