HomeMy WebLinkAbout8A Vacate ROW Northwood/Butternut O� p ��+P ti � u � 4646 Dakota Street SE Prior Lake, MN 55372 �INNES�� CITY COUNCILAGENDA REPORT MEETING DATE: JULY 8, 2013 AGENDA #: 8A PREPARED BY: JEFF MATZKE, PLANNER PUBLIC HEARING: YES AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION PROVIDING FOR THE VA- CATION OF A PORTION OF RIGHT OF WAY ADJACENT TO 16653 NORTHWOOD ROAD AND 3121 BUTTERNUT CIRCLE DISCUSSION: Introduction Jim Elliason and Patricia Hejhal are requesting vacation of a portion of right- of-way along frontage of the properties at 16653 Northwood Road and 3121 Butternut Circle. The properties are located along the western shores of Up- per Prior Lake, north of County State Aid Highway 12. Hi StON Much of the right of way for the public street, Northwood Road and Butter- nut, was platted with the Northwood plat in 1911. In addition roadway ease- ments were granted in 1977. As indicated by the attached survey, the paved roadway of Northwood road does not follow the platted right-of-way alignment in this area. Utility lines, both public and private are located in proximity to this roadway corridor. Current Circumstances As required by State Statute 462.356 Subd.2, the Planning Commission is required to make a recommendation to the City Council regarding the dis- posal or acquisition of public lands as it relates to compliance with the Com- prehensive Plan. The Planning Commission recommended approval of this vacation request at their July 1, 2013 meeting. Upon proper notification, State Statute 412.851 allows the Council to vacate right-of-way by resolution. The statute also states "no such vacation shall be made unless it appears to be in the public interest to do so. " CenterPoint Energy and Integra Telecom have both identified concerns in re- gards to the location of the private utility lines within the platted right-of-way, however, they do indicate that the granting of an easement in place of the current road right-of-way for their utility lines would alleviate their concern. A condition of approval has been attached to City Staff's recommendations re- quiring that an easement be granted by the property owners which would be sufficient for the maintenance of these utility lines. Upon review by City Staff and the City Attorney, it has been determined that the request for vacation of the Outlot A area adjacent to Lot 9 and Lot 10 cannot be considered by the City Council because this area is part of a larger property deeded to the City along with the wetland area on the west side of 1 Northwood Road. Deeded property must undergo a different process to re- move it from public possession. Also, the small triangular area designated as park which exists in the roadway of Butternut Circle cannot be vacated under this right-of-way vacation request. Vacation of park property is not subject the same rules as vacation of street right-of-way. Therefore, the applicant was advised to edit the vacation request to the right of way areas within the Northwood Road and Butternut Circle platted areas in front of Lot 10. The accompanying survey and resolution identifies the legal description of these right-of-way areas accordingly without the inclusion of the Outlot A area or Park area. ISSUES: The City Council must make two determinations. Does the vacation of the existing right-of-way comply with the Comprehensive Plan and is there a pub- lic need or anticipated future need for the dedicated property? Comprehensive Plan Review One of the goals of the Comprehensive Plan is to "provide well-maintained streets, water distributions systems, sewage systems, and other municipal services". The portion of the public right of way area proposed to be vacated in this case is not needed to provide adequate street access or utility service to the residential neighborhood. The roadway as travelled is not located within this platted right of way. Public Need The result of the excessive area of right-of-way width is the location of North- wood Road further west of the platted right-of-way. This curvature of the ex- isting roadway is a more suitable location for the roadway corridor that the sharper curvature of the platted right-of-way, therefore the City has no plans to relocate the existing Northwood Road with the originally platted right-of- way. The portion of the public right of way area proposed to be vacated is not needed to provide street access or utility service to the residential neigh- borhood contingent upon the granting of an easement for the existing gas main service line. Conclusion The portion of the public street right-of-way requesting to be vacated is not needed to facilitate access or utility services to the residential neighborhood contingent upon the granting of an easement for the existing gas main ser- vice line. As a result City Staff recommends approval of the vacation of the requested portion of right-of-way (excluding the areas included in Outlot A and designated as Park) with the following conditions: • The property owners shall grant an easement which would be suffi- cient for the maintenance of existing CenterPoint Energy and Integra utility lines. � The approval resolution vacating the public right of way shall be rec- orded at the Scott County Recorder's Office. ALTERNATIVES: 1. Receive input at the public hearing and if no new substantive concerns are identified, approve the attached resolution authorizing the proposed 2 vacation with the conditions set forth above as presented or with any changes as identified by the City Council. 2. Continue the discussion to a date and time certain to allow the City Staff to provide additional information specifically requested by the City Council. 3. Based upon expressed findings of fact, deny part or all of the applica- tions based upon inconsistency of the proposal with specific regulations of the Zoning and Subdivision Ordinances and/or specific policies of the Comprehensive Plan.
