Projec DATE: SA KEN SHERMAN, ENGINEERING TECHNICIAN CONSIDER APPROVAL OF RESOLUTION 96-12 APPROVING 1996 CIP IMPROVEMENT PROJECTS AND AUTHORIZING PREPARATION OF PLANS AND SOLICITATION OF QUOTES OR BIDS FEBRUARY 5, 1996 AGENDA #: PREP ARED BY: SUBJECT: INTRODUCTION: The purpose of this Agenda item is to authorize staff to proceed with the design of the following 1996 CIP projects: . Green Heights Trail Storm Improvement Project . Bluff Heights Storm Improvement Project . Brooksville Hills Storm Improvement Project . Crossandra Street Sidewalk Project . Seal Coat Project In addition to the 1996 CIP projects, approval of a pedestrian ramp project, of limited scope, is requested. These projects are funded by means other than tax levy or assessment. BACKGROUND: These projects with the exception of the pedestrian ramp project are in the Capital Improvements Program for this year. Staff requests that the Council authorize the design of these projects. Funding authorization will be submitted later when approval of the quotes or bids is requested. DISCUSSION: The following narrative describes the historical rationale for the improvement and projected cost for each project. The costs presented are the costs used to develop the CIP. The inlet capacity of the storm sewer has been restricted causing water to overtop Dutch Avenue during heavy rainfalls. The purpose of this project is to alter the existing inlet at the intersection of Green Heights Trail and Dutch Avenue by installing an inlet control structure prior to the storm water entering Prior Lake. Also included with this project is the construction of a sediment basin at this same location to trap sediment before it enters the lake, and to reduce the potential for the storm sewer becoming plugged. Easements need to be acquired and a neighborhood meeting held to obtain the residents approval on the improvement. Due to the water fluctuation and plugging problems, the residents have requested that the City make improvements to correct this problem. The projected cost for this improvement is $12,000. Funding for the project will be drawn from the Storm Water Enterprise Fund. (See attached map for location. ) Bluff Heights: (Water Quality Pond) The purpose of this improvement is to construct a water quality pond to serve existing and proposed development. This pond will be located on Lots 1 and 2, Block 1, Bluff Heights Addition which is north of the intersection of Franklin Trail and Brunswick Avenue. Drainage easements were acquired from the owner as part of Project 95-13, which included storm sewer being constructed from Bluff Heights Trail to the proposed pond, which was completed in December, 1995. The projected cost for the project is $30,000 to be drawn from the Storm Water Enterprise Fund. (See attached map for location.) Brooksville Hills: (Storm Sewer) The purpose of this project is to provide additional relief to an existing low area in Brooksville Hills 5th and 6th Additions which experiences flooding of townhomes during large storm events. A combination of both an overland swale and reconstruction of an existing storm sewer line will allow adequate surface drainage which will reduce surface ponding and flooding in this area. Neighborhood meetings will need to be held prior to final plan preparation to receive resident input. Also, all necessary easements will need to be acquired prior to the improvements being installed. If property owners do not cooperate, this may prolong this projects timing. The estimated project cost is CIPIMPRODOC 2 T r 1 ..' $60,000.00. This amount would be drawn from the Storm Water Enterprise Fund. Fran Otto, the owner of three duplexes in Brooksville Hills 5th Addition, has experienced flooding problems in two of the three units since they were constructed in 1986. He has asked the City on several occasions over the years to correct the rear drainage problem that exists. (See the attached letter from Fran Otto dated April 28, 1995.) The City has spent both time and money on feasibility reports and engineering trying to find an economical way to correct this situation. At the same time, the City has been somewhat reluctant to spend taxpayer money, since the two units that have been experiencing the flooding problems were built lower than shown on the certificate of survey. A drainage analysis has shown that the storm sewer system in this area is under capacity, and contributes to the problem. If the units had been built as designed, the problems that are occurring may not have experienced as frequent of flooding. This project is listed as a 1996 CIP project, and was moved up the priority list in place of the Fish Point Park channel stabilization project, which was moved to 1997 in the CIP. The City is looking at several drainage options to solve this problem. Fran Otto has agreed to provide the required easements and turf restoration for the area impacted on the five lots he owns. (See attached map for location.) Crossandra Street: (Sidewalk) During the open forum session of a City Council meeting in the spring of 1995, residents from Crossandra Street presented traffic related concerns to the Council. One of the concerns was the lack of a sidewalk on Crossandra and the safety of the pedestrians, especially the school children who now have to walk in the street. The installation of a sidewalk on Crossandra will provide a safe place to walk and connect a critical link between Franklin Trail and 160th Street. This sidewalk will also provide a link to the proposed trail system in Cardinal Ridge Park. Approximately 1,350 L.F. of sidewalk will be constructed at a projected cost of $27,000 drawn from the Capital Park Fund and shown in the 1996 CIP. '-., T r II< During the review process of the plat of Cardinal Ridge, a 5' concrete sidewalk was required to be installed from Fish Point Road to the west plat boundary along the north side of Crossandra Street within the plat. With this construction a gap was created between Cardinal Ridge and the existing trail system to the west to Franklin Trail. An Informational Meeting was conducted on Tuesday, December 12, 1995, to inform the property owners on the status of the sidewalk project. Two property owners attended the meeting and all questions were addressed to their satisfaction. The plans that will be prepared if this item is approved, would show the sidewalk on the north side of Crossandra Street. Pedestrian Ramps at Various Locations: Scott County will be striping CSAH 21 for crosswalks in the spring of 1996. This is in response to a request by a petition submitted to the City Council at the February 21, 1995 Open Forum. See the attached Memo by Frank Boyles dated February 17, 1995, and a copy of the petition. The petition asks the City and the County to provide crosswalks and lower speed limits on CSAH 21. The speed limit has since been lowered and City and County staff have worked together to determine safe locations for pedestrian crosswalks on CSAH 21. Attached is a letter dated April 28, 1995, addressed to Brad Larson that shows the City sending the petition to the County. Also attached is a letter dated June 7, 1995, addressed to Larry Anderson that addresses the understanding of issues regarding the construction of crosswalks on CSAH 21. As stated in the follow- up letter sent to Scott Merkley on January 30, 1995, the City agrees with the letter of understanding of issues except for the construction of a crosswalk at Highland A venue. Mr. Don Beno is a resident that lives in the area and has requested that a crosswalk be stripped across CSAH 21 at the Highland/Eau Claire intersection. Staff determined that there is not adequate sight distance to provide a safe crosswalk at this location. Please refer to the attached maps for the location of proposed crosswalk striping. Staffhas contacted Mr. Beno to discuss the crosswalk locations. At two of the selected locations, Quincy and West A venue, there is no pedestrian ramp on the west side of County Road 21. Staff has decided to combine the retrofit of these two pedestrian ramps with the Crossandra sidewalk project which will decrease the cost CIPIMPRO.DOC 4 T r , significantly. Four additional ramps, two each at the intersection of Dakota Street and Main Avenue and Pleasant Street and Main A venue have been added as well. This will complete the retrofit of pedestrian ramps on City sidewalks which was mandated by the 1992 Americans With Disabilities Act. See the attached maps. The projected cost for this work is $4,500 to be drawn from the Street Collector Fund. Seal Coat: Seal coat is an annual street maintenance project. This year approximately 100,000 square yards of street will be done at a projected cost of $50,000 as set forth in the 1996 Budget.. ISSUES: Before design work is completed, neighborhood meetings will be conducted for Brooksville Hills and Green Heights. Easements will be needed for both of these projects. If there is neighborhood resistance to the projects or the City is unable to obtain the easements these projects would not go forward. City staff will continue to try to explain to Mr. Beno about the City and County's position regarding a crosswalk at Highland Avenue on CSAH 21. Mr. Beno might present the June 7, 1995 letter that Scott County sent out addressed to Larry Anderson as a document that the County has agreed to construct a crosswalk at Highland Avenue. After the City received the letter from the County, then the City and the County met at the site to review the crosswalk locations. At the meeting, the City and the County determined that a crosswalk located at the Highland intersection would not meet the engineering requirements for a safe crosswalk. FUNDING: The estimated costs of the proposed projects is summarized below. Financing of the storm improvement projects is through the Storm Water Utility Budget, which has $113,000 planned for capital outlays in 1996. Financing for the Crossandra sidewalk CIPIMPRODOC 5 T r 1 project is through the Capital Parks Fund. Pedestrian ramp retrofitting will be financed through the Street Collector Fund. The seal coat project will be financed through ad valorem levy. AL TERNA TIVES: The alternatives are as follows: 1. Approve Resolution 96-12 authorizing design and preparation of plans and solicitation of bids or quotes for the 1996 projects. 2. Table this Agenda item for a specific reason. 3. Deny this Agenda item for a specific reason. RECOMMENDATION: The recommendation is for Alternative No.1. FINANCIAL IMP ACT: The three drainage related projects with a total estimated cost of $102,000 from the 1996 CIP are being funded through the Storm Water Enterprise Fund, which makes up the water quality budget. This fund is currently bringing in approximately $137,000 per year by collecting $3.75 per residence per quarter. There is currently $182,000 in the 1996 water quality budget because the Council approved a carryover from the 1995 fund to 1996. Of this, $69,000 is budgeted for salary, overhead, design and miscellaneous expenses and $ll3,000 is budgeted for capital outlays. The Collector Street Fund with a $752,000 balance would fund the $4,500 pedestrian ramp project. Finally, the Crossandra sidewalk project estimated to cost $27,000 would be funded by the Capital Parks Fund which has a balance of$275,000. I would like to follow up with some comments regarding our meeting we had on April 7th. In regards to our discussion concerning a remedy for the drainage problem I feel the only real solution is to cap the stonn sewer inlet that exists on the property now. and put in an additional stonn sewer line to deal with the water behind my rental units on Franklin Trail. From the time it was suggested to benn behind my properties. I have always stressed my disapproval of this as a possible solution. Mainly because of the high risk of trapping water between the benn and my buildings. creating more of a water problem than the one that already exists. The proposal that I put in a crushed rock trench. four feet deep by thirty feet long and install a sump pump system may take care of the water between the benn and building problem until there is a power outage. When I requested that I be able to talk to someone who already has a similar system I was told that none exist. All of the yards behind my five buildings would be dug up to increase overtlow drainage t'or a stornl sewer that is dumping water into my backyards instead of taking water away. and I would be required to pay re-sodding and re-seeding expenses. In regards to overtlow drainage. I am reluctant to expand city easement rights before we have a proper solution to the problem. In regards to the suggested solutions by the City of Prior Lake. I see the repair costing me approximately S I 0.000.00. The only time I have a problem with water in my basements is when a faulty stonn sewer discharges water into my backyards instead of taking it away. The same people who are telling me now that two of the buildings are to low are the very same people who gave me a certificate of occupancy eight years ago. The same people who designed a faulty stann sewer are the same people who are also telling me I need to benn around my buildings. As I see it I am being asked to spend thousands of dollars for a solution to a water problem .that I did not create. with no guarantee from the C icy of Prior lake that the benn solution will work. In summary I feel the only solution to this problem is to block off the current stonn sewer behind my property and put in another line parallel with the line that already exists. I would like a response to this letter as soon as possible as this situation needs to be dealt with before further nooding occurs. Merkley Engineering Coordinator Scott County Highway Department 600 Country Trail East Jordan, l'v1N 55352 RE: CSAH 21 PED RAMPS AND CROSSWALKS Dear Scott: The City of Prior Lake is preparing the plans for the construction of ped ramps on CSAH 21 from CSAH 82 to Franklin Trail (CSAH 44). We anticipate completion of the plans by the middle of February and then we will submit the plans with a permit application to the county for your review and approval. We agree with the items listed in your letter to Larry Anderson dated June 7, 1995, except for one item. The City does not feel that a crosswalk should be constructed at the Highland Avenue/Eau Claire Trail and CSAH 21 intersection because of limited visibility and inadequate sight distance. Larry Anderson and Ken Sherman along with you met at the site on August 30, 1995 to review the crosswalk locations on CSAH 21. It was decided at this meeting that a crosswalk at the Highland Avenue intersection would not be safe. This letter is a written notice to follow-up with the verbal notice from the field site visit. Subsequent pavement markings would be the responsibility of the City. 4) Curb modifications to incorporate pedestrian ramps to ADA standards at crosswalk locations would be the responsibility of the City. 5) Speed enforcement along CSAH 21 would be the responsibility of the City. Scott County Highway Department 600 Country Trail East Jordan,1\.1N 55352-9339 R.E: CSAH 21 Dear Brad: On Wednesday, April 26, 1995, I met with Dan Jobe to discuss the attached petition which was received at the Prior Lake City Council open forum and faxed to your office prior to the meeting. The focus of the petition was probably a result of the speed limit being raised through the bridge area. I understand that the posting is in accordance with the MnDOT speed study dated December 9, 1994. The 40 mph posting with advisory posting of 35 mph does not seem to be appropriate considering the urban nature of the area with local streets and driveways. One particular concern is the sight distance available at the intersection of Eau Claire Trail and CSAH 21. The City would request that the County review the sight distance at this intersection and determine if the current posting is appropriate. It is possible that MnDOT did not consider this while doing the speed study. Another problem is the advisory posting at each end of the curves, residents indicated that they have not seen the advisory posting. A 30 mph posting as an urban section may be more appropriate. The petition requests that intersections be posted "BLIND ENTRANCE", this may be appropriate considering the visibility at the intersection. The petition addresses crosswalks. Don Beno has also indicated that Ruth Carpenter was promised a crosswalk as part of the right-of-way negotiations. The City was not a part of these discussions. I understand that Eau Claire Trail would not meet warrants for a four way stop. The intersection at C.R. 82 and CSAH 21 may meet warrants for a signal.
