HISTORY
On October 16th, 1989 the Prior Lake City Council adopted
Ordinance #89-03 (copy enclosed) which set forth
parameters and enabling legislation on restricting parking
within 2500 feet of public launch sites. On December 18th ,
1989, the City Council passed Resolution 89-37 (copy
enclosed), setting parking restrictions on streets in the
DeWitte Avenue access area. Resolution 89-37 lists
numerous streets that were posted "No Parking" zones.
Over time, some signs in the Sunset Hills subdivision have
disappeared. These missing signs will be replaced by new
"No Parking Vehicles with Trailers" if this resolution is
passed. Missing signage on the other designated streets
will also be replaced.
CURRENT CIRCUMSTANCES
Residents in the Sunset Hills subdivision have made
numerous complaints to the City regarding boat trailer
parking in the neighborhood and disrespect for personal
property by the owners of these vehicles.
Based on these complaints staff has evaluated the situation.
Using a letter (copy enclosed) soliciting the residents input
we collected feedback to a proposed parking restriction plan
that is similar to what was put in place in the Sand Point
area. The major restriction is the posting of "No Parking
Vehicles with Trailers" throughout most of the neighborhood.

The most significant "No Parking" zone is proposed on
Spruce Trail between Balsam and 170th Streets. The
results of the feedback is tabulated and included with this
report.
These recommendations are forwarded to the Council
because Ordinance 89-03 requires the Council to designate
the streets on which parking will be restricted and set the
fine for violation of the restrictions.
The entire Sunset Hills subdivision is within 2500 feet of the
DeWitte Avenue Public Access.
ISSUES
Some of the feedback received from the residents was
simply to ask where they were supposed to park their own .
boats? Legally, the ordinance would apply to all violators
regardless of residency.
Five of twenty-seven respondents were opposed to the
proposal. Some indicated they have not had a parking
problem in front of their homes. If parking restrictions are
enacted on only some of the streets in the subdivision the
trailers will assuredly show up along Spruce Trail and other
areas that currently don't perceive a problem. The issue
could potentially have to be revisited again in the near
future.
Some residents indicate they do not want the signs posted
in front of their homes. Normally, signs are posted at the
property lines so no one home is singled out for a sign in
front of their home. All signs are posted within the existing
right-of-way.
CONCLUSION
Based on the reponses to the proposed plan, staff
recommends implementation of the parking restrictions as
outlined in the letter. A letter has been sent to the
neighborhood indicating this issue will be considered by the
Council at their May 18, 1998 meeting.

AVENUE, AND SPRUCE TRAIL AND SETTING A FINE OF $50 PER VIOLATION

WHEREAS, on October 16, 1989, the City Council adopted Ordinance #89-03 setting
forth the parameters and enabling laws for this resolution, and
WHEREAS, residents have requested parking issues in this area be addressed, and
WHEREAS, parking by users of the lake access and residents of the neighborhood has
been and will continue to be a public safety issue.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that Balsam Street, Sunrise Avenue, and Spruce Trail between Sunset
Trail and Balsam Street are hereby designated "No Parking Vehicles with Trailers"
zones; and Spruce Trail between Balsam Street and 170th Street is hereby designated
a "No Parking" zone.
BE IT FURTHER RESOLVED, that the fine and violation of ordinance on these streets
is hereby determined to be $50 per violation.

ORDINANCE NO. 89-03
AN ORDINANCE AMENDING PRIOR LAKE CITY CODE, TITLE 11, CHAPTER 1.
The Council of the City of Prior Lake does hereby ordain:
Title 11, Chapter 1, of Prior Lake City Code is hereby amended by
adding new Sections 11-1-5, 11-1-6 and 11-1-7 which shall read as
follows:
11-1-5: PARKING RESTRICTED, PUBLIC LAUNCH SITES; IN GENERAL: The
City Council of the City of Prior Lake has determined
that separate parkin~ restrictions and penalty provisions are
necessary in the vic1nity of public launch sites of public bodies of
water in the City of Prior Lake due to increased traffic, congestion
and public health and safet~ hazards associated with the launching
and retrieval of boats, mov1ng of ice houses and other activities
associated with the public access facility. The City Council of the
City of Prior Lake has determined that extraordinary hazards exist
with respect to added pedestrian traffic and motor vehicle traffic
with obstructed views associated with ice houses, boats and trailers
and general increased risks at such facilities. Therefore, the City
Council has determined that increased restrictions and penalties are
necessary in order to enforce the regulations for public health and
safety reasons and to deter prohibited conduct in order to decrease
such hazards and risks to the public safety and welfare in the
vicinity of public launch facilities.

NO PARKING, STOPPING OR STANDING ZONES IN THE VICINITY OF
PUBLIC ACCESSES: The City Council may, by resolution,
desi~nate certain streets or portions of streets as no
park1ng or no stopping or standing zones within two thousand
five hundred feet (2,500') of public launch sites in the City
of Prior Lake. The City Council shall a~prove by resolution
the amount of fines for violation of th1s section of the
ordinance to which these parking restrictions apply. The City
Engineer shall mark b~ appropriate signs each zone so
designated and such s1gn shall indicate the amount of the
fine for violating the restriction which shall be imposed
u~on the violator. The sign shall further indicate that
v101ators' vehicles shall be subject to impoundment and/or
towing.
TOWING/IMPOUNDMENT: Because of the increased health and
safety hazards associated with ~ub1ic access areas in the
event the number of vehicles uS1ng those accesses at anyone
time is not adequately controlled, the City Council has
determined that impoundment/towing is necessary in order to
deter violations of the parking restrictions. Therefore, any
police officer, consistent with the provisions of Minnesota
Session Laws 1989, Chapter 256 (M.S. 169.041 and M.S.
514.18), may have a vehicle removed from the above no-parking

This ordinance shall become effective from and after its passage and
publication.
Passed by the City Council of the City of Prior Lake this 16th day of

WHEREAS, on October 16, 1989, the City Council adopted Ordinance
#89-03 setting forth the parameters and enabling laws on
the proposed resolution; and
WHEREAS, Dewitte Avenue area residents have requested this No
Parking issue be addressed by the City Council; and
WHEREAS, the Cit~ Council has discussed and considered the
imp1icat1ons and ramifications of the "No Parking" in
the access areas; and
WHEREAS, parking by users of the lake access and residents of
neighborhoods has been and will continue to be a health
and safety issue for the city of Prior Lake residents.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, MINNESOTA, that according to Ordinance 89-03 11-1-5A
the attached "No Parking" areas represents the specific
references and designated certain streets.

Dear Prior Lake Resident:
During the last few summers the City has received complaints about vehicles with boat
trailers parking in your neighborhood. Most of these vehicles have been using the
DeWitte Avenue Public Access to launch their boats on the lake.
As one way to prevent parking and traffic problems in your neighborhood we are
proposing to post "No Parking" and "No Parking Vehicles with Trailers" zones in your:
neighborhood as indicated on the graphic on the back of this letter. It should be noted
that due to visibility, there may be a need for "No Parking" zones along the inside of
curves on Spruce Trail, however, unless we have a number of requests for this we will
likely post that area as "No Parking Vehicles with Trailers".
We would appreciate hearing your input on this issue. Please call 447-9830 to indicate
your position regarding this proposal. This number is available 24 hours a day and you
may leave a message if you call after working hours. We will take your input until
Apri/17s 1998 at which time we will notify you again as to what the consensus of
your neighborhood is. We will then post the parking accordingly, or if there are major
differences of opinion we may invite you to a meeting to further discuss this issue with
you.
