HomeMy WebLinkAbout13-108 Easement Vacation on Marlen CirclePRjQ\ U M �Ir� 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 13 -108 A RESOLUTION PROVIDING FOR THE VACATION OF DRAINAGE AND UTILITY EASEMENTS LOCATED WITHIN LOTS 7 and 8, BLOCK 1, GREEN OAKS 2"D ADDITION Motion By: Morton Second By: Souku WHEREAS, A petition by Mahowald Builders on behalf of Robert and Patty Hubbard for the vacation of drainage and utility easements located within Lots 7 & 8, Block 1, GREEN OAKS 2ND ADDITION has been duly presented to the City of Prior Lake, singed by the owners of the property subject to the following described easement situated in the City of Prior Lake, Scott County, Minnesota to wit: Legal Description (Drainage and Utility Easements): All that part of the drainage and utility easements on Lots 7 and 8, Block 1, Green Oaks 2 nd Addition, Scott County, Minnesota described as follows: A strip of land 10.00 feet in width lying 5.00 feet each side of the following described centerline and its extensions: Commencing at the most southerly of said Lot 8; thence North 59 degrees 15 minutes 00 seconds East, assumed bearing along the southeasterly line of said Lots 7 and 8, a distance of 356.40 feet; thence North 00 degrees 02 minutes 31 seconds East to its intersection with the northerly line said Lot 7, the point of beginning of the centerline to be described; thence southwesterly along said northerly line to the northwest corner of said Lot 7; thence southwesterly along the westerly line of said Lot 7 to its intersection with a line drawn 50.00 feet northerly of and parallel with said southeasterly line of said Lots 7 and 8, and there terminating. WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable Minnesota Statutes; and WHEREAS, A Public Hearing was held on said petition on Monday, August 12, 2013, in the Council Chambers at City Hall, 4646 Dakota Street SE, Prior Lake; and WHEREAS, The City Council then proceeded to hear all persons interested in said petition, and persons interested were afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, The existing drainage and utility easements described herein are not necessary for the maintenance of public utilities. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council of Prior Lake has determined that the vacation of said easements would be in the public interest. 3.
