The purpose of this hearing is to consider a request by developer,
Louis Stassen to amend the PUD of First Addition to West Edge
Estates, to delete a portion of sidewalk within the PUD. The specific
request is to delete the westerly portion, (approximately 415 feet) of
sidewalk south of Simpkins Drive, within the plat of First addition to
West Edge Estates.
See attached application, maps, and Planning Report dated
February 17, 1994 for a detailed discussion of the proposed
amendment.
The City Council approved the PUD of the First Addition to West
Edge Estates on November 1, 1993 subject to the stipulations
contained in attached Resolution 93-85. Specifically, item # 11
specifies: "A pedestrian side walk system shall be installed along
the entire east/west private road and a connection south to 170th
Street, acceptable to the City Parks Director" (City Council
Resolution 93-85, p.1).
The Planning Commission held a public hearing on February 17,
1994 to consider Mr. Stassen's application to amend the PUD by
removing approximately 415 feet of sidewalk, legally described in
unrecorded Deed of Easement (see attached map for reference).
Four people were in attendance at the public hearing, Ms.
Margaret O'Keefe spoke in support of the applicant's request to
remove the westerly 415 feet of sidewalk from the PUD. See
attached Planning Commission minutes for details regarding the
public testimony. The main objections raised at the public hearing
were a concern that residents, other than the Townhome residents,
would use the sidewalk and possibly cut through the existing plat of
West Edge Estates. In addition, it was mentioned that residents
currently walk on the street and that no additional sidewalk is
needed.

Approve the PUD amendment as requested to delete

RECOMMENDATION: Alternative #3. The Planning Commission recommends that the
application to amend the PUD be denied. The basis for the denial is
that the PUD was approved with a 24' private road. The sidewalk
should be installed for safety reasons to separate pedestrians from
vehicle traffic. In addition, City Parks Director, Bill Mangan, testified
that there should be an internal pedestrian link within the
townhouse development to provide a connection to the City-wide
Trail System.
STAFF NOTE: The subject site is a town home development with no
recreation amenities. The sidewalk is intended to provide a means
for the residents and guests of West Edge Estates townhomes to
access the school, park and shopping center areas without having
to drive on STH 13. The applicant identified that the current
residents are senior citizens however, it is the understanding of staff
that there are no formal covenants nor regulations that would
prohibit sale of a unit to a younger individual or family.
Staff is of the opinion that the long range objective incorporating
pedestrian and bike improvements is important to this
neighborhood. Sidewalks are a typical improvement found in
multi-family developments to provide links to community facilities.
The sidewalk was planned and discussed during the original PUD
public hearings and the PUD approved with the sidewalk. The
sidewalk should be installed to provide long term pedestrian access
to park systems, school and church sites and the business districts.
The optimum objective would also include a sidewalk within the
original West Edge Estates plat. However, that plat was approved a
number of years ago, before the City conducted surveys and began
its initiative to develop sidewalks and trails on a City-wide basis.
ACTION REQUIRED: A motion to approve, deny, continue or table this issue, as per City
Council discussion.

ITEM II. PUBLIC HEARING. PUD AMENDMENT OF WEST EDGE ESTATES FIRST
ADDITION
The Public Hearing was called to order at 8:15 P.M. The public was in attendance and a sign-up
sheet was circulated.
Bryce Hoemueller stated he is representing the applicant Stassen Construction. 16617 Creekside
Circle. The request is for an amendment to Item 11 of Resolution 93-85 allowing the applicant
to remove the easterly 415 foot section of sidewalk from West Edge Estates FlI'St Addition PUD.
The West Edge Estates Townhome Association residents do not want the sidewalk as they feel it
. would create unnecessary traffic into their neighborhood.
Deb Garross presented the information as per planning repon of February 17, 1994. The City
Council approved the final plat of the First Addition to West Edge Estates contingent with the
items listed on Resolution 93-85 to be met and is pan of the pun. The purpose of the sidewalk is
to provide a pedestrian connection from the development to 170th Street and Wlllowood Street
The goal of the City is to have hike/bike trails connecting all neighborhoods. A walkway system
is designed to move pedestrians safely within the City. The road in the development is a private
road and is only 24 feet wide in a multi-family district therefore a safety issue must be
considered. Recommendation from Staff is to recommend denial of the amendment to City
Council.
Bill Mangan, Director of Parks. stated that in a 1990 community-wide smvey 73% of the number
responding was that safe trails were wanted in Prior Lake. The sidewalk in question would be
used primarily by the residents. their children. and grandchildren as an internal connection to the
City-wide trail sustem.
Margaret O'Keefe, 3798 - 170th Street, voiced her opposition to the sidewalk. She felt it was
mostly senior citizens living there and a sidewalk would have children coming through their
property.

INTRODUCTION:
The Planning Department has received an application from Louis Stassen, 16617 Creekside
Circle N.E. to amend the Planned Unit Development (PUD) of the First Addition to West Edge
Estates. The application is being processed according to Prior Lake City Code. Section 5-6-10:
Amendments. The specific request is to amend the PUD plan to delete approximately 415 feet of
sidewalk adjacent to Simpkins Drive. within the plat of First Addition to West Edge Estates. See
application for reference to the request
BACKGROUND:
On November 1. 1993. the City Council approved the final plat of the First Addition to West
Edge Estates via attached Resolution 93-85. Item #11 specifies: "A pedestrian side walk system
shall be installed along the entire east/west private road and a connection south to 170th Street,
acceptable to the City Parks Director" (City Council Resolution 93-85. p.1).
The applicant requests to remove approximately 415 feet of sidewalk located south of Simpkins
Drive and east of the west lot line of the PUD. legally described in unrecorded Deed of
Easement, (See attached map for reference). The sidewalk section linking 170th Street to
Simpkins Drive and the easterly portion of the sidewalk connecting to Simpkins Circle. is
proposed to be constructed as originally planned.
The applicant did not include a reason for the proposed sidewalk deletion in the application.
However. he did indicated to staff that the homeowners within the plat of West Edge Estates
(located west of the subject site) were concerned about pedestrian traffic into their neighborhood.
DISCUSSION:
The pwpose of the sidewalk is to provide a pedestrian connection from the development to 170th
Street and Willowood Street Staff has included a "Schematic Trail/Sidewalk Map" with the
agenda packet that indicates the location of existing and anticipated pedestrian improvements
within approximately 1/2 mile of the subject site. The intent of the pedestrian system is to
provide neighborhood links and pathways from residential homes to Five Hawks Elementary
School. parks, shopping areas, Priordale business district, Downtown and Lakefront Park. There
are few street connections outside of SlH 13. therefore. a pedestrian system is integral to this
part of the community.

Sidewalks will be developed within the Westbury Ponds development and exist adjacent to Five
Hawks Avenue, and on Duluth Avenue. south of STH 13. A park trail system will be developed
within Outlot A. Westbury Ponds and exists between Willow Beach Street and Priorwood Lane.
Future trails and sidewalks are anticipated along C.R. 12 (170th Street) and C.R. 23. (panama
Avenue). and adjacent to STH 13. Internal trails and sidewalks are needed within subdivisions to
get people to the community wide systems which will be located along County Roads and
Collector streets within the community. It is anticipated that internal pedestrian links will be
needed to link the Westbury Ponds neighborhood to Duluth Avenue and Pershing Street; a
southerly link from Walnut Avenue to the Woodview Park and an extension of Five Hawks
Avenue to the north to intersect with Cates Street.
ALTERNATIVES:
1. Recommend that the City Council approve the PUD amendment as requested to delete
approximately 415 feet of sidewalk.
2. Table or continue the item for specific reasons.
3. Recommend that the City Council deny the PUD amendment.
RECOMMENDATION:
Alternative #3. The purpose of requiring the sidewalk is to enhance the pedestrian systems
within this part of the community. The subject site is a townhome development with no
recreation amenities. The sidewalk provides a means for the residents and guests of West Edge
Estates townhomes to access the school, park and shopping center areas without having to drive
on SlH 13. Staff is of the opinion that the long range objective incorporating pedestrian and bike
improvements is important to this neighborhood. Sidewalks are typically found adjacent to high
density residential developments and to provide links to community facilities. The removal of
sidewalk would provide a short term economic gain to the developer however. the intent of the
sidewalk is to provide long term pedestrian access to park systems, school and church and to the
business districts.

claim to the CITY OF PRIOR LAKE, a political subdivision of the
State of Minnesota, a perpetual easement to construct, operate,
maintain and repair a public sidewalk over, across, under and
upon real property in Scott County, Minnesota, described as
follows:
A strip of land, 6.00 feet in width, within Outlot B, FIRST
ADDITION TO WESTEDGE ESTATES, the east and south line of
which is described as follows:
Commencing at southwest corner of said Outlot B; thence
North 86 degrees 24 minutes 40 seconds East along the
south line of said outlot B, a distance of 170.15 feet
to the point of beginning of the line to be described;
thence North 2 degrees 20 minutes 20 seconds West a dis-
tance of 73.00 feet; thence North 13 degrees 20 minutes
20 seconds West a distance of 69.00 feet to the south
line of the platted 38.00 foot utility and drainage

A title opinion or commitment of title insurance be submitted acceptable to the City Attorney.

Payment of all fees including but not limited to: final plat fee of $60.00 dollars; park dedication fee. trunk
sewer charge, storm water management fee, collector street fee and all other fees associated with the
developers agreement

The Developer's Agreement. as drafted by the City Engineer, shall be signed and fully executed prior to the
release of the Final Plat All fees shall be paid prior to release of the Fmal Plat.
Reductions of the entire plat be submitted. to the following scales: 1"-800'.1".200'. and one reduction at
no scale which fits onto an 8 1/2" x II" sheet of paper.

The applicant shall submit a copy of the proposed covenants which include a statement. acceptable to the

Utility and drainage easements along with an erosion control plan and sewer/water plan be revised
acceptable to the City Engineer. All easements including those necessary on the plat of West Edge Estates
be granted. acceptable to the City Engineer.

however it will not be required along individual unit driveways.

This letter is in response to Louis Stassens request to eliminate the
westerly 415' of sidewalk along the south side of Simpkins Drive, within
WestEdge Estates.
It is my feelings that this sidewalk will continue to add to the unnecessary
traffic within WestEdge Estates. While city sidewalks are an asset to the
community, they do not however run through private property, which would
be the case here. This Association has been forced to accept the City's
planning to have temporary vehicle access to our property by way of the
future Simpkins Circle. Adding the additional pedestrian traffic and the
vandalism that is sure to follow will be placing an unfair burden on the
homeowners and taxpayers of this Association.
Again, this is private property that the City Council is allowing people to
have access to. Who would be responsible for any damages from
vandalism, or basic wear and tear? Is it our Association fund, that we all
contribute to in addition to property taxes, that will have to pay for the
clearing of these sidewalks during the winter months? Why not leave the
sidewalks in the boulevard where they are supposed to be?
