BY SCOTT COUNTY) FOR DON MCKUSH.

Don McKush, the applicant, has petitioned the City Council to
approve a registered land survey, R.L.S., ( the number to be
assigned upon filing with the County Registrar) in accordance with
Section 6-8-1 (attached), of the Prior Lake Subdivision Ordinance.
"Minnesota Statutes 508.47 requires the filing of R.L.S.'s if the
Registrar so requires. The original intent of the above law was to
provide a means of simplifying some of the lengthy complicated
descriptions found in many certificates of title, and to prevent the
compounding of even more complicated descriptions on these
already unwieldy descriptions. The R.L.S. simply substitutes a
picture for the written metes and bounds legal description and uses
a tract letter and survey number in place of a wordy legal
description.
The R.L.S. is not a substitute for a plat. There are no dedications
on an R.L.S. it is simply a pictoral representation of an existing
metes and bounds parcel of record. The R.L.S. Act provides that an
R.L.S. must be approved by the local governing body before it can
be filed" (Mn. County Records Association: Registered Property
Procedures (Torrens). 1987, pp. 28-29).
The applicant owns Lone Pine Golf Course and resides at 15279
154th Street (County Road 82) in Prior Lake. The proposed R.L.S.
identifies the existing metes and bounds parcel of record which is
commonly known as Lone Pine Golf Course. Mr. McKush is in the
process of paying off a contract for deed for the property and was
advised by the Scott County Surveyors Office that an R.L.S. should
be filed for the parcel.
