AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION ACCEPTING PROPOSALS
AND AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE
THE CITY'S STANDARDIZED PROFESSIONAL SERVICES CONTRACT
WITH ELEMENT MATERIALS TECHNOLOGY TO PROVIDE
CONSTRUCTION TESTING SERVICES FOR THE RIDGEMONT / MAIN /
TH 13 IMPROVEMENT PROJECT (CITY PROJECT #13-001)
DISCUSSION: I ntroduction
The City Council has awarded a bid for the above referenced project. This
agenda item considers approval of a contract to complete construction
testing in association with this project.
Histo
In 2008, the City completed a Feasibility Report for the improvement of the
intersection of Ridgemont Avenue, Main Avenue, Trunk Highway 13, and
County State Aid Highway 44. The Feasibility Report discussed traffic
demands, safety and access issues, roadway geometric design, urban
design elements, right of way impacts, and preliminary cost estimates.
Currently the orientation of this intersection is confusing. The close
proximity of Ridgemont and Main Avenue to Highway 13 complicate
navigation. The efficiency of this intersection is poor as vehicles must
frequently wait on Ridgemont Avenue during peak hours as traffic backs up
on at Highway 13.
The proposed project includes the reconstruction of Ridgemont Avenue
and Main Avenue on the west side of Highway 13. Reconstruction of �
County Road 44 on the east side of this intersection will not be changed
significantly, however a new traffic signal at Highway 13 will be I �
constructed. Updated pedestrian facilities, stormwater ponding, and trail
reconstruction will be a part of the project.
Once the Feasibility Report was completed, this project was incorporated
into the 10 year Transportation Plan and the 5 year Capital Improvement
Plan. This project has been programed in these planning documents since
2009. The City has worked with MNDOT and Scott County in coordinating
funding for this project in the year 2013.
On September 10, 2012, the City commissioned WSB and Associates to
perform the engineering design for the project. Since this authorization,
WSB has been busy designing this project.
On December 4, 2012, the City learned that we were successful in securing
additional dollars, $674,763, for this project in the form of the "MNDOT
Cooperative Agreement Program". This additional funding reduces the
amount of City Municipal State Aid and City Tax Levy which was planned
for this project.
On May 28th, 2013, the City Council approved several resolutions including
a resolution authorizing the advertisement for bids on the project.
On July 22, 2013 the City awarded a contract with Chard Tiling in the
amount of $2,103,380.45 for the construction.
Current Circumstances
Staff has requested proposals from the three firms listed in the consultant
pool for construction testing. They include: American Engineering Testing,
Element Materials Technology, and Braun Intertec. Each of these firms
has a positive history of construction testing in Prior Lake. The results are
tabulated below:

The proposals received were each reviewed using an estimated
construction testing estimate. The number of tests actually performed
could be less than the estimate or could exceed the estimate. For the
purposes of evaluation, the consultant provided a unit price for each item
listed in the estimated construction testing estimate. The results were
analyzed and City Staff is recommending that Element Materials
Technology be selected to perform the construction testing for the
Ridgemont / Main / TH 13 Project. Element is currently under contract to
perform geotechnical services for the Sunset Avenue Improvements project
and CSAH 12.
Conclusion
It is recommended that the City enter into a standardized professional
services contract with Element Materials Technology for the Ridgemont /
Main / TH 13 Improvement Project.
ISSUES: No issues are identified.
FINANCIAL The cost for construction testing was part of the overall project support
IMPACT: costs to delive.r this project. The pricing as received was expected.
ALTERNATIVES: 1) Approve a resolution accepting proposals and authorizing the Mayor
and City Manager to execute the City's Standardized Contract for
Professional Services with Element Materials Technology for the
Ridgemont / Main / TH 13 Improvement Project.
2) Deny this item for a specific reason and provide Staff with direction.
3) Table this item until some date in the future

A RESOLUTION AUTHORIZING ELEMENT MATERIALS TECHNOLOGY TO PROVIDE
CONSTRUCTION TESTING SERVICES FOR THE RIDGEMONT 1 MAIN 1 TH 13 IMPROVEMENT
PROJECT (CITY PROJECT # 13-001)

WHEREAS, Construction testing is a necessary service needed to properly install City infrastructure;
and,
WHEREAS, Construction testing is needed for the Ridgemont / Main I TH 13 Improvement Project,
City Project #13-001; and,
WHEREAS, The City does not have the equipment or expertise to provide these services; and
WHEREAS, The City solicited and evaluated proposals from qualified firms to provide construction
testing for the Ridgemont I Main I TH 13 Improvement Project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Element Materials Technology is hereby selected to provide Construction Testing Services for the
Ridgemont / Main / TH 13 Improvement Project for a base price in the amount of $18,691.00 and the
unit pricing rates shown in the proposal and attached to the City's Standartl Professional Services
Contract.
3. The Mayor and City Manager are authorized to execute the City's Standard Professional Services
Agreement on behalf of the City.
4. Funding for these engineering services will be drawn from the Construction Fund Account #501-48376-
505.
