CONSIDER APPROVAL OF A RESOLUTION REQUESTING A
VARIANCE FROM MUNICIPAL STATE AID STANDARDS FOR MAIN
AVENUE, CITY PROJECT #04-01

On September 16, 2003, the City Council approved Resolution 03-160
authorizing Bonestroo Rosene Anderlik & Associates (BRAA) to prepare
plans and specifications for reconstruction of Main Avenue from CSAH 21
to Kop Parkway and Dakota Street from TH 13 to Erie Avenue
(commonly known as the downtown redevelopment project). This project
is in the adopted 2004 Capital Improvement Program.
The purpose of this agenda item is to authorize a submission to the
Minnesota Department of Transportation (MnDOT) for a variance to
Municipal State Aid (MSA) Standards for width of Main Avenue.
Municipal State Aid (MSA) funding is to be used to assist in financing this
proposed project. MSA rules require that streets with diagonal parking on
both sides must be designed to a 66-foot width (33 feet from centerline to
curb). Main Avenue has an existing right of way of 80 feet with existing
building fronts at or over the right of way line. A 66-foot wide road would
only allow for a 4-foot wide sidewalk in some locations. BRAA is
proposing a 31-foot wide roadway from centerline to face of curb (total
width of 62 feet) instead of the 33 feet required by MSA. BRAA and staff
are of the opinion that this variance is a minor adjustment and would not
cause any traffic or pedestrian problems.
In order to minimize disruption to adjacent properties, maximize sidewalk
widths, and to utilize Municipal State Aid Funds on Main Avenue, a
variance from State Aid standards is required. Adopting the attached
resolution at this time will allow the State Aid committee to review the
request and, if approved, will provide the City with MSA funds to complete
the Main Avenue construction project in 2004.
There are two alternatives for the City Council to consider:
1. Approve a motion as part of the Consent Agenda to adopt a
Resolution requesting a variance from Municipal State Aid standards
for construction of Main Avenue, City Project No. 04 - 01.

WHEREAS, the Prior Lake City Council intends to let a construction project located on
Main Avenue, from County State Aid Highway 21 (Eagle Creek Avenue)
to approximately 850 feet north of Dakota Street, in the City of Prior Lake,
Minnesota, which will entail street light replacement, curb and gutter
improvements, sidewalk reconstruction and storm sewer improvements,
making the area more pedestrian-friendly; and
WHEREAS, this portion of Main Avenue has an existing right-of-way width of 80 feet,
which is also the approximate distance between buildings from one side
of the road to the other; and
WHEREAS, the Average Daily Traffic (ADT) for this portion of Main Avenue is less
than 3,000 vehicles per day, and striped 45 degree diagonal parking is
currently allowed on both sides of the portion of Main Avenue, which is 58
feet wide from C.S.A.H. 21 to 200 feet north of Dakota Street with
variable width sidewalks; and
WHEREAS, the Prior Lake City Council proposes to reconstruct this portion of Main
Avenue in the City of Prior Lake, Minnesota as a 62 foot wide roadway
with 45 degree diagonal parking allowed on both sides of the roadway,
and construct a minimum six and a half foot wide sidewalk along this
portion of Main Avenue, and allow planting of some trees in this part of
Prior Lake's Downtown Area, and
WHEREAS, Minnesota Rules for State Aid Operations 8820.9961 require a minimum
2 foot width between the traffic lane and 20 foot parking stall depth when
45 degree diagonal parking is allowed on both sides of a roadway with
current ADT less than 3,000 vehicles per day;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The City Council does hereby request a variance to Minnesota Rules
for State Aid Operations 8820.9961, so as to allow the reconstruction
of Main Avenue as a 62 foot wide roadway from face to face of curb
with 45 degree diagonal parking on both sides of the roadway
between C.S.A.H. 21 and Dakota Street and to allow the
reconstruction of Main Avenue as a 31 foot wide roadway from center
of road to face of curb with 45 degree diagonal parking on one side of
the roadway between Dakota Street and approximately 200 feet north

of Dakota Street in Downtown Prior Lake, Minnesota, in lieu of the
required 66 foot wide roadway and 33 foot wide roadway respectively.
3. That construction plans for this portion of Main Avenue in the
Downtown Area of Prior Lake, Minnesota be submitted for approval by
the State Aid for Local Transportation Office which include a Diagonal
Parking Plan in the form of a cooperative agreement between the
local road authority and the Commissioner of Transportation, which
meets all other applicable standards required for approval by the
State Aid for Local Transportation office.
4. That the City of Prior Lake, Scott County, Minnesota hereby
indemnifies, saves, and holds harmless the State and its agents and
employees of and from claims, demands, actions, or causes of action
arising out of or by reason of the granting of the variance. The City
further agrees to defend at its sole cost and expense any action or
proceeding begun asserting any claim of whatever character arising
as a result of the granting of the variance. Nothing herein shall
increase the liability of the City beyond the statutory limitation of MINN
STAT 9 46604, Subd. 1.
5. That the City of Prior Lake, Scott County, Minnesota hereby
indemnifies, saves and holds harmless Scott County and its agents
and employees of and from claims, demands, actions, or causes of
action arising out of or by reason of the granting of the variance. The
City further agrees to defend at its sole cost and expense any action
or proceeding begun asserting any claim of whatever character
arising as a result of the granting of the variance. Nothing herein shall
increase the liability of the City beyond the statutory limitation of MINN
S~.A T 9 466 04, Subd. 1.
