HomeMy WebLinkAbout8C Vacate Easements Green Oaks (Marlen) O� P ���' � V � 4646 Dakota Street SE Prior Lake, MN 55372 � CITY COUNCIL AGENDA REPORT MEETING DATE: AUGUST 12, 2013 AGENDA #: 8C PREPARED BY: DAN ROGNESS, COMMUNITY & ECONOMIC DEVELOPMENT DIRECTOR PRESENTED BY: DAN ROGNESS AGENDA ITEM: CONDUCT A PUBLIC HEARING TO CONSIDER THE APPROVAL OF A RESOLUTION PROVIDING FOR THE VACATION OF DRAINAGE AND UTILITY EASEMENTS LOCATED WITHIN LOTS 7 AND 8, BLOCK 1, GREEN OAKS 2" ADDITION DISCUSSION: Introduction The purpose of this item is to consider a request by Mahowald Builders on be- half of Robert & Patty Hubbard to vacate drainage and utility easements lo- cated across property at 6094 Marlen Circle (PID 25-127-008-0). The property is located north of Highway 13 S., east of Green Oaks Trail. Histo In 1971 Green Oaks 2"d Addition was platted into 8 residential lots with 5 foot � side rear drainage and utility easements surrounding around each lot. In 1976 a building permit was approved to construct homes on the area of lot 7& 8 combined; the current home is located within the drainage and utility easement for lot 7& 8. The City cannot determine the exact date that a majority of Lot 7 and Lot 8 were combined into a single lot; however, it appears the combination occurred between 1971 and 1976. The City has no record of the side and rear drainage and utility easements being vacated; therefore, to construct a future addition on the site within the easement area, the property owner is requesting the easement be vacated at this time. Current Circumstances As required by Minnesota State Statute 412.851, the City Council is required to determine that, upon proper notification and hearing, "no such vacation sha/l be made un/ess it appears to be in the public interest to do so." The Planning Commission met on August 5 and made a recommendation to the City Council regarding the disposal or acquisition of public lands and easements as it relates to compliance with the Comprehensive Plan. Conclusion The existing easements are no longer necessary for public drainage and utili- ties; therefore, it is in the public interest to vacate the easement across Lots 7 and 8, Block 1, Green Oaks 2nd Addition. City Staff recommends approval of the vacation of the requested easements with the following condition: (1) the approval resolution vacating the drainage and utility easements shall be rec- orded at the Scott County Recorder's Office within 60 days of City Council ap- proval. ISSUES: The property owner cannot expand the house on this property with the existing easement in place. City staff has determined that no public utility or drainage purpose is needed now or in the future in relationship to the existing ease- ment. FINANCIAL None IMPACT: ALTERNATIVES: 1. Motion and a second to approve a resolution providing for the vacation of drainage and utility easements located within Lots 7 and 8, Block 1, Green Oaks 2"d Addition. 2. Motion and a second to deny the resolution based the proposed vacation not meeting Minnesota State Statue 412.851. 3. Motion and a second to table action and request staff to provide additional information as directed by the City Council. RECOMMENDED Staff recommends Alternative #1 MOTION: ATTACHMENTS: 1. Green Oaks 2"d Addition plat (1971) � I I � ; 04 rRr ti � U tr� 4646 Dakota Street SE 'yi� Prior Lake, MN 55372 RESOLUTION 13-�ocx A RESOLUTION PROVIDING FOR THE VACATION OF DRAINAGE AND UTILITY EASEMENTS LOCATED WITHIN LOTS 7 and 8, BLOCK 1, GREEN OAKS 2N� ADDITION Motion By: Second By: WHEREAS, A petition by Mahowald Builders on behalf of Robert and Patty Hubbard for the vacation of drainage and utility easements located within Lots 7& 8, Block 1, GREEN OAKS 2ND ADDITION has been duly presented to the City of Prior Lake, singed by the owners of the property subject to the following described easement situated in the City of Prior Lake, Scott County, Minnesota to wit: Legal Description (Drainage and Utility Easements): All that part of the drainage and utility easements on Lots 7 and 8, Block 1, Green Oaks 2�a Addition, Scott County, Minnesota described as follows: A strip of land 10.00 feet in width lying 5.00 feet each side of the following described centerline and its extensions: Commencing at the most southerly of said Lot 8; thence North 59 degrees 15 minutes 00 seconds East, assumed bearing along the southeasterly line of said Lots 7 and 8, a distance of 356.40 feet; thence North 00 degrees 02 minutes 31 seconds East to its intersection with the northerly line said Lot 7, the point of beginning of the centerline to be described; thence southwesterly along said northerly line to the northwest corner of said Lot 7; thence southwesterly along the westerly line of said Lot 7 to its intersection with a line drawn 50.00 feet northerly of and parallel with said southeasterly line of said Lots 7 and 8, and there terminating. WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable Minnesota Statutes; and WHEREAS, A Public Hearing was held on said petition on Monday, August 12, 2013, in the Council Chambers at City Hall, 4646 Dakota Street SE, Prior Lake; and WHEREAS, The City Council then proceeded to hear all persons interested in said petition, and persons interested were afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, The existing drainage and utility easements described herein are not necessary for the maintenance of public utilities. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council of Prior Lake has determined that the vacation of said easements would be in the public interest. 3.
